SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 15,632 sq. ft. lot located in an R- 40 Zoning District. The property has a 105 foot road frontage along Mayflower Road, then turns west for 150 feet, turning north for 105 feet for the rear yard, before returning 150 feet back to Mayflower Road. The property is improved with a one-story, residence, and inground accessory pool, and an as-built accessory garage in the rear yard as shown on a survey prepared by Joseph A. Ingegno,L.S., dated August 2,2001. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspectors October 4;-2022-Notice-of Disapproval based,on-an-application-for a=perrnit-to=legalize.an-.accessory garage, at; 1) located less than the code required minimum side yard setback of 5 feet; located at: 405 Mayflower Road,Mattituck,NY. SCTM No. 1000-107-8-21. RELIEF REOUESTED: The applicant requests a variance for the existing as-built garage that is located 4.1 feet from the side yard property line where a 5 feet minimum setback is required. ADDITIONAL INFORMATION: In both written and oral testimony at the public hearing it is noted that the current residence, and accessory swimming pool currently have valid certificates of occupancy. As stated in the testimony at the public hearing, the current as-built garage was built prior to the current ownerpurchasing the residence and the applicant is seeking to legalize the structure with variance relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other'evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: I ' r Page 2,January 19,2023 #7734,MacDonald SCTM No. 1000-107-8-21 I- Town Law§267-b(3)(b)(D. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The garage does not increase the lot coverage beyond the maximum allowed, and as itis only one story in height which is in keeping with other accessory structures in the neighborhood. Furthermore, according to the applicant's representative,the interior of the accessory garage shall be unfinished and unconditioned space with only electrical service installed. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The garage is currently as built, and so the only way to achieve a valid certificate of occupancy is with setback variance relief for the existing structure. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 18% relief from the code. However, the garage conforms in all other ways to the zoning code, and is typical of the accessory structures found in this neighborhood. 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and the conditions of this board. 5. Town Law 12267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is-the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while. preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Weisman(Chairperson),and duly carried, to RANT the variance as applied for SUBJECT TO THE FOLLOWING CONDITIONS• I. The applicant's architect,, Curtis Taurman, shall submit a new site plan correcting the original site plan dated September 2,2022, showing the correct property line lengths. 2.
