The Department of Environmental Conservation (DEC) has completed a review of your proposal
to modify a single-family dwelling more than 75 linear feet from the Tidal Wetland Boundary, as
per the plans prepared by Peter Willcox Architect LLC, last revised 11/08/2022. Based on the
information you submitted, DEC has determined that the project is listed in the Tidal Wetlands
Land Use Regulations (6NYCRRPart GG1.5) auause not requiring apermit. Therefore, no
permit is required under the Tidal Wetlands Act (Article 25#26) of the Environmental
Conservation Law.
Be advised, any additional work or modification to the project as described, may require DEC
authorization. Please contact this office if such activities are contemplated.
Please note that this letter does not relieve you of the responsibility of obtaining any necessary
permits orapprovals from other agencies orlocal municipalities.
Please be further advised that DEC has documented the occurrence of the piping plover
(Charmdriumnmw]odmm)' a species listed moendangered /threatened inGNYC;KR Part 182,
on or near the subject property. We have determined that activities, including but not limited
to, construction, excavation, the placement of fill, grading or the operation of mechanical
equipment or vehicles on the beach and dune area at this location during the species' spring
and summer nesting season, whether landward or seaward of the Tidal Wetlands jurisdiction-
limiting dune crest referenced above, may result in the "take" of this endangered /threatened
species or its habitat within the meaning of Environmental Conservation Law (ECL) 11'535. The
term "take" is defined in part as the direct killing or injury of individual members of protected
wpeoiem, interference with critical breeding, hnrmging, migratory orother essential bohnviors, or
the adverse modification of the species' habitat. The taking nfaspecies listed mnendangered or
threatened is prohibited in the absence of a permit from this Department issued pursuant to ECL
11'535.

TERMS AND CONDITIONS

New or as part oft a consideration forte issuance of the Permit does understand and
prescribe tothe following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
operation perfon-ned pursuant to this permit, and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Pennittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid fora period of 24 months,which is considered to bethe estimated
time required to complete the work involved, but should circumstances warrant,request for
an extension may be made to the Board at a later date.
1 That this Permit should be retained indefinitely,or as to as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
® That the work involved will be subject tote inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation oft is Permit by resolution oft e said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7, That if future operations oft e To of Southold require the removal and/or alterations inthe
location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses tathe
Town of Southold.
& The Permittee is required to provide evidence that a copy oft is Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed oft e subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance oft is permit.
9, That the said Board will be notified by the Permittee of the completion oft e work
authorized,
10. That the Permittee will obtain all other permits and consents that may be required
supplemental tothis permit,which may be subject to revoke upon failure to obtain same.
11, No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the Penn it.

ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON

WHEREAS, on June 25, 2022, the Applicant submitted an application to the Town Board of the
Town of Southold seeking to appeal the determination of the Board of Trustees, or in the
alternative, seeking a variance from the requirements of the Law; and
WHEREAS, on August 9th, 2022, the Town Board conducted a duly noticed public hearing on
the instant appeal with an opportunity for all interested parties to be heard and testimony was
taken of the Applicant's consultant and other interested parties; and
WHEREAS, the application has been reviewed pursuant to Chapter 268, Waterfront
Consistency Review of the Town Code and the Local Waterfront Revitalization Program;now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds that the proposed
action is classified as a Type II Action and is not subject to review pursuant to SEQRA Rules
and Regulations for this action; and be it further
RESOLVED that the Town Board of the Town of Southold docs hereby adopt the Finding ,
and Determination dated A ust 9,th. 2022 granting,the application of Patricia Moore,Esq.
