Completion of revegetation & path to dock
Dear President Goldsmith and Board:
As you may recall this application to extend the dock was litigated. The matter was
settled on appeal after Article 78 was granted to the owner. The owner is completing one of the
conditions of the permit and agreed upon during settlement: Revegetate area seaward of pool
fence. One of the listed plants"Carex-known as Silk Tassel"on the revegetation plan is not
available. The landscaper would like to replace this plant with more of the other plants specified
in the landscape plan (attached plant list). Please advise if that is acceptable.
Also,the pathway to the dock was improved during the permitting process in 2024 and
there was no objection to the gravel and field stone on the pathway to the dock(see enclosed i
picture). The owner wants to continue the path landward to the house and through the 4' path in
the revegetation area. Please advise if this is acceptable as part of the settlement or if you want
me to apply for an administrative permit to extend the pathway which was previously grass.

WHEREAS, DECLARANT-(S) is/are the owner(s) of certain real property located
On 497 Ripple Water Ln., Southold, , Town of Southold, County of Suffolk, State
of New York, described in the Suffolk County Tax Map as
District 1000, Section 76, Block 01, Lot 15.3 which is more particularly bounded
and described as set forth in Schedule "A" annexed hereto, hereinafter referred

WHEREAS, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the "Trustees") pursuant to
Chapter 275 of the Town Code of the Town of Southold or its successor, and various
activities conducted upon the property may thus be subject to the regulation and
approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT(S) therefore made application to the •Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake certain
regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake
such regulated activities, the Trustees required that a 6299 square foot "non-
disturbance buffer" adjacent to and landward of the edge of wetland line as approved
by the Southold Board of Trustees on August 23, 2002 and as depicted on the survey
of Nathan Taft Corwin III revised September 25, 2014 and stamped approved by the
Southold Board of Trustees on October 3, 2014 be installed; and WHEREAS, the
DECLARANT has considered the foregoing and has determined that
the same will be for the best interests of the DECLARANT and subsequent owners of
the Property.
NOW, THEREFORE, the DECLARANT(S) do/does hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted
activities there shall be established and perpetually maintained 6299
square foot "non-disturbance buffer" as defined by Chapter 275 of the
Town Code: to wit:
A vegetated area, as designated by the Board of Trustees, immediately
landward of the wetland boundary, shoreline structure, or other line
designated by the Trustees where no operations, maintenance, placement of
signs or other activities may take place, except that man-made debris may be
removed from such area by hand without the permission of the Board of
Trustees". An application for a wetland permit may be submitted for the removal
of harmful, "invasive" or non-native vegetation; and as depicted on the survey
of Nathan Taft Corwin III revised September 25, 2014 and stamped approved by
the Southold Board of Trustees on October 3; 2014, see Exhibit A attached;
and
2) These covenants shall run with the land and shall be binding on the

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 17, 2023 and again on Wednesday, October 18, 2024 regarding the above
matter:
WHEREAS, Patricia Moore, Esq. on behalf of ANDREW &ANDREA WEISBACH applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated March 16, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be found
Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the following
Best Management Practice requirements: re-establishing the Non-Disturbance Buffer area from
the pool deck to the wetlands; a 4'wide access path to the dock; remove the lighting and
irrigation in the area seaward of the dwelling; remove the kayaks; and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
May 17, 2023, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management Practice
requirement imposed above, the Board of Trustees deems the action to be Consistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code,
and,
RESOLVED, that the Board of Trustees AMENDS the Resolution dated May 17, 2023 to read
as follows:
RESOLVED that the Southold Town Board of Trustees APPROVES the application of
ANDREW &ANDREA WEISBACH for a Wetland Permit to remove the existing floating docks
and adjustable ramp off of the existing permitted 4'wide by 65' foot long dock with 8" CCA
treated timber piles; off of seaward end of dock construct proposed 4'x24' fixed dock extension
with 4' wide steps down to a 4' wide by 16' long fixed "T' dock section supported with 8"
diameter CCA timber pilings; all decking to be Thru-Flow type material; water and electric on the
dock; install an aluminum ladder on the "T" section; total length of fixed dock to be 93'; with the
conditions that the backyard be replanted with native vegetation; with a survivability inspection
after one (1) year of planting; the re-establishment of the 50' Non-Disturbance Buffer from the
pool deck to the wetlands; allowing for a 4' wide access path to the dock on the side of the
dwelling; remove the lighting in the area seaward of the dwelling; remove the irrigation in the
area seaward of the dwelling; and remove the kayaks from their current location.; and as
depicted on the site plan prepared by Jeffrey Patanjo, last dated October 14, 2024, and
stamped approved on October 25, 2024.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

TERMS AND,CONDITIONS
The Permittee Andrew&Andrea Weisbach,residing at 497 Ripple Water Lane Southold New
York as part of the consideration for the issuance of the Permit does understand and prescribe to
the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 36 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold•require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees',the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without'expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and.deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does'not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

TRUSTEE SEPENOSKI: Number 10, REVISED PROJECT DESCRIPTION AND PLANS

requests a Wetland Permit to remove the existing floating docks and adjustable ramp off of the
existing 4'wide by 65'foot long catwalk which shall remain undisturbed; off of seaward end of
catwalk, construct a proposed 4'x24'fixed catwalk extension supported with 8" diameter CCA
pilings and using Thru-Flow decking leading to the relocated T wide by 12' long aluminum ramp
which shall be permanently attached to a proposed 4'wide by 16' long fixed "T° section of
catwalk; and to install an aluminum ladder at the end of the"T' section to gain access to boat
during low tide.
Located: 497 Ripplewater Lane, Southold. SCTM# 1000-76-1-15.3
The project description received 5/1112023.
The Trustees recently reviewed the application on May 9th, 2023. Visited the site. Notes
from that visit read: Provide water depths; suggested proposed configuration; a dock of
similar length of existing but in fixed format; remove floats; remove lighting on docks; remove
lighting on access path; remove irrigation on access path; allow non-disturbance area to
naturalize.
The LWRP found the project to be inconsistent with its policy standards. And following
comments provided to the Board.
The length of the private dock structure into public waters is not consistent with the LWRP.
The original dock, 65-foot catwalk, was approved in 2005.A similar applied for in 2009 was
denied by the Board. See the resolution language below.
Furthermore, the proposed amendment to the existing dock is not suitable in this location
due to the limiting water depth 0.6 to 1.8 feet in 2009. The Board of Trustees disapproved a
similar action for a longer dock structure because of the limited water depths in this location.
The applicant enjoys access to the water and navigability. One final point, Goose Creek is a
critical environmental area, nominated by the Town of Southold as worthy of protection under
275-2.
The Conservation Advisory Council also resolved not to support the application because of
the excessive extension into the creek. I will invite comment from the public at this point.
.MR. PATANJO: Jeff Patanjo, on behalf of the applicant.
So this application is to remove the existing ramp,floating dock,jet ski dock that is currently
in place, as you are all well aware. To extend the existing fixed pier out with an extended fixed
pier structure which extends out an additional 22 feet, as you saw the staked terminus of the
proposed structure in the field.When you were out there, you saw there was an existing, I think
it was a Grady White, tied up to the existing floating dock for about eight, nine to ten feet beyond

that Grady White where the stake was set, a little float, I think was orange. So it's about a total
of 22 to 24 feet beyond the end of the floating dock.
I did a measurement right here on my proposed plan. If you take the projected pier line from
the neighboring property to the north and neighboring property to the south, we are landward
of the projected pier line, 25 foot landward of the projected pier line. We are proposing a fixed
dock here because as noted we don't have sufficient water depth, by the code of the
Trustees as well as New York State DEC. It is a fixed structure, we are going to reutilize the
existing aluminum ramp that is there currently, extend out the fixed pier an additional, I
think it's 18 feet, and reutilize a fixed ramp going down to a fixed lower level platform.
We have no problem with removing the lighting that is there. We have no problem
removing any lighting that is on the existing Walkway. We have no problem, I did read the field
notes, we have no problem revegetating the, re-naturalizing, I think that was the word indicated.
Re-naturalizing the area that was proposed originally to be a non-disturbance buffer on some
previous permits.
TRUSTEE GILLOOLY: It was required to be a non-disturbance buffer.
MR. PATANJO: Yes, no problem re-naturalizing the required non-disturbance buffer on the
previous permits dating back to I believe 2015 or'12, if I'm not mistaken.
So, you know, the proposed project meets typical requirements as far as fixed pier. It meets
the requirements of the DEC for projection into the waterway, the 25% projection
requirement.We meet the pier line requirement of the Trustees. We meet the projection
requirement of the New York State DEC.
Any other questions, I would be happy to answer.
TRUSTEE SEPENOSKI: Okay. So the path forward for this application is cleanest and
straightest when it returns to the land, and structures to their original permitted conditions.
In other words, put it back the way it was. I understand the current owner may not have
perpetrated the changes to the original conditions of the land by filling in lawn, making
modifications to the dock without permits. So they would like a way to bring this project back
into some kind of conformity.
MR. PATANJO: Yes, that was, that was recently addressed at, as you are well aware--
TRUSTEE SEPENOSKI: April.
MR. PATANJO:You did an investigation and it was brought to light that some work here on the
property was done by the previous owner.
My client had purchased the property after these improvements were done to the property,
not knowing to them, and we are working right now with the Trustees as well as the Court
system?
MS. HULSE: Yes, right. It was just arraigned today in court.
MR. PATANJO: Yes. So we are working to correct these deficiencies.
MS. HULSE: That, to let you know, has to be completely resolved before the permit is actually
released.
MR. PATANJO: Understood.
TRUSTEE KRUPSKI: To be clear, though, if we were to move forward --just to be clear with
that, being in the Court currently, that is it something that we could resolve under this permit,
just to clarify.
MS. HULSE: Yes.
TRUSTEE GILLOOLY: Just to make a general comment about our pier line. There are some
properties that are deep within a cove, and they greatly benefit from the idea of drawing'a
straight line across from two docks. That is not how we interpret it. I would not, in that case, we
would look at how long are the neighboring docks and try to get a better idea in that sense, so.
MR. PATANJO: Yes. Completely understood. I have been through that multiple times. When I
had clients that they were on the outer end of a pier line, and we project, I projected in the

past, we take the shoreline, take the pier--we interpolate that, so that's how much further out
you can go.
Yes,this one is definitely setback a little bit from the adjacent. And if you took into
consideration a pier line that follows the shoreline at the mean low tide line, we would still
be within your pier line, and I could represent that on a revised plan if required.
TRUSTEE SEPENOSKI: So with respect to the pier line, yes, the dock they are proposing does
conform to the pier line. However when the cove or the contour of the shoreline dips inward,
such as it does in this location, and further more you are not gaining any significant water depth
by extending the dock structure so significantly, it really isn't a good idea to --
MR. PATANJO: I do have a water depth survey for this parcel. We are gaining some additional
water depth.
TRUSTEE KRUPSKI: Four inches, I think.
MR. PATANJO: I would have to look'at the water depth surrey. First I have to figure out what
the property address is.
TRUSTEE GILLOOLY: It is right there, 497.
MR. PATANJO: Yes, I'm blind. I did not present to the Board a water depth surrey really for the
fact that it's a fixed structure,fixed dock, so we typically don't require water depth surveys.
Yes, I'm, we are gaining approximately, if you go to the end of the existing floating dock, to
the end of the proposed floating dock, it varies from 0.9 to 1.5. So, you have seven or eight
inches of water depth. And for a boat docked there on a fixed pier, the seven inches of water
depth is a big consideration for a boat to be docked.
TRUSTEE GILLOOLY: Six inches.
MR. PATANJO:That's a huge, in my opinion --
TRUSTEE GILLOOLY: I was just correcting your math there.
MR. PATANJO:What did I say? 0.9 to 1.5.
TRUSTEE GILLOOLY: Wait. Sorry, you're right.
MR. PATANJO: Yes. So if you are, if the Board was previously indicating they would like the
structure to remain in the existing conditions with fixed pier revert back to originally, which is
permissible for them to dock a boat at. The current boat in the•current situation, which is
permitted,which is 0.9 minus 0.9, which is 0.9 is—what is 0.9— 0.92 is ten inches. So it's ten
inches of water at low tide.
Permissibly, by rights of their current permit, ten inches of water to dock a boat, it's going to
be bouncing off the bottom at low tide. No one is going to lie to each other. Its going to be
bouncing off the bottom. It's permissible to dock a boat there.
TRUSTEE SEPENOSKI: So this was a catwalk to a set of stairs going into the water, correct?
MR. PATANJO: Yes.
TRUSTEE SEPENOSKI:And it's constructed a dock with a "T"on it and a jet ski float and
another floating dock off to the edge, and an aluminum ramp. So that was not permitted,
correct?
MR. PATANJO: To my knowledge, not permitted by the previous owner.
TRUSTEE SEPENOSKI: Okay. It's not this owner's fault, but it's not permitted.
MR. PATANJO: Correct.
TRUSTEE SEPENOSKI: So theorizing that the boat's there, so it's okay. But it's not legally
allowed to be there.
MR. PATANJO: Not legally allowed to be there, however is there anything precluding them from
tying a boat up to their existing permitted dock?
TRUSTEE SEPENOSKI:To the steps, you mean?
MR. PATANJO: Right.
TRUSTEE SEPENOSKI: Go for it.

MR. PATANJO: It's going to be laying on the bottom. So we are trying to resolve the situation
here by putting in a fixed dock that doesn't extend out into the pier line, and I'll prove that
on the plans, we'll do a projection of the shoreline with a pier line extending out. And my
proposed plan will meet that requirement. And we are also gaining an additional six inches
of water depth, which will work for the draft of the boat, which is about 12 to 13 inches.
TRUSTEE SEPENOSKI: I think one of the issues we are looking at here is that this property has
several open violations.
MR. PATANJO: Correct.
TRUSTEE GILLOOLY: For extending a structure that was not permitted. And whether the
previous owner did it or this owner did it, it's this owner's responsibility to know what they have
and what they have permitted or not. So that--
MR. PATANJO: That is why I'm before the Board today to try to clarify all of the issues with the
property that—
TRUSTEE GILLOOLY: I think they have been clarified in the violations. So I think to come in
and ask for so much extensive additional dock when the violations have not been resolved is a
bit difficult to understand.
Okay, so, that said, environmentally speaking, I think that this is too much of an ask for this
particular property.
TRUSTEE SEPENOSKI: Is there anyone else who wishes to speak regarding this application?
MS. BROWN:As somebody who is actually on the CAC, I kayak there regularly, and I have the
lowest keel of any kayak in existence. And I'm often pushing off with my paddle to get back into
the center of that, of West Creek over there. Um, extending 22 feet, I mean originally you had
48 feet. But even 22 feet into the waterway is going to impact public access. It is used mostly
by kayaks and paddle boards, and not by, there's just a couple of boats, and most of them
scrape bottom as they,go. I think it's an inappropriate ask as well.
TRUSTEE SEPENOSKI: Is there anyone else who wishes to speak regarding this application?

just remind all that the LWRP's report states that the original 65-foot catwalk was approved in
2005, and that similar application was applied for in 2009 and was denied by the Board.

the backyard be replanted with native vegetation, and reestablishing a non-disturbance buffer
from the wetlands to the pool deck; the reinstallation of a gate at the seaward edge the of the
pool deck, on both sides of that deck, allowing for a four-foot access path to the dock on side of
the house; remove the'lighting in the,area seaward of the house; remove the irrigation in the
area seaward of the house; remove the kayaks from their current location; and the approval of
an existing 4'x65' dock to remain; and a fixed T-configuration of the dimensions of 4'x16'foot at
the end of this 4'x65' dock. So this will be a fixed dock and catwalk all the way.
Furthermore, new plans to show acceptable planting plan in the rear yard; and a survivability
inspection after one year of planting; and new plans depicting the dock according to the
dimensions 4x65'.
MR. PATANJO: The dock is approved per my submitted plans?
TRUSTEE SEPENOSKI: Total of 69 feet, including the"T'. I'm sorry, that is my motion.
TRUSTEE KRUPSKI: Second.

So there's a stone wal ay down, and en you are proposing a gravel stone/gravel walk
along the landward side f the bulkhead. I j st want to ensure that that is intended to have
pervious edges so th it would not be a--
MR. PATANJO: Ye . Fully pervious. It is inte ed to be a non-turf buffer. This is a carryover
from a permit th was never constructed from o years, two-and-one-quarter years ago.
They were, to start building the project, fou d out they didn't have a permit with the
Trustees,w ad to renew the permit with the Tru tees, same exact plans, I saved a lot of
time bu,ldi `these plans, because I just had a cop and just changed the date.
SOS e exact plans that was previously approve with previous Boards, it is a non,fully-
pervio gravel stone walkway with no vegetation, no rtilizer and no herbicides. I heard from
the dience.

Dear President Goldsmith and Board:
The Board did not approve the revised plans submitted by Jeff Patanjo which preserved the
owner's rights to navigable water. The Board voted by resolution to only extend the dock by the width
of the existing catwalk,four(4)feet,with a"T". The Board's written decision will not be issued until
the applicant submits plans consistent with the Board's resolution.
Enclosed are prints of the existing dock with a"T"rather than steps down. As I had previously
advised you in my letter dated August 7',the Board's actions denied the requested extension of the
catwalk within the bounds of the owner's property, disregarded the water depth at the end of the"T",and
results in the owner's small boat sitting-in the mud at low tide.
Nevertheless,this plan is being submitted,under protest and reserving all rights, in accordance with
the Board's procedures for issuance of a written determination.

Dear President Goldsmith and Board:
I was retained by the owners for the Justice Court action and to assist Jeff Patanjo
regarding the above wetland application. I reviewed the file and unfortunately the client
inherited the prior owner's violations. The owner is in the process of doing the following:
1. Sprinklers in the back and walkway removed.
2. The fence requested by the Trustees was ordered and is to be installed within 3 weeks.
3. The low-level mushroom lights on the path and the lights on the dock which are only on
as needed(switch) are being removed by the electrician next week.
4. A landscape plan is being prepared by the landscape designer which will be submitted as
soon as it is prepared. The owner wants to be sure that native drought tolerant plants are
used.
5. Kayaks were moved.
The Board has withheld the written pen-nit for the approved plan(which is different from
the original and revised plan submitted)until the above is completed. So you made a verbal
decision at the'meeting but we have no written decision to review.
As to the dock: The land underwater is privately owned,and the dock is solely on the
owner's property.

Point 1: The water depth survey showing existing water depths. The Bathymetric survey
shows the possible extensions of the dock which would give the owner the ability to tie up her
boat to the fixed catwalk and retain her riparian rights.
In a review of the scanned"Pending"folder the bathymetric survey does not appear to be
scanned in your folder. This was requested by the Board in the field notes, but it appears that
your decision disregarded the water depths because�he approved plan is not functional to tie up
the existing boat. i
Point 2 & 3:The revised plan submitted by Jeff to the Trustees with the revised Project
Description.After the Board's.field inspection and before the hearing, Jeff Patanjo prepared a
revised plan that shortened the proposed dock and replaced the ramp and float with a fixed dock.
The revised ramp and float extended the dock by 32'lifor 1.4' MLW. The proposed dock is
shorter than the"pier line"and is within the title to the underwater land'owned by the applicant.
This revised plan met the Board's standards regarding the"Pier line"and only 18%of the width
of Goose Creek waterway. The Trustees had approved the dock to the east with the same water
depth.
Point 4: Trustee's approved plan: The Bathymetric survey shows that the"as built"-floats were
in .9 MLW. As you see on the attached plan,when the"as built"floats are removed,the T
would be behind the MLW and there will be no water at dead low tide. If the Board was
considering this alternative, then the water depth at the T would be critical to the decision
making. The owner had tied up her boat onto the floats and the"as built"was proven to be
functional. At a minimum, replacement of the"as built"floats with the fixed dock would
continue to be functional.
The transcript of the meeting is not available yet. The dock approved by the Board may not
have been intended to be nonfunctional. We hope that with the enclosed information you will
correct what the board asked Jeff to submit. We believe that what was intended,the bare
minimum,was replacing the"as built"floats with a"T". Please advise as soon as possible.

Regarding the Board of Trustees determination for the above referenced property the conditions are as follows:
• Re-establish and re-vegetate the 50' wide Non-Disturbance Buffer area located from the edge of wetlands to
the pool deck (see prior owner's survey to explain buffer area better if need be).
• The re-installation of a gate and if necessary a fence from the seaward edge of each side of the pool deck (at
the 50' N-D line) to the side yard property line to delineate the 50' wide Non-Disturbance Buffer area (see prior
owner survey to explain gate/fence location if questions).
® Allow one 4' wide access path to the dock.
• Remove the lighting within the area seaward of the dwelling.
® Remove the irrigation within the area seaward of the dwelling.

Regarding your inquiry this is a basic explanation along with attachments.
Permit#6173 for a dock was approved in 2005 and received a Cert. of Compliance in Sept. 2006. In October 2008 the
owner applied to enlarge the dock and add a ramp to float, and was formally denied. What is out there today appears
to have been for the majority of or fully reconstructed, and added on to which is not permitted under Ch. 275. Even if
there is a permit for a structure, if it is to be reconstructed new permits must be applied for, and structure that was
formally denied was added. Floating docks, including jet ski floats cannot exceed a cumulative amount of 120 square
feet. What is out there today may not exceed Town Code Ch. 275.
Permit#8501 refers to the pool, deck, revegetation, a low profile fence along 50' wide non-disturbance boundary,
etc. Upon inspection Trustee Peeples determined that the deck was no longer cantilevered and was in a sense enlarged
to be no longer cantilevered which now encroaches into the 50' non-disturbance buffer area which was why the deck
had to be cantilevered. There is a swath of lawn located in the non-disturbance area, plantings no longer exist in the
non-disturbance buffer area, the non-disturbance buffer delineating fence and gate have been removed, the 4' dirt
walkway had been modified to a bluestone pathway with lighting, and kayaks are in the non-disturbance buffer area.
Permit 45605 refers to the dwelling and to establish a 50' wide non-disturbance buffer along the landward edge of
wetlands. The .50' wide non-disturbance buffer has been modified which is not permitted Under-Ch. 275 of the Town
Code.
Because all Perrnit Transfer requests were denied, I believe the Board is requesting new Wetland Permit applications be
applied for to remediate the code violations. It is recommended a Pre-Submission Inspection be requested and you and
Your permit expeditor.should be in attendance to take notes and further discuss the issues and ways to remediate.

My expediter, Jeff, forwarded me your email explaining why 2 of the permits
were denied. However, it does not say in what way the permits do not match- is
the fence a wrong color? Is the fence not on the property line? A different height?
And I do not understand how a Certificate of Occupancy was issued for a permit
that you are now claiming does not match up? in addition, there was a third permit
that you did not address in your email. Any details you can provide to me would
be greatly appreciated so that I know how to proceed. In addition, although the
prior owner may have done things incorrectly, that was in the past and as the

For Permit #8501 the deck and fence do not match
the permit. For Permit it it was that the buffers
and path do not match the permit issued. The
previous owner had received multiple violations
from this office for doing things ithout permits or

Dear Mr. Fitzgerald:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., October 15, 2008 regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of GAIL RERISI applied to the
Southold Town Trustees for an amendment to a permit under the provisions of Chapter
275 of the Southold Town Code, the Wetland Ordinance, application dated September
24, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and specifically Inconsistent with the following
coastal policies: Policy 9— Provide for public access to, and recreational use of, coastal
waters, public lands, and public resources of the Town of Southold, Policy 9.4—Assure
public access to public trust lands and navigable waters, Policy 6 —Protect and restore
the quality and function of the Town of Southold ecosystem, Policy 6.3—Protect and
restore tidal and freshwater wetlands, and,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 15, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure, as applied for, does not comply with the standards set forth in
Chapter 275 of the Southold Town Code, and,
WHEREAS, the Board has determined that the structure, as applied for, will have a
detrimental effect upon the health, safety and general welfare of the people of the town,
and,
NOW THEREFORE BE IT,
RESOLVED, for the foregoing reasons, and based upon the application's failure to meet
the standards contained in Chapter 275 of the Town Code, that the Board of Trustees
deems the proposed project to be Inconsistent with the Local Waterfront Revitalization
Program pursuant to Chapter 268-5 of the Southold Town Code, based on the
inadequate water depths, and,
BE IT FUTHER,
RESOLVED, that the Board of Trustees DISAPPROVES the application of GAIL
RERISI to Amend Permit #6173 to construct a fixed open walkway 4'X 107' with
decking a min. of 3.5' above vegetated grade, hinged ramp TX 10', and floating dock
5'X 20', and install two 6" dia. piles to secure the floating dock, and as depicted on the
hydrographic map prepared by Sea Level Mapping last dated September 15, 2008.

Dear Mr. Musco:
On October 10, 2018 the Board of Trustees conducted a field inspection at 497 Ripple Water
Lane, SCTM#: 1000-76-1-15.3 regarding Wetland Permit#8501 and possible encroachment
into the 50' non-disturbance buffer.
The Trustees found several actions that compromised the non-disturbance area. The following
actions must be taken before next month's field inspection in order to avoid a continuing
violation scenario:
1. Hydrangeas and raised flowering bed must be removed from the non-disturbance area;
2. No further mowing of grasses in the non-disturbance area in order to allow native
vegetation to return to the area;
3. Reduce the width of the path to the dock to the 4 foot wide path allowed by Code.
4. Store all recreational equipment and kayaks/vessels plandward of the non-disturbance
area.

Jeffrey Patanjo on behalf of ANDREW&ANDREA WEISBACH requests a Wetland Permit to remove
the existing floating docks and adjustable ramp off of the existing 4' wide by 65' foot long catwalk which
shall remain undisturbed; off of seaward end of catwalk, construct a proposed 4'x24' fixed catwalk
extension supported with 8" diameter CCA pilings and using Thru-Flow decking leading to the relocated
3' wide by 12' long aluminum ramp which shall be permanently attached to a proposed 4' wide by 16'
long fixed "T" section of catwalk; and to install an aluminum ladder at the end of the "T" section to gain
access to boat during low tide. Located: 497 Ripplewater Lane, Southold. SCTM# 1000-76-1-15.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to us, it is our recommendation that the proposed action
is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP.
The lengthening of private dock structures into public waters is not consistent with the LWRP.
The original dock 65' catwalk was approved in 2005.
A similar application applied for in 2009 was denied,by the Board. See the resolution language
below.
RESOLVED, that the Board of Trustees DISAPPROVES the application of GAIL RERISI to Amend
Permit#6173 to construct a fixed open walkway 4'X 107'with decking a min. of 3.5'above
vegetated grade, hinged ramp 3X 10, and floating dock 5'X 20, and install two 6"dia. piles to
secure the floating dock, and as depicted on the hydrographic map prepared by Sea Level
Mapping last dated September 15, 2008.
The proposed amendment to the existing dock is not suitable in this location due to the limitin
water depth .6 to 1.8 feet in 2009. The Board of Trustees disapproved a similar action for a
longer dock structure because of the limited water depths in this location.
The applicant currently enjoys adequate access to navigable waters via the existing dock.
structure. The applicant also has an alternate means of access to Goose Creek via the Town's
brut ramp off Ga en''s Landin Rd.
The proposed action is located in goose Creek a Critical Environmental Area nominated by the
Town of Southold as worthy of protection see Critical Environmental Areas § 275-2 Definitions
below). Any proposed action in a Critical Environmental Area may be subject to more stringent
requirements such as denial of certain operations ursuant to 275-11 Construction ,and
operation standards.
§ 275-2 Definitions; word usage.
CRITICAL ENVIRONMENTAL AREAS --All sites previously nominated by the Town of Southold and
designated by the New York Sate Department of state as Critical Environmental Areas worthy of
protection including: Cutchogue Harbor Wetlands, Hallock's Bay, Dam Pond, Downs Creek, Orient
Creek, West Creek, Richmond Creek and Beach, Brush's Creek, Cedar Beach Creek, Corey Creek,
Deep Hole Creek, Goldsmiths Inlet, Halls Creek, Goose Creek, Little Creek, Mill Creek and Pipes Cove
Creek.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
