SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated December 22, 2022 stating that this application is considered a matter for local determination as there appears to be,no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a 51, 534 SF lot located in a B zone and is improved with an 16,061 sf one story metal building.The parcel has a 170.35 ft road frontage along Moore's Lane,then turns east for 302. 39 ft, the rear yard turns south for 103. 5 ft before returning 305. 73 ft back to Moore's Lane. This is shown on a survey by Nathan Taft Corwin Land Surveyor, dated January 28, 2014. BASIS OF APPLICATION: Request for Variances from Article XI, Section 280-49 and the Building Inspector's December 8, 2022 Notice of Disapproval based on an application for a permit to construct a storage building, at; 1) located less than the code required minimum rear yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 25 feet;3)construction more than the code pennitted maximum lot coverage of 30%; located at: 170 Moore's Lane, Greenport,NY. SCTM No. 45-7-3. RELIEF REQUESTED: The applicant requests the following setback and area variance relief to construct a storage building: 1. The proposed building has a side yard setback of 5 feet where a minimum of 25 feet is required. 2. The proposed building has a rear yard setback of 5 feet where a minimum of 35 feet is required. 3. The proposed building has a lot coverage of 41. 28%where a maximum of 30% is allowed. ADDITIONAL INFORMATION: The Southold Town Planning Board submitted a memorandum dated March 31, 2023 stating that the pre-existing nonconforming site was developed prior to site plan review with little landscape area and received approvals for the addition of an office from the Zoning Board of Appeals and the Planning Board in 2014. The warehouse use is relatively low in intensity and appropriate for this location. As proposed,the building Page 2,April 20,2023 97755, 170 Moores Lane Realty SCTM No. 1000-45-7-3 would align with the existing warehouse along the side yard and at 17 ft tall would be lower in height/scale than the warehouse at 23 feet. Although the relief requested increases the nonconformity of the site, the addition of the storage building is reasonable due to the pre-existing nonconforming development history of the parcel that exists with little visibility from Route 25,compatible surrounding uses,the reduction of trucks parked and used for storage, and the removal of temporary storage containers on site. During the public hearing,the applicant's representative described the use of the storage building as a transfer station to temporarily store small loads, since the warehouse is at capacity. The building is not to be used for public storage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6, 2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is zoned business and is surrounded by other businesses, a school, park, Public Utility company and a few residential properties. The property has historically been used for business use. Adding more storage building space to this property will not change the character of the neighborhood or be a detriment to nearby properties. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. The existing storage building has been in existence for more than 40 years, and has always been used by a moving and storage company, which is a conforming use in a B zone. The applicant is proposing an additional storage building on the site on which any proposed construction would require variance relief. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. 1. The proposed side yard setback represents a 80% relief from the code. 2. The proposed rear yard setback represents a 86%relief from the code. 3. The proposed 41. 28% lot coverage represents 37%more than the code allows. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the conditions of this board. The property is currently surrounded by commercial used properties. Town Law X267-b(30)(5). The difficulty has been self-,created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a proposed storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Lehnert, seconded by Member Dantes,and duly carried,to GRANT the variances as applied for, and shown on the site plan and architectural plans drawn by Nicholas J. Mazzeferro, PE, dated September 6,2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall conform to all exterior lighting codes as outlined in Chapter 172 - Lighting, Outdoor, of the Town Code. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the variances)granted herein as shown on the architectural drawings,siteplan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformides under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one (1)year terms. Purpose: This is in reference to the commercial business facility operated by Jernick Moving&Storage Inc. The facility is located at 170 Moores Lane, Greenport,NY 11944.This established moving business has been operating on the North Fork in the Town of Southold since 1 cj yO There are currently 40_employees headquartered at this facility. This Southold Town location is the corporation headquarters and this business operation is the major moving company supporting the residents and businesses of Southold Town. This company is the primary mover for all the hamlets of the North Fork especially the Peconic Landing Community. This facility is the primary center for the business and contains the main office,warehousing,transfer operation and parking location for the truck fleet. This document was prepared to initiate and advance the process for obtaining a building permit for construction of permanent transfer and storage space in the rear yard of this facility. The proposed construction work will greatly improve the site conditions, enhancing the appearance of the facility while increasing the efficiency of the operation. The proposed construction replaces an ad-hoc temporary set up which lacks efficiency and does not create the optimum appearance for the property. It is important to note that the proposed transfer and storage space in the rear yard is not actually an additional facility; it is replacing portable and temporary structures that do not enhance the properties appearance. Existing Conditions: The existing warehouse building is a Butler-type building,believed to have been manufactured by the Stran-Steel Corporation. We have drawings by Donald A. Becker and Richard P. Arelt Architects, dated 1972. The original structure was approximately 80' east-to-west and approximately 125'north-to-south. P. 1/5 The drawings indicate that the existing siding and roofing is 26-gauge galvanized steel sheet with a factory-applied paint system. The current paint color is a forest green. A later similarly constructed addition expanded the warehouse to the west. We have drawings by the Lundquist Construction Company dated 1977 for that expansion. This work expanded the warehouse by 48' to the west. An office addition was later added to the west of that warehouse extension, for which drawings were prepared by Nancy Dwyer Design Consulting, Inc. and Sherman Engineering& Consulting P.C. in 2015. These shipping containers are not permanent structures and are not designed to be an effective transfer storage facility. As business activity increases there is more need for efficient transfer storage and distribution at the facility. One solution is to acquire more temporary containers and possibly stacking them as they were designed Unfortunately this solution does not efficiently address the problem and is at best a stop gap measure. Continued use of these containers does not provide the best business operation or environmental conditions on this property. Although these containers are not permanent and located in the rear yard, they do not enhance the visual aspects of the property or the business operation. In addition, at any given time there are also numerous moving trucks parked in the rear lot waiting to be loaded or as short-term storage of customers' goods. If a proper transfer facility is added to the property these Z acks would be better organized when parked and used more efficiently moving goods. The proposed solution to the problem is to construct a low profile storage building specifically designed for this purpose.The proposed short-term storage building will allow Jernick Moving& Storage to stage moving items in a dedicated building. The benefits are as follows: Avoids conflict with long-term storage in main warehouse building, saving energy, equipment run time and labor expenditure Reduces quantity of trucks parked and used for storage on site Removes negative visual effect of shipping containers on site The proposed storage building will be manufactured by XX(or similar manufacturer)and constructed of pre-fabricated steel. It is proposed to be XX' east to west, and XX' feet north to south. Two levels are proposed,which will be approximately XX' above curb. The short-term storage building is proposed to be constructed in the northeast comer of the existing rear yard, in the present location of the shipping containers. The containers will be removed. The proposed low profile building location aligns the north side wall with the north side wall of the existing warehouse building. A 5' minimum setback will be maintained along the north lot line to provide emergency access, aligning with the existing warehouse. Southold Zoning Regulation requires 25' side yards for properties in this `B' General Business District, for which a variance is necessary. A 5' minimum setback will similarly be maintained along the east lot line to provide emergency access. Southold Zoning Regulation requires 25' year yards for properties in this `B' General Business District, for which a variance is necessary. The lot coverage currently stands at 33.38%,exceeding the 30%allowed for this `B' General Business District.The proposed lot coverage is 41.80%, for which a variance is necessary. Attached are preliminary drawings showing the site plan and elevations for the south and east sides of the property- The site plan shows the proposed location aligning with the existing warehouse and the space left for access around the building. It is noted that the proposed building location has been selected to maintain as much ofthe rear parking area as possible.The use of this rear yard area needs to be optimized to allow truck maneuvering,loading and short tam paddng. The elevations provide a true scale picture of the site with the proposed storage building in position. The South Elevation shows that the proposed building is less massive than the existing structure.This elevation view is along the rear yards of the commercial and residential properties that front on Rte. 25. The visibility from Rte. 25 is limited by the structures that front on the road. The East Elevation shows that the proposed building overlaps the existing warehouse and has a minimal impact on the visual read ofthe property.This elevation is seen from the School property. There is an existing fence along this property boundary that reduces the visual impact. In addition the School has an open field that has a distance of 375 feet from the rear property line to the school building. This field contains an agricultural greens house,open growing bed areas and tennis courts.There is also a tree line planted along the School side of the field. The property adjacent to the north is owned by the Village of Greenport and contains the municipal buildings for the electric and water departments. The buildings and industrial structures house the power plant, cooling equipment and industrial facilities used for village utility operations.There are also numerous stacks on the property and the facility has a very strong industrial appearance.The view of the Jernick property from the north is completely obstructed by the Greenport Village facility.
