The public had access to view and listen to the meeting as it was happening via Zoom. If a member of the public had no access to a computer or smartphone, there was an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. It is expected that the Committee will enter into Executive Session* at some point after opening the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. The public is not allowed to attend, view, or listen to Executive Session. Motion carried: 5/0 • Next LPC meeting date: April 18, 2023 GENERAL PRESERVATION • Amendments to Chapter 71 & 72 Supervisor Russell presented his proposed revisions to the agricultural preservation scheme established in Chapters 70, 71, and 72 of the Town Code for development rights easements going forward. Some LPC members were in favor of the high-level proposal, and other LPC members will reserve their judgment until they review draft code. The LPC members requested an opportunity to comment on written draft revisions before those revisions are discussed in a public meeting. Supervisor Russell also informed the LPC that Town policy requires the LPC to return to hybrid meeting formats. INQUIRIES/APPLICATIONS FOR USES OR STRUCTURES ON PRESERVED PROPERTY • Liv2Max LLC — 8 Hands Farm SCTM4 1000-96.-2-10.2 Property subject to Town PDR: Request for improvements on property subject to Town PDR March 30, 2023 referral from Planning Board The LPC reviewed and discussed the application for a 4,000 sq. ft. barn for the storage of equipment and hay to be located within the area subject to the recorded Town development rights easement. The LPC reviewed the applicable terms of the Recorded Easement. The Town purchased the rights using both Community Preservation Funds and a USDA NRCS grant. MOTION made by Anne Murray, seconded by John Simicich: The Land Preservation Committee has reviewed and discussed the request made by LIV2MAX LLC to install a 4,000 sq. ft. barn for the storage of hay and equipment on lands subject to a recorded Town development rights easement. The Committee finds that the proposed improvement is consistent with the terms of the Recorded Easement. Motion carried: 5/0 Sam clarified that the Committee does not permit or approve of structures and/or uses on DRS parcels, but instead determines whether a structure or use is consistent with the terms of the recorded Town development rights easement. STEWARDSHIP AND MANAGEMENT • Reinhardt SCTM4 1000-102.4-5.3 Property subject to Town PDR: Concerns raised regarding use of property Sam explained that he viewed the Reinhardt property, which is subject to a recorded Town development rights easement, from an adjacent parcel and observed a storage container, machinery, and a boat on the northeastern corner of the property. Lilly explained that the property was last monitored on 3/11/2020 and that it is not actively farmed. The Committee instructed Lilly to ask the Town Attorney whether the observed conditions violate the Recorded Easement. LAND PRESERVATION APPLICATIONS&POTENTIAL APPLICATIONS: • EXECUTIVE SESSION- Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof MOTION made by Sam McCullough, seconded by Anne Murray, to enter EXECUTIVE SESSION.
