Salice, owners of the adjoining residence property at 9326 Main Bayview, Southold,NY. During the hearing on Sept. 2,2021, the question was raised as to whether or not the Trustees and DEC ("Agencies") should be asked to make their decisions or recommendations on the environmental aspects of this application prior to the ZBA issuing a decision.on the variance setback request. In this particular case,the answer should be in the.affirmative due to.the extreme extent of wetlands,which severely limits the buildable area on the parcel. In such a situation, it makes sense for these Agencies to. weigh in at an early stage, subject, of course,to the ZBA decision on front yard setback. However, any such Agency decisions or recommendations affecting front yard setback would be based on factors such as wetlands proximity and environmental impact, which are largely different fTom those applied by the ZBA. The ZBA cannot overweight those standards above the relevant standards under Town Law Section 267-b. Thus, should the Agencies recommend or permit a plan with a greatly abbreviated front yard setback,that should not influence the Board in its consideration of statutory variance standards in greatly reducing Code requirements. The ZBA standard of adverse environmental effect, Section 267-b(3)(b)(4), applies to a negative consequence of granting of a variance. Thus, the applicant's argument that granting the variance will have a positive environmental impact by increasing distance from the wetlands is not applicable under this standard. As to the merits, an applicant's wish to situate a house on a parcel inundated with wetlands,,and far beyond those of neighboring properties, can be accommodated only by substantially reducing setbacks. This does not form a justification for doing so. Specifically,the standards of neighborhood character, visible impact, and lack of feasible alternatives should not be diluted because the applicant chose to purchase a parcel which is clearly unbuildable without substantial relaxation of so many Code provisions.
