(631) 765-1809 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF APRIL 20, 2023 ZBA FILE: # 7757 NAME OF APPLICANT: Neil William Currie and Katie Lynn Watson PROPERTY LOCATION: 1175 Champlin Place, Greenport,NY SCTM No. 1000-34-4-15 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated 1/13/2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 31, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards. On September 9, 2022,the LWRP Coordinator issued comments to the Town of Southold Board of Trustees pursuant to the applicant's request for a Wetlands Pen-nit proposing the same actions, as well as installing a new Innovative Advanced (I/A) sewage disposal system. The actions were considered CONSISTENT;therefore,this Board shall deem the proposal CONSISTENT with the LWRP Standards. PROPERTY FACTS/DESCRIPTION: The subject property is a non-confonning 42,645 square foot parcel located in an R-80 Zoning District. The parcel runs 196 feet along Champlin Place, runs 194.54 feet on the East side, runs 242.41 feet on the North side, and 200.00 feet on the West side. The parcel is improved with a single-family home and frame sheds. The buildable lot area is 16,972 square feet. The remander of the parcel is covered by Wetlands. All is shown on a survey prepared by Howard W. Young,L.S., last revised November 17, 2022. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's December 6, 2022 Notice of Disapproval based on an application for a permit to demolish an existing dwelling,construct a single family dwelling,and to legalize an existing shed(under 100 sq. ft.); at 1) dwelling located less than the code required minimum side yard setback of 20 feet; 2) dwelling less than the code required minimum rear yard setback of 60 feet; 3)"as built"shed located less than the code required minimum rear yard setback of 15 feet; located at: 1175 Champlin Place, Greenport,NY. SCTM No. 34-4-15. RELIEF REQUESTED: The applicant requests a variance to build a single-family structure with a side yard setback of 10 feet and a rear yard setback of 18 feet. The Town Code requires a minimum single side yard setback of 20 feet Page 2,April 20,2023 #7757, Currie/Watson SCTM No. 1000-34-4-15 and a minimum rear yard setback of 60 feet. The applicant proposes to legalize an"as-built"frame shed with a rear yard setback of 4.9 feet. The Town Code requires a minimum rear yard setback of 15 feet. ADDITIONAL INFORMATION: The applicant has the benefit of Southold Town Board of Trustees Permit No. #10217 dated September 14, 2022, Resolution dated December 22, 2022 to construct a new two-story dwelling in the proposed location. This approval includes Innovative Advanced (I/A) sewage disposal system to be installed, the maintenance of a 15 foot non disturbance buffer running along the landward limit of wetlands and the entirety of property to be kept as non-turf and all existing trees to remain. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances or will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood and consists of single-family homes in non-conforming locations. The proposed non-conforming side yard and rear yard setbacks are set back from Champlain Ave and will have limited visibility from the street. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Much of the parcel is covered with wetlands. Any proposed structure that would conform to zoning code would be placed in the wetlands and therefore not be permitted by the Town's Trustees and other environmental agencies. The applicant cannot build a new home without the benefit of variance relief. 3. Town Law§267-b(3)(b)(3). The variances granted herein for the rear yard setback is mathematically substantial, representing 30% relief from the code. The variance granted herein for the non-conforming side yard setback is mathematically substantial representing 50% relief from the code. However, the building envelope on the parcel is constrained by wetlands and it would be impossible to build a new home without the benefit of variance relief. The variance for the accessory shed is substantial representing 33%relief from the code.However,the shed has no adverse impact on wetlands, has been in place for many years, and is still in useable condition for needed storage. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 12267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new residence and as built shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Planamento,and duly carried, to Page 3,April 20,2023 #7757,Currie/Watson SCTM No. 1000-34-4-15 GRANT the variances as applied for, and shown on the Architectural Plans prepared by Charles M. The applicant shall observe all conditions listed in the Board of Trustees Permit No. 10217,dated,September 14, 2022. 2. The applicant shall install an Innovative Advanced(I/A)sewage disposal system as approved by the Suffolk County Department of Health Services. 3. When the as built shed is no longer useable due to further deterioration, it shall be demolished and any new shed on the subject property must be located in a conforming location. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The requested reduced setback from the proposed home would therefore not have a direct impact on a neighboring residential home.I further understand that the woodland may not be developed,therefore reducing the likelihood of any detriment to the land resulting from the construction of the proposed home—the design of which is intended to focus on the front yard outlook. The variance requested for the existing shed is made with the understanding that no changes will be made to the existing structure, as covered by Building Permit#7255,issued by the Town of Southold Building Department on May 10' 1974 (attached to this application for reference). The building permit was notated"10x10 no longer requires a BP or CO". 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: A 20 feet side yard setback would result in the proposed house being 10 feet closer to the wetlands on the East side of the parcel. I have detailed below some of the pertinent points of the variance request, including the efforts made in the last 19 months to obtain approval from the county, state and Town Trustees. Now that we have obtained these approvals, we are seeking to obtain the zoning variance approval to enable us to achieve our dream of building a home in Greenport. Throughout her childhood, my wife's family have owned property on the North Fork. When we were able to purchase the plot, we jumped at the opportunity. With the requested variance, we are seeking to build a modest home. I will be present at the hearing on the 6th of April, 2023, to represent the request. Both my wife and I hope that facts presented to the Board provide the information required to make a determination on the variance request. Many thanks, Neil W Currie Article III Section 280-15 I. The variance is requested to legalize an existing shed building, which has been in the same position on the property since its construction in 1974. II. A building permit was issued in 1974, dated May 14th (Building Permit#7255 submitted in the package to the Zoning Board of Appeals). III. The building,permit has a handwritten comment included, stating "10x10 no longer requires BP or CO" and is initialed "CB". As this is a record held by the Town, this is assumed to be written by a town official noting that the structure is sized such that neither a Building Permit('BP') or a Certificate of Occupancy ('CO') is required. IV. As the shed is believed not to have moved the request for a variance under current planning/zoning requirements is to legalize the existing shed through the approval of a variance. V. The current owners, Neil W Currie and Katie L Watson, would like to retain the structure for the storage of accessories required for the maintenance of the property. VI. No changes will be made to the position or footprint of the building on the lot. Article XXIII Section 280-124 I. Due to the unusual characteristics of the lot, the owners have no option other than to request a variance to the rear and side yard setbacks to allow for the construction of a new home on the property. The proposed home will replace an existing single-family home situated on the lot. A. Without a variance from the Zoning Board of Appeals ('ZBA'), it is not possible to build a home on the land within the permitted building parcel. 1 RECEIVED B. Due to the restrictions created by the wetlands (increase setba 0d preservation standards), the buildable area is further res icted. C. The variance requested is the minimum possible to allo fc�-otjq�% gtrcVc�tfic ppf new ,modest home. II. While the lot is zoned as R-80, with a total size of 42,645 square feet, the upland area is only 16,972 square feet, due to the coverage of the wetlands on the property. A. In comparison, non-conforming lots with less than 20,000 square feet require setbacks of 10' and 35' for side and rear yards respectively. B. Based on the characteristics of the lot, the requirements of the smaller lot size appears reasonable as a point of comparison for the variance requested in this application, due to the unique configuration of the lot(notwithstanding the understanding that the lot is zoned as R-80). C. The impact of the variance on neighboring properties is reduced as a result of the land immediately adjacent to the lot. On the Western perimeter there is a private road (see survey for details) which adds a minimum of 10' buffer to the property lines on Bailey Avenue (in aggregate it is believed that this would meet the setback requirements). On the Northern perimeter there is a wooded area, currently or formerly owned by Suffolk County. These areas are unused and would not be buildable (some owners have erected fences on the private road). D. As a result the impact on the neighboring properties is reduced/mitigated. III. The Trustees of the Town of Southold issued a wetland permit to construct the proposed house. A. Prior to the permit being issued, the owners reviewed the plans with the Trustees during a site visit and agreed to push the proposed structure further from the wetlands. The effect of this was that the side and rear yard setbacks were reduced. This has resulted in a relatively minor reduction from 13' on the current home to 10' in the proposed new home.. B. On September 9th 2022, the LWRP Coordinator issued a Memorandum detailing the application was deemed consistent with the LWRP (attached to this addendum). C. In agreement with the feedback received from the Trustees, the non-disturbance buffer surrounding the perimeter of the wetlands was increased from 10' to 15'. This has the effects noted in point III.A. D. In addition to the increased non-disturbance buffer, it was required from the Trustees that the remainder of the upland area be non-turf. This will be noted on the deeds as a covenant restriction, once final approvals are in place to build the proposed home (this is to be recorded with the County of Suffolk Clerk's office). E. The trees that are on the property will remain where they are healthy and do not pose a threat to the environment or the safety of those on the property. IV. The County of Suffolk Department of Health Services has approved the permit for the proposed home on 2/3/2023. This includes the newly installed waste water treatment system. A. The proposed home includes a best-in-class nitrogen removal wastewater system. 2 B. VII. Aerial photographs show reduced setbacks on other properties in the Town that are R-80, and have presumably been granted a variance (unless constructed before the town code was changed). VIII. On the balance of considerations, the proposed home would appear to be consistent with the Town's review of impact to the environment, character of the neighborhood, and other criteria. Wolpert Young & Young 400 Ostrander Avenue Riverhead, NY 119901 RE: NEIL CURRIE 1175 CHAMPLIN PLACE, GREENPORT SCTM#1000-34-4-15 Dear Mr. Wolpert: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 14, 2022 regarding the above matter: WHEREAS, Young & Young, on behalf of NEIL CURRIE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 13, 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 14, 2022, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed-will-not-affect-the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of NEIL CURRIE to demolish \ and remove the existing 585sq.ft. dwelling and 83sq.ft. utility shed and construct a new proposed 1,341sq.ft. two-story dwelling with a 259sq.ft. covered porch; a 168sq.ft. wood deck; a 30sq.ft. entry landing and stairs; a 34sq.ft. egress window; a 16sq.ft. outdoor shower; existing 89sq.ft. frame shed to remain; install two (2) new 8' diameter by 4' deep drywells for roof runoff; remove existing sewage disposal system and install a new IAOWTS sewage disposal system consisting of one (1) 500 gallon treatment unit and three (3) 8.5' long by 4.0'wide by 4.0' deep sanitary leaching galleys; establish and perpetually maintain a 15' non-disturbance buffer running along the landward limit of wetlands; with the condition that the entirety of the property be kept as non-turf and that all existing trees are to remain; and as depicted on the survey prepared by Howard M. Young, Licensed Land Surveyor&Thomas C. Wolpert, PE, last dated November 17, 2022 and stamped approved on December 22, 2022. Permit to construct and complete project will expire two years from the date the permit is signed.
