SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated January 18, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. PLANNING BOARD: This application was referred to the Town of Southold Planning Board for comments and issued its reply dated March 30, 2023, stating: The proposed special exception use of a nursery school at this location is consistent with the Town's Comprehensive Plan,which has a chapter focused on providing quality human services, and the second goal of this chapter includes sustaining and enhancing services for youth. The Long Island Regional Economic Development Council has identified Southold Town as a "childcare desert"; therefore, this above-referenced application is fulfilling an identified gap in services. Furthermore, the proposed location has supported similar uses in the past including a nursery school and church. The Board identified two key areas that require further consideration: 1. Parking: a.The applicant has delineated a drop-off/pick-up procedure in their application to ensure the safety and well-being of children. The Planning Board recommends the ZBA require the applicant to clarify proposed vehicle circulation for managing this procedure, including clear markings for entrance and exit. b.The Planning Board recommends the removal of the three parking stalls currently located by the front landscape area that abuts Main Road for safety reasons. c.Based on existing parking of 14 spaces(11, if the three around the island at Main Road are removed), and the proposed staffing of up to 12 employees the Planning Board recommends monitoring the situation in the future to be able to deal with potential parking constraints. 2. Exterior Lighting: All exterior lighting must comply with Chapter 172. Please require the applicant to demonstrate that all existing outdoor lighting complies. PROPERTY FACTS/DESCRIPTION: The subject, rectangular-shaped property consists of 40,075 square feet, .92 acres, located in the Business (B) Zoning District and measures 132 feet along Main Road a.k.a. State Route 25, then runs northwest 330.00 feet down the middle of a shared 22 feet wide (11 feet on the subject parcel) right of way, known as Sterling Lane,then continues west 131.54 feet before returning south 319.03 feet back to the roadway. The subject parcel is improved with a two story wood frame building (subject of this application)connected to a one story metal"Morton or Butler"building via a one story wood frame addition,roof over an open wood porch,handicap ramp,asphalt parking areas,wood tie planters,stoops and steps,various retaining walls, gravel parking, stockade fencing and gates as shown on a survey prepared by Nathan Taft Corwin, III, Land Surveyor, and dated May 2,2022. BASIS OF APPLICATION: Applicant requests a Special Exception under Article III, Section 280-13B(4) to establish and operate a Nursery School/Childcare/Early Learning; at: 31095 Main Road, Cutchogue,NY. SCTM#1000-102-2-24.1. RELIEF REQUESTED: The applicant proposes to use the front building facing Main Road,containing office space, as a childcare/early learning center for approximately 50 students. No proposed change in use will occur to the rear building accessed via Sterling Lane, currently leased to an auto-parts retailer. North Fork Discoveries LLC, a branch of Bright and Early Discoveries located at 608 Northville Turnpike, Riverhead NY, proposes to establish a second location,the subject property, converting the first floor area to a reception area, two toddler classrooms, two lavatories and kitchen with snack room; the second floor area to a preschool classroom; an outdoor area to two play areas; storage within the existing building and cellar accessed via an exterior bilco-type door. The applicant proposes to maintain a total of 14 parking spaces for staff, guest parking and drop-off of students located at the front of the building facing Main Road; should it be necessary, the applicant has arranged overflow parking at the rear of the building with the landlord and other tenant. ADDITIONAL INFORMATION: Members of the Zoning Board of Appeals performed individual interior inspections of the subject building and property on March 27, 2023. The applicant provided a detailed'statement of the described use, hours of operation, site description of services offered and a hand-drawn floor plan illustrating the uses per room, including the two outside play areas. Also included in the application are existing and proposed floor plans and elevations for the site prepared by Nicholas J.Mazzaferro,Licensed Professional Engineer,last revised January 5,2023 and labeled G001-2, A100-103. The subject property was originally a retail garden center/nursery established prior to zoning, including the lot"to the immediate north. In 2010 the subject building was issued a Zoning Board of Appeals Special Exception, file #6397se, to allow the establishment of a nursery school, the Maritime Day School, LLC. In 2013 the same structure was granted a similar Special Exception, file#6695se, to allow the subject building to be used as a church, True Light Church. Certificate of Occupancy for the subject parcel include: Z-2377 dated April 4, 1966 covering a business building Z-7322 dated June 12, 1974 covering an accessory greenhouse Z-7310 dated October 19, 1976 covering a retail nursery with greenhouse Z- 9978 dated June 16, 1980 covering a retail nursery-florist Z-9979 dated June 17, 1980 covering Pre-Existing non-habitable structures Z-13155 dated January 18, 1985 covering a 2-story addition to an existing building I Page 3,April 20,2023 #7760SE,North Fork Discoveries SCTM No. 1000-102-2-24.1 Z-13156 dated January 18, 1985 covering an accessory greenhouse Z-17946 dated April 14, 1989 covering an addition to a commercial building Z-20217 dated September 13, 1991 covering alterations& conversion of a retail store Z-27682 dated May 15, 2001 covering conversion of retail store to a real estate office According to the Property Card, as maintained by the Town of Southold Assessors office,the subject parcel was `split' from a larger parcel on December 9, 1995;the agricultural improvements remained on the northern lot(presently used as a wholesale nursery)and the commercial improvements including the subject building are maintained on the southern lot. The parcel lies within the B Zoning District. Planning Board site plan approval is not necessary for this application; the Planning Board previously reviewed the site, under an earlier application, and on October 31, 1988 authorized its use. No further action is required. During the public hearing the applicant stated that they will comply.with the Town of Southold Planning Board's requests, as outlined in the Memo cited above and will remove the three parking spaces from the landscape island at Main Road and will clearly mark the pavement and include signage for proper entrance/exit from the site. Several members of the public and parents of students spoke in favor of this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280- 142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. The proposed childcare/early learning center/nursery school will occupy a vacant building,previously used as a church,a nursery school,a real estate office,a retail storefront and offices building. No new construction is proposed nor expansion of the existing building. The nursery school will enroll a maximum of fifty children aged 6 weeks to five years in age and will provide a needed service to the community. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. The nursery school is a permitted use in the B Zoning District where the property is situated. C. That the safety,the health,the welfare,the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. Educational uses are inherently beneficial, and the proposed nursery school will promote rather than detract from the welfare of the community. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. See B and C above. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The use will be compatible with the character of the community in terms of visibility, scale, and overall appearance. The use is for an existing but currently vacant structure. The scale of the school, as described, is minimal, as it will consist of 5 small classrooms with a maximum total of 50 children Page 4,April 20,2023 #7760SE,North Fork Discoveries SCTM No. 1000-102-2-24.1 enrolled. The only"visible"portion of the use will consist of two small outdoor play areas,which will be fenced to secure the safety of the children. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. The owner/applicants are aware of the importance of safety for children and staff and will follow Town Code, establish a relationship with first responders and will also encourage the orderly and safe arrival and departure of the children. G. That the proposal shall comply with the requirements of Chapter 236,Stormwater Management. The structure to be used as the nursery school has a valid Certificate of Occupancy and no expansion or exterior alteration of the building is proposed; as such,there should be no new runoff created. In making such determination, consideration was also given to: A. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. B. The conservation of property values and the encouragement of the most appropriate uses of land. C. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent(whether liquid, solid, gaseous or otherwise) that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors, smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges, dust, light, vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or by other competent governmental agencies. H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. I. Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus,or by the undue concentration or assemblage of persons upon such plot. J. Whether the use or the structures to be used therefore will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. L. Whether the use to be operated is unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. Whether the site of the proposed use is particularly suitable for such use. N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate. P. Whether the natural characteristics of the site are such that the proposed use may be introduced there without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. Q. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. R. The conservation of property values and the encouragement of the most appropriate uses of land. S. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. T. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. Y. Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried to GRANT, a Special Exception, as applied for to establish the use of the front building as a nursery school/childcare/early learning center for a maximum enrollment of 50 children, and shown on the Survey prepared by Nathan Taft Corwin, III, Land Surveyor and dated May 2, 2022 and existing and proposed floor plans and elevations for the site prepared by Nicholas J. Mazzaferro, Licensed Professional Engineer, last revised January 5, 2023 and labeled G001-2, A 100-103. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Special Exception Permit granted herein may involve a change in occupancy or a change in use or a change within a classification of the occupancy. Therefore, as a condition of approval,the Page 6,April 20,2023 #7760SE,North Fork Discoveries SCTM No. 1000-102-2-24.1 applicant must contact the Building Department to make the determination whether or not a Building Permit is required and that changes will be NYS Code Compliant. 2. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department on an annual basis to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 4. In accordance with the Zoning Board of Appeals, approval shall thereafter be deemed a lawful use as if the same were permitted by this chapter without need for a special exception permit; provided, however,that: a) All conditions imposed by the special exception approval shall continue to apply unless they, by their express terms, are of limited duration. b) All conditions imposed on special exception approval uses generally or specifically by this chapter shall continue to apply, regardless of whether any such conditions were expressly incorporated into the special exception approval. c) The Zoning Board of Appeals shall retain continuing jurisdiction over the same; d) The duration of a special exception use may be limited to a specified time period as set forth in the approval of the Zoning Board of Appeals, if the approval is silent as to the duration of the special exception use,then said use shall be in perpetuity; e) A special exception use which has been discontinued for a period of one year or more shall be deemed abandoned 5. A maximum of 50 children can be enrolled at any time with a staff not to exceed 12 caregivers/teachers/clerical, etc. 6. The applicant is to permanently remove the three parking spaces at the `island' planter along Main Road 7. The applicant is to clearly indicate ingress and egress to the site via appropriate signage and painted arrows on the parking roadway entrance. 8. The applicant is to clearly indicate"drop off'areas at the site via appropriate signage and painted marking on the pavement. 9. All exterior lighting is to comply with Chapter 172, Lighting, Outdoor, of the Southold Town Code That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: Violations of Conditions. A violation of any limitation or condition of a special exception approval or of any provision of this chapter applicable to a special exception use shall constitute a violation of this chapter. The Zoning Board of Appeals shall retain jurisdiction and shall have the right, after a public hearing, to modify, suspend or revoke such approval or any term or condition thereof or to impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town Code.
