Like many businesses containing retail floor areas, an alteration of that floor plan which substitutes or provides office space, is not prohibited or disallowed under zoning, either with single units (tenants), or throughout the entire building floor area. The purpose of this letter is to affirm the multi uses of the building at Sterling Lane and Route 25 (North West Corner). This building has two separate sections and over the years they have been used continuously as a seed store, a penny & ice cream store, a full service retail garden center, and retail/wholesale auto parts store with offices and a full service machine shop. These various business owners have used the premises simultaneously. If I can be of any more assistance on this matter please feel free to call upon me. We 've never been able to use this area for anything , it just sits there , we pay taxes on it, it looks lousy all the time, except in the front. THE CHAIRMAN : Is there any reason why it would have to be on the east side? PETER STERLING: Well, we 're just so wide. THE CHAIRMAN: Well, what about over here on the north side: PETER STERLING: On that side we have a greenhouse display, we always had bird baths and that sort of thing , it leads around Southold Town Board of Appeals -7- January 27 , 1977 1 � to the greenhouse. We don't have the area for a ground display there. THE CHAIRMAN: I believe your family home is on the right- of-way, you own the right-of-way and Hills has part? PETER STERLING: Right. (There was no response. ) After investigation and inspection the Board finds that the applicant requests permission to construct addition with insuffi- cient side-yard setback, Main Road , Cutchogue, New York. The findings of the Board are that the applicant will still have more than sufficient side-yard area for the "B-1" zone. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance . The portion of the subject premises which is under jurisdiction in this variance application consists of approximately 82,880 sq. ft. and is located in the "B" General Business Zone District. FRIEMANN decision, continued: ) The area of land under consideration in this variance has a frontage of 132.0 feet along the north side of State Route 25 (a/k/a Main Road) in the Hamlet of Cutchogue, Town of Southold. The width of the remaining (rear) section {referred to as Lot #1) is 683. 44 feet {inclusive of easements) . 2. The subject premises as exists: (a) contains a total combined lot area of 19.596 acres; (b) are improved with structures as more particularly shown on the plan prepared by Roderick VanTuyl, P.C. dated November 1, 1990. 3 . Article X, Section 100-102, (Bulk Schedule) of the zoning code regulations (as amended January 9, 1989) requires a minimum lot depth of 150 feet and minimum width of 150 feet per lot. 4. The relief sought by this application are variances for approval of: (a) proposed southerly lot referred to herein as Lot #3 with a lot width (frontage) of 132. 00 feet, inclusive of easements or right-of-way (or 117+- feet exclusive) ; (b) proposed center lot referred to herein as Lot #2 with a total lot area of 40,192 sq. ft. , inclusive of right- of-way or easements; (c) access to Lot #2 and Lot #1, over a 22 ft. wide right-of-way, half of which is shown to be located upon premises of the applicant and the other half upon premises of S & E Realty Co.
