(631) 765-1809 Southol�d =bw er FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF APRIL 20, 2023 ZBA FILE No.: 7775SE NAME OF APPLICANT: Peconic Community School PROPERTY LOCATION: 27835 Main Road, Cutchogue SCTM No. 1000-102-1-18.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions,without further steps under SEQRA. SEORA DETERMINATION: The Southold Town Zoning Board of Appeals,as Lead Agency,at the conclusion of their coordinated has classified the proposed Action for Special Exception Approval and Site Plan Approval, as Type I, (or Unlisted) pursuant to Part 617 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act) of the Environmental Conservation Law, and on April'6, 2023 determined that the Action having a Negative Declaration will not have a significant adverse impact on the environment. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated February 28,2023, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: The application was referred to the Southold Town Planning Board for comments. In their memorandum dated March 30, 2023, the Planning Board indicated that the proposed special exception use of a school at this location is consistent with the Towns Comprehensive Plan. The Town Comprehensive Plan has a chapter focused on providing quality human services,and the second goal of this chapter includes sustaining and enhancing services for youth. This private school, which is licensed by the NYS Board of Regents,plans to focus on providing educational services to elementary/middle school youth. Furthermore, the proposed location has supported similar uses in the past including a church and school since the late 19th century. The reuse of this historic property while maintaining its character aligns with the Town Comprehensive Plans Chapter 5, Goal 2,Objective 2.3,which states: "Provide for the compatible use,reuse,and integration of historic resources in future planning while limiting and minimizing inappropriate alterations to the resource." The applicant stats a desire to protect and preserve the historic character of the property. The applicant has demonstrated adequate off-street parking based on 280-78 requirements and the proposed use for the elementary/middle school. In addition, the application meets the required acreage as outlined in 280-13 (B) (3)(d) based on their proposed enrollment of up to 125 students. 1 Page 2,April 20,2023 #7775SE,Peconic Community School SCTM No. 102-1-18.1 In their Memorandum,the Planning Board has requested that the applicant demonstrate that all exterior lighting complies with Chapter 172—Lighting, Outdoor. PROPERTY FACTS/DESCRIPTION: The subject property consists of a 10.2-acre site which sits within the R- 40 Zoning District. The site consists of a two-story school building, a church building, a two-story church rectory/office building, and an accessory carriage house/garage. The property has a road frontage along Main Road along the southerly property line, and Griffing Street to the east. All as depicted on a survey prepared by Howard W. Young, L.L.S. last revised October 27, 2022. BASIS OF APPLICATION: Applicant requests a Special Exception under Article 111, Section 280-13B(3)to establish and operate a private school for elementary and middle school age children; at: 27835 Main Road, Cutchogue, NY. SCTM#1000-102-1-18.1. RELIEF REQUESTED: The applicant proposes to operate the property as a private school campus utilizing all of the buildings for school use. A Special Exception is required as is side yard setback variances for the existing residence, and carriage house. ADDITIONAL INFORMATION: The Peconic Community School which also operates in Aquebogue,NY, is a non-profit 5010 corporation with a student population of anywhere from the current 106 students to up to 120 students. The church was built in the late 1800's but is not currently in use. The property will be used as a school campus utilizing the existing school building, church, rectory, and carriage house. At the hearing the neighbor to the west voiced security concerns over the current use of the subject property by individuals not associated with the school and the vehicles that use the adjacent access road off of Main Road. The applicant agreed to install a gate at the foot of this access road to prevent unauthorized entry. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent_ properties or of properties in adjacent use districts. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. G. That the proposal shall comply with the requirements of Chapter.236, Stormwater Management J Page 3,April 20,2023 #7775SE,Peconic Community School SCTM No. 102-1-18.1 In making such determination, consideration was also given to: A. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses.. B. The conservation of property values and the encouragement of the most appropriate uses of land. C. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent(whether liquid, solid, gaseous or otherwise) that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors, smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges, dust, light, vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or by other competent governmental agencies. H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. I. Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. J. Whether the use or the structures to be used therefor will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. L. Whether the use to be operated is unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. Whether the site of the proposed use is particularly suitable for such use. N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. O. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate. P. Whether the natural characteristics of the site are such that the proposed use may be introduced there without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. Q. The issuance of a Special Exception permit, as applied for in this application, is also subject to the following specific criteria and requirements which have not been met pursuant to Section 280-13B(3) of the Town Code l Page 4,April 20,2023 #7775SE,Peconic Community School SCTM No. 102-1-18.1 Pursuant to Section 280-13B(3) of the Southold Zoning Code "private elementary or high schools colleges and other educational institutions" are permitted by Special Exception provided that the following requirements are met : a) No building shall be less than 50 ft from any street or lot line. b) The total area occupied by all principal and accessory buildings shall not exceed 20% of the area of the lot. c) Any school shall be a nonprofit organization within the meaning of the Internal Revenue Act and shall be registered effectively thereunder as such. d) Any such school shall occupy a lot with an area of not less than five acres plus one acre for each 25 pupils for which the building is designed. R. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. S. The conservation of property values and the encouragement of the most appropriate uses of land. T. I BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Lehnert seconded by Member Planamento, and duly carried to GRANT a Special Exception, as applied for, and shown on the Survey prepared by Howard W. Young, L.L.S., last revised October 27, 2022,the Architectural Drawings prepared by Lee H. Skolnick, Architect, dated December 30,2022. Page 5, April 20,2023 #7775SE, Peconic Community School SCTM No. 102-1-18.1 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Special Exception Permit granted herein may involve a change in occupancy or a change in use or a change within a classification of the occupancy. Therefore, as a condition of approval, the applicant must contact the Building Department to make the determination whether or not a Building Permit is required and that changes will be NYS Code compliant. 2. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department on an annual basis to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 3. In accordance with the Zoning Board of Appeals, approval shall thereafter be deemed a lawful use as if the same were permitted by this chapter without need for a special exception permit; provided, however, that: 1) All conditions imposed by the special exception approval shall continue to apply unless they, by their express terms, are of limited duration. b) All conditions imposed on special exception approval uses generally or specifically by this chapter shall continue to apply, regardless of whether any such conditions were expressly incorporated into the special exception approval. c) The Zoning Board of Appeals shall retain continuing jurisdiction over the same; d) The duration of a special exception use may be limited to a time period as set forth in the approval of the Zoning Board of Appeals, if the approval is silent as to the duration of the special exception use, then said use shall be in perpetuity; c) A special exception use which has been discontinued for a period of one year or more shall be deemed abandoned 4. The applicant shall conform to all exterior lighting codes as outlined in chapter 172 of the town code. AREA VARIANCE RELIEF AREA VARIANCE RELIEF is required for the existing church rectory to be used as school offices and the existing garage having less than the code required minimum setback of 50 feet from the secondary front yard. Currently,the two-story rectory/office has a 33.1 feet secondary front yard setback and the existing accessory garage has an 18 feet secondary front yard setback. 1 Town Law§267-b(3)(b)(1). The requested relief will not adversely affect the character of the neighborhood or be a detriment to nearby properties because the applicant is not proposing any new construction at this time. The existing buildings have been in this location for over one-hundred years and arguably define the original character of the neighborhood. The buildings currently are legal with Pre-Co's but due to the special exception application, a 50 ft setback is required. Due to the age of the property and buildings, and the fact that no additions to the footprints are proposed, it will not adversely affect the character of the neighborhood. 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance because the Special Exception statue requires a 50 ft setback from the road. These buildings have existed in their current locations for over 100 years, and cannot be feasibly moved. Moreover,to do so would alter their valuable historic status and authenticity. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial. The existing two- story residence represents a 34%relief from the code. The existing accessory garage represents a 64%relief from the code. Both structures currently exist with pre-certificates of occupancies as non-conforming Page 6,April 20,2023 #7775SE,Peconic Community School SCTM No. 102-1-18.1 buildings. The current variances were only needed due to the special exception needed to re-open the school that is currently on the site, as one of the requirements is a 50 ft setback from front yards for all buildings on the site. 4. Town Law&267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this mixed-use district will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and the conditions of this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law§267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a school campus utilizing all of the existing buildings on this site that currently enjoy the benefit of certificates of occupancy. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert seconded by Member, and duly carried, to GRANT the variances as shown the Survey prepared by Howard W. Young, L.L.S., last revised October 22, 2022. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the Zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void . The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Initially, we note that the subject property. in 10.21 acres. in size. Clearly, this exceeds the minimum lot size for the school use and would allow for up to 130 students. The school building is designed to accommodate 125 students. Currently, Peconic Community School has 106 students which and the student population has traditionally been less than 120. Based on the foregoing this complies with subsection"d"of the criteria. Peconic Community School is a nonprofit corporation as defined under United States Code 501(C)(3). Thus,the applicant complies with subsection"c". There are five (5) buildings located on the Subject Property. The total lot coverage of these buildings is 15,771 square feet which is 3.5% of the total Jot area. This satisfies subsection «b„ Finally, subsection "a" requires that all buildings on a school property be a minimum of 50 from the street and lot lines. The applicant is not proposing any new construction at this time, and intends to make use of the existing buildings for the School. While all of the buildings on the Subject Property are located 50 feet or more fromMain Road, the rear lot line and the side lines, two of the buildings are less.that 50 feet from Griffing Street, a secondary front yard on the east side of the lot. Specifically, the former rectory building is 33:1 feet from Griffing Street and the former carriage house is 18 feet from Griffing Street. It is critical to note that these buildings have existed on the Subject Property for many years and are both validly existing with the proper permits and certificates of occupancy. It is my opinion that the pre-existing nature of these buildings renders the application compliant with subsection "a". In an effort to clarify this position, I reached out to the Town of Southold Building Inspector to discuss whether the application would require a denial of permit and an area variance. The Building Inspeotor-stated.that he did not believe it was necessary to issue a denial for these buildings because there is an original jurisdiction application for a special permit pending before the Board of Appeals. He indicated that the Board could grant a variance from the criteria as part of the special permit application. Furthermore, stated that Board has done this in the past. The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. The maximum height shall be 35 feet or 2 1/2 stories. The entire lot, except areas occupied by buildings or parking or loading areas, shall be suitably landscaped and properly maintained. Any health care, continuing care or life care facility shall meet the following standards: u ` All buildings shall be of fire-resistive construction. I1 All such uses shall be served by adequate water and sewer systems approved by the Suffolk County Department of Health. LL Patients suffering from communicable diseases shall not be permitted in any nursing home or sanatorium. (Communicable diseases are defined by the Sanitary Code of the Public Health Council of the State of New York.) 141 Eight thousand square feet of lot area shall be provided for each patient bed. C. Accessory uses, limited to the following uses and subject to the conditions listed in § 280-15 herein: M Any customary structures or uses which are customarily incidental to the principal use, except those prohibited by this chapter. Home occupation, including home professional office and home business office. In permitting these uses,the Town Board recognizes that the residents historically have operated small businesses which provide services to the community from their homes. The Board finds that these businesses have not impacted negatively on the appearance of.these residential zones. In the Board's judgment, it finds that in order to maintain the economic viability of the Town, to maintain the rural quality of life and in the interests of the welfare of the residents, these businesses (or home occupations) should be permitted to continue. In setting forth the following subsections, the Board intends to permit as of right certain business uses in residential zones with the understanding that these uses are to be conducted in a manner that will not alter the character of the residential neighborhoods. The Board believes that the following subsections provide sufficient safeguards to accomplish that aim. These uses shall be permitted, provided that: [Amended 4-9-1991 by L.L. No. 10-1991; 7-28-1992 by L.L. No. 14-1992] No display of products shall be visible from the street, and no stock-in-trade shall be kept on the premises. (b Such occupation is incidental to the residential use of the premises and is carried on in the main building by the residents therein with not more than one nonresident assistant for whom off-street parking must be provided on site. Such occupation is carried on in an area not to exceed 25%of the area of all floors of the main building, and in no event shall such use occupy more than 500 square feet of floor area. There shall be no exterior effect at the property line, such as noise, traffic, odor, dust, smoke, gas, fumes or radiation. (e) Studios where dancing or music instruction is offered to groups in excess of five pupils at one time or where concerts or recitals are held are prohibited. In no manner shall the appearance of the building be altered, nor shall the occupation be conducted in a manner that would cause the premises to lose its residential character, including but not limited to the use of colors, materials, construction or lighting. Lgh Notwithstanding anything set forth elsewhere in this article, home occupations, home business offices and home professional offices shall in no event be deemed to include animal.hospitals, kennels, barbershops, beauty parlors, clinics or hospitals, mortuaries, nursery schools, clubs, auto repair shops, restaurants,tourist homes, rooming houses or boardinghouses and uses similar to those listed above.0 U Editor's Note:Former Subsection C(2)(h), regarding signs, which previously followed this subsection, was repealed 11-29-1994 by L.L._No. 25-1994. For current sign provisions, see Art. XIX Signs. Home occupations, home business office and home professional offices shall not include manufacturing, fabrication or construction of any type on the site. CO The outdoor storage of equipment necessary for residents connected with aquaculture shall be screened from view and shall conform to the setbacks for accessory structures. (3) Boat docking facilities for the docking, mooring or accommodation of noncommercial boats, subject to the following requirements: There shall be docking or mooring facilities for no more than two boats other than those owned and used by the owner of the premises for his personal use. The Town Trustees shall approve new boat docking facilities. Boats at such docking facilities shall not be used for overnight sleeping purposes. Garden house, toolhouse, storage building, playhouse, wading pool, swimming pool or tennis court incidental to the residential use of the premises and not operated for gain, subject to the following requirements: Any swimming pool shall be completely enclosed with a permanent chain link (or similar type) fence of not more than two-inch mesh, not less than four feet in height, erected, maintained and provided with a self-closing, self-latching gate to prevent unauthorized use of the pool and to prevent accidents. However, if said pool is located more than four feet above the ground, then a fence is not required, provided that all points of access to said pool are adequately protected by a self-closing, self-latching gate. Any swimming pool in existence at the effective date-of the provisions of this subsection shall, within one year from such date, comply with all of the provisions hereof. J Individual outdoor tennis court related to residential use on a lot containing a single-family detached dwelling, provided that the same is set back not less than six feet from all lot lines and that there is no lighting for after dark use. Private garages; provided, however, that not more than two passenger automobile spaces in such garages may be leased to persons not resident on the premises. Off-street parking spaces accessory to uses on the premises. Not more than four off-street parking spaces shall be permitted within the minimum front yard. M The storage of either a boat or travel trailer owned and used by the owner or occupant of the premises on which such boat or travel trailer is stored,for his personal use, subject to § 280-78Q, Supplemental parking regulations,m and the following requirements: Lal Such boat or trailer shall not exceed 30 feet in length. Such boat or trailer shall be stored only in the required rear yard, and the area occupied thereby, together with the area of all buildings in the rear yard, shall not exceed 40% of the area of the required rear yard. Such boat or trailer shall not be located within 15 feet of any street or lot line. Ll Editor's Note: See now§280-78P. (8 Horses and domestic animals other,than household pets, provided that such animals shall not be housed within 40 feet of any lot line. Housing for flocks of more than 25 fowl shall not be constructed within 50 feet of any linea [41 Editor's Note:Former Subsection C(9), as amended, regarding signs, which.previously followed this subsection, was repealed 11-29-1994 by L.L. No. 25-1994. For current sign provisions, see Art. XJ Signs. Yard sales, attic sales, garage sales, auction sales or similar types of sales of personal property owned by the occupant of the premises and located thereon, subject to the following requirements: [Amended 6-2-2009 by L.L. No. 6-2009] Lal No more than two such sales shall be conducted on any lot in any one calendar year. Adequate supervised parking facilities shall be provided. No signs, except one on-premises sign not larger than six square feet in size, displayed for a period of not longer than one week immediately prior to the day of such sale, shall be permitted. A permit shall be obtained therefor from the Town Clerk upon the payment of a fee of$15. The display permit issued by the Town Clerk shall be posted on the premises so it can be read from the street and removed before sundown on the day of the sale. Wineries may have an accessory gift shop on the premises which may sell items accessory to wine, such as corkscrews, wine glasses, decanters, items for the storage and display of wine, books on winemaking and the region and nonspecific items bearing the insignia of the winery. Wineries may not have a commercial kitchen as an accessory use but may have a noncommercial kitchen facility for private use by the employees. [Added 11-29-1994 by L.L. No. 26-1994] (11) Child care. [Added 11-12-1996 by L.L. No. 20-1996] Use of aircraft in agricultural operations, provided that: [Added 7-31-2018 by L.L. No. 9-2018] The use has been granted a special exception from the Zoning Board of Appeals. In addition to the criteria for a special exception set forth in §§ 280-142 and 280-143, the ZBA shall consider the following criteria: I1 The anticipated frequency of flights. f2l The location of the proposed landing and takeoff zone. u The location of residences. L1 The type of aircraft being used. Notwithstanding the forgoing, the use of aircraft shall be limited to spraying crops, surveying fields and transporting employees and shall not be used for transporting nonemployees to and from the subject premises. 13 Processing of agricultural products,which meet the following standards: [Added 6-4-2019 by L.L. No. 6-2019] The processing of agricultural products shall take place on a parcel that qualifies as a bona fide farm operation as defined in § 280-4 of this Code. b Notwithstanding the provisions in § 280-15C of this Code, the square footage of an agricultural processing building, or part of an agricultural building used for agricultural processing, shall not exceed 1.5% of the total size of the parcel on which it is located. Lch An agricultural processing building with a square footage of 3,000 square feet or-less shall not be subject to site plan review. Any site plan application for an agricultural processing building shall be entitled to the expedited processing and fees for agricultural related site plan applications set forth in Article XXIV of this chapter. At least 66% of the agricultural products being processed must have been grown by that bona fide farm operation. The requirement in this subsection shall not apply in cases of a catastrophic crop failure. Direct marketing of aquaculture or mariculture products, subject to the following requirements: [Added 9-24-2019 by L.L. No. 15-2019] Only bona fide acquaculture/mariculture farm operations may engage in the direct marketing of aquaculture or mariculture products pursuant to this section; (b) A bona fide acquaculture/mariculture farm operation may engage in the direct marketing of their produce at one of the following locations, but not both: L1 A parcel containing a single-family dwelling that is the primary residence of the owner of a bona fide aquaculture/mariculture farm operation; or L1 A parcel used as part of a bona fide farm operation located on State Route 25("Main Road") or County Road 48 (the "North Road"); Only products grown by the bona fide aquaculture/mariculture farm operation may be sold; 101 Notwithstanding anything set forth elsewhere in this article, a temporary display area located in the front yard of the parcel may be used in connection with direct marketing taking place at the primary residence of the owner of a bona fide aquaculture/mariculture farm operation, subject to the following requirements: L1 The display area shall not exceed 100 square feet and may not be enclosed; Ll A refrigeration unit, not exceeding five cubic feet in size, may be used in the display area; f3L No generators may be used to supply electric power to the display area. Recreational uses. [Added 5-18-2021 by L.L. No. 6-2021] Lah Permitted recreational uses include, but are not limited to, uses such as tennis courts; pickleball courts; volleyball courts; paddleball courts; basketball courts; shuffleboard courts; playgrounds; jogging; hiking; outdoor ice skating rinks; outdoor skateboard/roller skate facilities; football, baseball, soccer playing fields, and the like, provided the following criteria are met: L�L The use is accessory to a community center or other not-for-profit use; I1 The recreational use is located on, or within 200 feet of, the parcel with the principle use; L31 The use shall be for the use of the general public; I4]_ The subject property on which the recreational use is to be located must be owned by a community center or similar not-for-profit corporation, or subject to a lease by the community center or not-for- profit corporation for a period of not less than 10 years; LL The recreational use shall be subject to special exception approval by the Zoning Board of Appeals; u The following activities are prohibited: Lal Private events, leagues, private clubs, organization activities or other uses which exclude participation by the general public. LL The charging of a fee for use of the facility. Lcl Retail sales, including the sale of food. I1 Outdoor lighting. M The following shall be permitted as part of the recreational use: rl Benches. LL Viewing stands. LL Kiosks. D. Rental permit for accessory apartments. Notwithstanding any prior course of conduct or permission granted, no owner of property shall cause, permit, or allow the occupancy or use of an accessory apartment created pursuant to § 280-.13A(6) or § 280-136(13)without a valid rental permit issued upon application to the Chief Building Inspector. [Added 6-15-2010 by L.L. No. 2-2010] 11) Content of application. An application for a rental permit or for a renewal of a rental permit shall bear the notarized signature of the owner and contain the following information: The name, date of birth and telephone number of the owner. The address of the subject property including street address and Suffolk County Tax Map number. In the event the owner is a corporation, partnership, limited liability company or other business entity, the name, address and telephone number of each owner, principal, officer, shareholder, partner or member of such business. The name(s) and telephone number(s) of all tenants. A copy of the lease agreement between owner and tenant. A copy of the certificate of occupancy or preexisting certificate of occupancy for the property. The owner of an accessory apartment within an existing one-family dwelling shall, in addition to the information required in § 280-13D(1)(a)through Lfl, provide a certification that the existing dwelling or accessory apartment is occupied by the owner and that the premises is in compliance with all of the provisions of the Code of the Town of Southold, the laws and sanitary and housing regulations of the County of Suffolk and the laws of the State of New York. The owner of an accessory apartment in an accessory structure lawfully existing pursuantto § 280- 1313(13) shall, in addition to the information required in § 280-1313(1)(a)through in, provide a certification that: [Amended 12-5-2017 by L.L. No. 20-2017] The existing single-family dwelling or the accessory apartment in the accessory structure is occupied by the owner as the owner's principal residence. The other dwelling unit on the subject property is to be occupied by either a family member or an individual who is currently on the Southold Town Affordable Housing Registry and eligible for placement. Rents charged to a tenant from the Affordable Housing Registry shall not exceed the rent established by the Town Board annually pursuant to § 280-30F of this Code. d) The dwelling unit is in compliance with all of the provisions of the Code of the Town of Southold, the laws and sanitary and housing regulations of the County of Suffolk and the laws of the State of New York. Review of application. The application for a rental permit shall be reviewed for completeness and accuracy by the Chief Building Inspector and, in the case of applications pertaining to accessory apartments in accessory structures, by the Government Liaison Officer. The Chief Building Inspector shall not issue a rental permit unless the application includes all of the requisite information enumerated in § 280-13D(1)through u and written approval by the Government Liaison Officer that the requirements of§ 280-13B(13)(i) have been satisfied. The Chief Building Inspector shall have the right to inspect the property to confirm compliance with the New York State Uniform Fire Prevention and Building Code and this Code. [Amended 5-3-2016 by L.L. No. 4-2016] Fees. A nonrefundable annual permit application fee in the amount of$150 shall be paid at the time of filing of an application for a rental permit or a renewal rental permit for an accessory apartment in an existing single-family dwelling.A nonrefundable annual permit application fee in the amount of$100 shall be paid at the time of filing of an application for a rental permit or a renewal rental permit for an accessory apartment in an accessory structure. Registry of permits. It shall be the duty of the Chief Building Inspector to maintain a register of permits issued pursuant to this chapter. Such register shall be kept by name of applicant and street address and set forth the date of expiration of the rental permit. Annual renewal. Rental permits issued pursuant to this chapter shall be valid for a period of one year from the date of issuance and must be renewed by application to the Chief Building Inspector in accordance with the procedures for the issuance of the initial rental permit within 10 days of expiration. LL Penalties for offenses. In addition to any other penalties for violations of this chapter,the Chief Building Inspector or Zoning Inspector shall revoke a permit when he or she finds that the owner has caused, permitted or allowed to exist and remain upon the premises a violation of any provision of the Code of the Town of Southold for a period of 14 days or more after written notice has been given to the owner. Should the owner permit any such violation of this Code,the laws and sanitary and housing regulations of the County of Suffolk and the laws of the State of New York to remain uncured for a period of 30 days or more after written notice has been given to the owner,the Chief Building Inspector may revoke the certificate of compliance for the accessory apartment. Appeal by owner. An appeal of a denial, revocation or renewal of a rental permit by the Chief Building Inspector based upon the owner's failure to satisfy the requirements of§ 280-13B(13)0)[1]and [2] may be taken to the Housing Advisory Commission, by written request, made within 30 days from the date of such revocation. The Housing Advisory Commission shall hold a public hearing on such appeal within 30 days after receipt of written notice of such appeal and, after such hearing, shall make written findings and a decision either sustaining such denial or revocation or issuing or reinstating such permit within 30 days after close of such public hearing.
