In your letter, you explain that the Trustees require the re-orientation of the residence in relation to the property lines and garage from the original ZBA approval. This revision represents no change to the original approved setback relief to the garage, as depicted on a revised Site Plan and Architectural Plans prepared by Mark Schwartz, Architect, dated September 7, 2023. Therefore, no de minimus approval will be required. However, the ZBA accepts as final approval the plans approved by the Trustees. ADDITIONAL INFORMATION: During the public hearing,the agent for the applicant explained that the project is a renovation of the existing house, which will attach the existing accessory garage to the existing house, thereby creating the need for technical variances for a building that currently exists with a Pre-certificate of Occupancy #Z14412, dated May 19, 1986. No structural changes will be made to the garage. The applicants will also install a new Innovative Advanced(I/A)sanitary system in the front yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The surrounding neighborhood is characterized by one- and two-story waterfront dwellings of varying sizes, many of which are on substandard lots, and have undergone renovations. The existing garage has been in place since it was approved by the ZBA in 1957 (Variance #38). Therefore,there is nothing in this application to create an undesirable change in the character of the neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicants are seeking to maintain the existing garage in its current location, and because the proposed house construction is deemed a demolition, variance relief is automatically triggered for the pre-existing nonconforming front and side yard setbacks for the existing garage. 3. Town Law &267-b(3)(b)(3). The variance granted herein for the side yard setback represents a 69% relief from the Code and is substantial.The front yard setback is only a 3%relief from the Code and is not substantial. However, since the building already exists,there will be no ground level disturbance,which mitigates the pre-existing location. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The pre- existing nonconforming setbacks were approved by the ZBA over 65 years ago when the garage was constructed in its current location. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this board. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Although to the extent that the difficulty is self-created, it was also approved by the Zoning Board, and also holds a current pre- Certificate of Occupancy. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate enable the applicant to enjoy the benefit of a re-constructed residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Because the construction plans entail the attachment of the garage to the residence, variance relief for its front and side yard setbacks is required to allow the garage to remain in place. The existing garage is located 38.9 feet from the front yard line where 40 feet is required and 4.6 feet from the side yard where 15 feet is required under Town Code Section 280-124 on lots measuring up to 39,999 square feet in total size. The subject parcel is a non-conforming 23,283 SF lot in the R-40 zoning district located on Calves Neck Road in Southold. With the exception of the pre- existing nonconforming garage footprint, the proposed construction will be entirely conforming to required setbacks. It is noteworthy that the existing garage setbacks were previously approved by way of ZBA Determination #38 of 1957 shortly after the advent of zoning in our Town. The Applicants also intend to relocate and upgrade the sanitary system in the front yard. For the following reasons, the Applicants submit that a Variance from Section 280-124 is warranted. POINT I THE APPLICANT HAS MET THE TEST FOR THE GRANT OF AN AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-B, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the , determination of the Board but shall not necessarily preclude the grant of the variance. It is respectfully submitted that under the facts and circumstances presented here, the Applicants can clearly meet the standards set forth in Town Law §267-B and as a result, the relief requested herein should be granted. 1. The Grant Of The Variance Will Not Cause An Undesirable Change In The Character Of The Neighborhood Or Create Detriment to Nearby Properties. The surrounding neighborhood is characterized by one-story and two- story waterfront dwellings of varying sizes, many of which are constructed on substandard lots and have undergone renovations or been reconstructed. Allowing the garage to remain where it has been since 1957 will not result in r � an undesireable change to the character of this residential community nor will it be of any detriment to nearby properties. The renovation of the garage in conjunction with the house construction will largely be cosmetic to update the exterior finishes. 2. The Benefits Sought to Be Achieved by Applicant Cannot Be Feasibly Achieved by Some Method Other Than the Requested Area Variance The Applicants are seeking to maintain the existing garage in its current location. Because the house construction.is deemed a demolition, variance relief is triggered for the pre-existing nonconforming front and side yard setbacks. 3. The Area,Variance Sought is Not Substantial. While variances for the side yard setback may be mathematically substantial at 69%, there is no new ground level disturbance in the side yard and prior ZBA relief was granted to allow the garage to be in its current location. The front yard setback relief is merely 1.1 feet and is essentially de minimus. 4. The Grant of the Variance Will Not Have an Adverse Impact on the Physical or Environmental Conditions in the Neighborhood or District. As stated previously, the pre-existing nonconforming setbacks were blessed by the ZBA over 65 years ago when the garage was moved to its current location. Granting of variance relief to allow the garage to remain where it stands will not have an adverse impact on the physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In addition, the Applicants will be upgrading to an I/A nitrogen-friendly system which is a net environmental benefit resulting from this project. 5. The Self Created Nature Of the Alleged Difficulty Should Not Preclude the Granting of Area Variance Relief. To the extent that the difficulty is self-created, pursuant to New York Town Law§267-B (3), a self-created hardship "shall not necessarily preclude the granting of an area variance." CONCLUSION For the reasons set forth herein, it is respectfully submitted that the standards of Town Law Section 267-B have been met and, as such, relief from the requirements set forth in Southold Town Code Section 280-124 is warranted. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration,grant an extension not to exceed three(3) consecutive one(1)year terms.
