TERMS AND CONDITIONS The Permittee Nancy&Philip Weber, residinjz at 160 The Strand, East Marion, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Box 1047 Southold, NY 11971 RE: NANCY & PHILIP WEBER 160 THE STRAND, EAST MARION SCTM# 1000-21-5-7 Dear Mr. Kimack: The Board of Town Trustees took the following action during its Regular meeting held on Wednesday, May 17, 2023 regarding the above matter: WHEREAS, Michael Kimack, on behalf of NANCY & PHILIP WEBER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated March 13, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program Policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: establish and perpetually maintain a 15' wide vegetated non-turf buffer planted with native vegetation; bringing rocks as close to the toe of bluff as possible, no use of naturally occurring beach boulders; WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 17, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 'WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS,'the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of NANCY & PHILIP WEBER to remove top sandbag; install 71 linear feet of rock revetment seaward of the embedded sandbags; the boulders will weigh a maximum of 2.5 tons per linear foot for a total weight of 177.5 tons; install a stabilization fabric under and landward of boulders; place approximately 395 cubic yards of clean fill to reconstruct the slope and install one layer of jute matting, pinned with 6" fasteners and plant American beach grass (o/e) at one (1) foot on-center; area of disturbance approximately 2,700 square feet; construct a 1' high berm with approximate base of 5' at top of bluff; cover with one (1) layer of jute matting (o/e); with the condition of the removal of all sandbags with a Trustee inspection to follow; establish and perpetually maintain a 15' wide vegetated non-turf buffer inclusive of the berm; rocks be moved as close to toe as possible to follow the contour; no construction during bluff swallow,nesting season; no naturally occurring boulders located on beach are to be used; access via the community ramp; and as depicted on the revised site plan prepared by M.A. Kimack, last dated May 24, 2023, and stamped approved on May 26, 2023. SCTM# 1000-21-5-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 1. Relocate the revetement to the toe of the bluff to protect public access. 2. The LWRP policies strive to reduce shoreline hardening. 3. The beach's geology will change due to this revetment. The loss of the beach over time may occur due to the reduction of sand supply from the eroding bluff, sand scouring from high energy wave events and sea level rise. 4. Vegetative buffers are most effective in stabilizing soil structure. 5. If the action is approved, no boulders naturally occurring on the beach should be used in construction.
