My husband and I are currently doing a home improvement project at our residence located at 2055 Grand Avenue in Mattituck. For a reference,the Building Permit number is#45096.The home improvement contractor is HomeworkPCSK, Inc. and on 2.2.2021 we had a water intrusion issue in the basement where the new addition is as well as other areas of the basement.The issue was reported to HomeworkPCSK, Inc.We were advised by Steven Kaplan on 11.6.2020 that the foundation inspection had taken place.Steven Kaplan has advised us on multiple occasions that the home is completely weather proofed. On 11.12.2020 John Jarski noted the following: J 1. Must Certify footing, foundation, and damp proof. 2. Frame and Strap OK. 3. Amend Plans for ALL changes. Sometime in November,Steven Kaplan contacted architect David Turner and requested that he provide an inspection report for the Concrete footings,foundation wall and damp-proofing. On 12.5.2020 David Turner provided the inspection report stating Concrete footings,foundation wall and damp-proofing installed as per code. On 2.3.2021 my husband and I spoke to David Turner regarding the water intrusion issue for the new addition and he advised when Steven Kaplan requested the inspection report he was under the impression the foundation,footings and damp proofing were scheduled to be inspected by the building department.We explained to David that John Jarski could not perform that inspection because the work had already been covered up and would require it to be dug back out for the inspection to be done. David Turner went on to state he had only inspected the footings and foundation because the damp proofing had not been done when he was on-site.So,the inspection report provided by David Turner is not valid and the footings,foundation, and damp proofing were never inspected by the building department. The property has never had any water issues in the basement.The property had to be excavated for the home improvement.The contractor removed all gutters and downspouts on the house and the yard is not grated because the work that was supposed to be completed on 12.7.2020 is months past due and is nowhere near completion.All water, rain, snow etc., are settling at the base of the foundation and thus we have water intrusion in the basement/cellar. I have left numerous voicemails for John Jarski to call me regarding our concerns with the foundation inspection not being done by the building department and the architect certification not being accurate and he has not returned my calls. STATEMENT OF FACTS We hired Homeworkpcsk, Inc., ("HWI"), in July, 2020 to perform home improvements on our house at 2055 Grand Avenue, Mattituck,New York 11952, ("Property"). The Property was to be renovated, including,but not limited to, new roof, siding, windows, doors, kitchen, baths, insulation, sheet rocking, and finishing. We did not receive an agreement which contained the items required by Section 771 of the New York General Business Law, as set forth below in detail. Rather, we received only an unsigned scope of work electronically (Exhibit A).No document was ever signed. The home improvement was to be performed at a cost of$346,400.00 plus the cost of appliances in the amount of$10,891.88. Improvement was to be completed by the first week of December,2020, as set forth in another electronic communication which contained an incorrect job reference (Exhibit B). We paid to HWI the total sum of$327,400.00 by a series of wire transfers (Exhibit Q. The home improvement proceeded so slowly that we became alarmed that the amount we already paid had far exceeded the amount of the work done. We requested on numerous occasions an accounting from (HWI) (Exhibit D). These requests went unanswered. In mid-November, 2020 we retained an attorney who also requested the same information—this request went unanswered(Exhibit E). In December, 2020,we finally demanded a verified statement pursuant to Lien Law Article 3-A(Exhibit F). HWI did not timely provide the verified statement. However, it did provide a statement which was entirely inconsistent and unsatisfactory (Exhibit G). The statement demonstrated that here have been insufficient funds (both paid and due)to cover the costs of improvement. HWI was so advised(Exhibit H). We continued to request a full accounting, including evidence of payments, invoices, etc. but have not received same. HWI has now demanded additional payment be made for claimed"extras". We have requested documentation concerning the nature and amount of these extras, but HWI has refused to provide same. Rather, it has threatened to walk off the job. We now seek the intervention of the Suffolk County Department of Consumer Affairs. We understand that HWI does not hold a Suffolk County Home Improvement Contracting License but that Tracy White, a claimed principal thereof, has such a license under ID#HI-60629. Tracy White and Steve Kaplan are the purported principals of WHI. THE VIOLATIONS OF GENERAL BUSINESS LAW ARTICLE 36-A AND SUFFOLK COUNTY CODE CHAPTERS 563 and 387 HWI and its principals are in violation of New York General Business Law Article 36-A and Suffolk County Code Chapters 563 and 387. The sections concerning these violations are set forth below. A. NEW YORK GENERAL BUSINESS LAW ARTICLE 36-A i New York General Business Law Article 3-A governs home improvement contractors. Section 771 thereof requires that home improvement contracts be evidenced by a signed writing and contain the hours enumerated therein. HWI is in violation of this section and Suffolk County Code Section 563-21 by reason of the following: (1) There is no signed home improvement contract; (2) HWI did not purport to provide starting and finalizing dates for the work until 3 months of the commencement; (3) The failure to disclose that non-payment would result in a lien; (4) The failure to disclose the deposit of funds received and the application of Lien Law Article 3-A; and (5) The failure to disclose the existence of a three-day recission period. B. SUFFOLK COUNTY CODE CHAPTER 563 Suffolk County Code Chapter 563 governs licensed occupations including, but not limited to, home improvement contractors. It applies to HWI and its principals. Section 562-10 sets forth acts and omissions by one in the regulated occupations, including,but not limited to, home improvement contractors, and includes, as relevant: (1) Abandonment or willful failure to perform, without justification, any contract engaged in by a licensee; (2) Willful deviation from or disregard of contract specifications or estimates in any material respect without the consent of the contracting party; (3) Engaging in deceptive or unconscionable trade practices in the solicitation or procurement of a contract, or in the preparation of or performance of a work estimate or invoice, or in the collection of debts incurred for consumer goods and services. A deceptive practice includes failure to state a material fact if such failure deceived or tends to deceive. Section 563-18 requires anyone acting on behalf of a licensee to possess and exhibit salesmen's identification card. Section 563-21 sets forth additional acts which are prohibited by home improvement contractors and include, as relevant: (1) Failure to enter into a written contract for work to be performed which specifies starting and completion dates, description of costs of labor and materials; (2) Willful or deliberate disregard in the violation of government building, sanitary, fire and health laws of the state or any political subdivision thereof in which the work is performed; (3) A failure to abide by any provisions of Section 771 of the New York State General Business Law. z The acts and omissions of HWI and its principals fall squarely within these prohibitions. Specifically, the acts and omissions consist of the following: (1) Failure to comply with Section 563-21(c), as set forth above; (2) Failure to comply with Section 771 of the New York General Busines Law, as set forth above; (3) Failure to fully account for trust assets - funds received by HWI; (4) Failure to disclose the details of subcontractors contributing to the home improvement, including, but not limited to, identity, licensing information, agreements, invoices and proof of payment; (5) Failure to disclose the details of materialmen contributing to the home improvement, including, but not limited to, identity, licensing information, agreements, invoices and proof of payment; (6) Failure to provide proof of insurance with respect to subcontractors; (7) Failure of Steven Kaplan, who negotiated the home improvement on behalf of HWI to exhibit a salesman's identification card; (8) False representations that windows have been timely ordered when, if fact,they had not; (9) False representations that roofing material had been timely ordered when, in fact, it had not. (10) False representations that doors had been timely ordered when, in fact, they had not and that the specified doors and hardware were incompatible. (11) False representations that the foundation had been properly damp-proofed and inspected when, in fact, it had not and had been covered so as to preclude inspection by the building inspector. The basement now leaks; (12) Failure to provide drawings and specifications for kitchen cabinetry; (13) Failure to timely and properly order tiles; (14) Demanding additional funds for asserted extras and refusal to provide documentation and substantiation for the nature and amount of the changes, as described in detail below in the description of disputed amounts. (15) Failure to timely complete the home improvement. C. DISPUTED AMOUNTS Due to the failure to provide a proper accounting of the amounts held in trust,the failure to document and substantiate amounts deemed as extras, and the threat to discontinue work if additional payments are not made, both the entire amount paid to date is in dispute and the additional amounts unpaid are in dispute. It appears that it may be necessary to engage a new contractor to finish the job at what will undoubtedly be a much greater cost. In addition, specifically,the following items are subject to dispute: (1) All claimed cash payments for labor and materials as no substitution has been provided; (2) All payments made to unlicensed subcontractors. Sometime in November,Steven Kaplan contacted architect David Turner and requested that he provide an inspection report for the Concrete footings,foundation wall and damp-proofing. On 12.5.2020 David Turner provided the inspection report stating Concrete footings,foundation wall and damp-proofing installed as per code. 4 On 2.3.2021 my husband and I spoke to David Turner regarding the water intrusion issue for the new addition and he advised when Steven Kaplan requested the inspection report he was under the impression the foundation,footings and damp proofing were scheduled to be inspected by the building department.We explained to David that John'Jarski could not perform that inspection because the work had already been covered up and would require it to be dug back out for the inspection to be done. David Turner went on to state he had only inspected the footings and foundation because the damp proofing had not been done when he was on-site.So,the inspection report provided by David Turner is not valid and the footings,foundation, and damp proofing were never inspected by the building department. In July 2020, licensed architect David Turner assisted Homework PCSK, Inc. in filing the paperwork to apply for a building permit for our home renovation and in August 2020 the building department issued BP #45096. Neither David Turner or Tracy White the license holder for Homework PCSK, Inc filed the temporary and final Stormwater management plans that are required by Southold Town Code § 236-7. In addition to not filing the required stormwater management plans they ignored Jimmy Deerkoski's stormwater management provisions as shown on page S1 of the building plans. For example, the dry wells shown in the plans were not installed. On 2.2.2021 we had a stormwater intrusion issue in the basement that we reported to HomeworkPCSK, Inc. Pre-construction our stormwater management plan controls included leaders and gutters. During construction, leaders and gutters were removed at the direction of Steven Kaplan. Tracy White and Steven Kaplan not only neglected to have temporary provisions in place during construction to address potential stormwater runoff infiltration issues they failed to bring this to our attention. We now must be worried that the presence of stormwater intrusion into the basement could result in black mold causing health related issues to our already medically fragile child. On 12.5.2020 David Turner provided a certified inspection report with findings of Concrete footings, foundation wall and damp-proofing installed as per code when he never inspected the damp-proofing. It is our understanding that David Turner should have only certified the items he inspected. On 2.21.2021 David Turner further injected himself into the matter by concluding that the water intrusion issues in the basement could not have been caused by removing leaders and gutters. We are uncertain as to David Turners motivation regarding his conclusion because Homework PCSK failed to have any provisions during construction to address stormwater runoff and water infiltration after the removal of the leaders and gutters. Based on yesterday's update from Steven Kaplan the stormwater provisions as shown on page S1 of the plans has not been done.
