Lucia PROPERTY LOCATION: 200 Green Hill Lane, Greenport,NY SCTM#33-3-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated 12/22/22 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 22,537.70 square foot parcel located in an R-40 Zoning District. The parcel runs 100.00 feet along Green Hill Lane,runs 230.84 feet on the North side, runs 100.60 feet on the East side and runs 219.90 feet on the South side. The parcel is improved with a two- story frame residence, an in-ground pool, a wood shed, and a pergula with shed and outdoor shower. All is shown on a survey prepared by Jason D. Leadingham,L.L.S. last revised July 13, 2022. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15 and the Building Inspector's December 15, 2022 Notice of Disapproval based on an application in conjunction with building permit 446053, to construct an accessory pool house/cabana and to legalize an existing shed, at; 1) pool house located less than the code required minimum side yard setback of 10 feet; 2) shed located less than the code required minimum rear yard setback of 10 feet; 3) shed located less than the code required minimum side yard setback of 10 feet; located at: 200 Green Hill Lane,Greenport,NY. SCTM No. 33-3-13. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built"pool cabana with outdoor shower and an "as-built" shed. The pool cabana roof line has a side yard setback of 6.5 feet with the wall of the cabana having a setback of 9.7 feet, where code requires a minimum side yard setback of 10 feet for accessory structures. The "as built" shed located in the rear of the property has a rear yard setback of 9.9 feet and a side yard setback of 8.2 feet where code requires a minimum side yard setback and rear yard setback of 10 feet for accessory structures. ADDITIONAL INFORMATION: A letter of support by the applicant's neighbor was received. Page 2,April 20,2023 #7754, Sourbis SCTM No. 1000-33-3-13 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances s for the as-built pool cabana and shed will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes where pools and pool cabanas are typical accessory structures. The non-conformity is created by a roof overhang. The vertical walls of the structure, the storage section, and the outdoor shower are about 10 feet from the property line. The pool cabana is an unheated, unenclosed structure. The granting of the variance for the shed will not produce an undesirable change in the character of the neighborhood. The shed is in a conforming location in the far rear corner of the property and is not visible to any other properties since it is screened with six-foot high fencing from the adjacent neighbor and is parallel to the neighbor's shed in a comparable location, and the property to the rear is undeveloped woodland. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant for the pool cabana cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The pool is in the existing location and this is the best location to place a pool cabana. Although the benefit sought by the applicant for the shed can be achieved by moving the shed to conforming setbacks,the setback difference will not be discernable. 3. Town Law 4267-b(3)(b)(3). The variance(s) granted herein for the pool cabana is mathematically substantial, representing 35% relief from the code. However, the need for the variance is triggered by the roof overhang of the pergola. The variance for the shed rear yard setback is .3%and is de minimus in nature and although the 18% reief for the 8.2 ft.side yard setback is substantial, it cannot be seen from the adjacent properties or the road and is located in a conforming rear yard. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law X267-b. Grant of the requested relief for the pool cabana is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool cabana while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Granting the requested relief for the non- conforming setback for the accessory shed is not the minimum action necessary for the applicant to enjoy the benefit of a shed. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to GRANT the variances as applied for,and shown on the Architectural Plans prepared by Anthony Portillo Architect, labeled G-001.01 and A 10 1.0 1 dated November 16, 2022, and Survey prepared by Jason D. Leadingham, L.S., last revised July 13, 2022. 1. The applicant must apply to the Building Department for a building permit(if applicable) for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Page 3,April 20,2023 #7754, Sourbis SCTM No. 1000-33-3-13 Board of Appeals,or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained_ This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,siteplan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Use a level and make sure each wall is level then screw a temporary board to the inside of the studs, 1 per wall. Place the cut end towards the top as this will get covered up by trim later. 5-Start with the overlap side toward the corner and the underlap side landing on the 4' stud. 6-Nail it off by putting a nail by every groove at the top and bottom, then 6 spaced evenly in the middle at each stud. 7-Overlap the next sheet to the overlap groove and nail through both sheets at the overlap. Use the same 2 Y2" nails that you used for the siding. 2-Before making any cuts, determine the best layout of pieces from each board so you don't end up short and/or have a lot of waste. Measure twice, cut once. 3-Cut and install the corner trim first. Each corner will have 2 pieces, one on the side and one on the gable. The gable piece will have a 4/12 pitch cut at the top. 4-You will need to get an exact measurement between corner trims for the eave trim board. It will go tight to the bottom of the roof osb overhang and nailed at every truss with two-2 Y2" nails and on top of the siding. 5-The Horizontal trim will also need an exact measurement between the corner trim. Install with the bottom edge even with the bottom edge of the top-plate above the door opening. 6-Jamb trim goes against the horizontal trim and down to the bottom of the siding and even with the inside of the door jamb. 7-Lastly install the gable trim, it is cut similar to the trusses with a 4/12 at the top and bottom. Note-Additional nails may be needed if you are in a high wind area. 4-The next row cut the shingle with a utility knife 6" shorter than the first row as shown. 5-Even up the shingle with the edge of the gable style-D trim and the bottom edge of the shingle on the groove in the middle of the first shingle as shown. If your opening is a little smaller or bigger you may have to adjust accordingly. 2-Cut the 2x4 framing material and attach with the remaining plates and pan nails. Plates will be installed on each side at every joint. 3-Next Cut the%" siding to the same width as the frame however the siding will need to be 1 '/z" longer and hang down past the floor joist. This will cover the bottom gap when the door is installed.Attach with pan nails. 4-Cut the trim around the edges and install with the 2 '/2"trim nails. 5-The door hinges will get screwed on. Center the pivoting part of the hinge with the edge of the door so they are on and ready when you stand the door up. 6-Hold the door up with a%"spacer between the door frame and top of the floor plywood. Then screw the hinges to the jamb trim making sure you have an even '/" gap at the top and the hinge side of the door is against the jamb trim. It usually takes a couple adjustments to get it to where it closes just perfect. We ask that you send your mailings promptly so that if any piece is undeliverable, you can reach out to your neighbors to request their mailing addresses, and re-mail.
