SOUTHOLD TOWN BOARD OF APPEALS
November 17, 1960
A regular meeting of the Southold Town Board of Appeals
was held ?z30 P.M., Thursday, November 17,. 1960, at the Town
Clerk Office,. Main Road, Southold, New York.
There were presentg Messrs. Robert W. Gillispie, Jr.,
Chairman,. Robert Bergen~ Herbert Rosenberg~ and Charles
Grigonis, Jr.
Absent: Mr. Ser~e Doyen, Jr.
PUBLIC HEARING: Appeal No. 326 - 7~30 P.M. (E.S.T.),
upon application of Peter Karas, a/c Olga Karas, West Front
Street~. Greenport, New York, for a special exception in accord-
ance with the Zoning Ordinance, Article IVa Section 408,. for
permission to erect and maintain a directional sign on the
property of Sunrise Coach Lines, Inc., south side Route 25,
West Front Street~ Greenport, New York, bounded north by Route
25~. east by Fleet Lumber,. Inc,, south by Long Island Railroad,
and west by Giovanelli and Schultze. Fee paid $15.00.

The Chairman opened the hearing by reading application for
a special exception, legal notice of hearing ~ affidavit attesting
to its publication in the official newspaper and letter from
property owner.
THE CHAIRMAN: The Sunrise Coach Lines property is business
and the Giovaneilli & Schultze property is business.
Is there anyone present who wishes to speak for this appli-
cation?
MR. PETER KARAS~. West Front Street, greenport: Whatever the
application states is true. We find it urgent to have the sign
for our business as it states in the application.
THE CHAIRMAN: Do people tell you that they cannot locate you?
MR. KARAS: Yes. They are always coming into my place and
telling me they missed me when they came into the village.
THE CHAIRMAN: Where do you have other signs?
MR. KARAS: I only have one other on the west side of Chapel
Lane on Route 25, right next to Claudio~s sign.
(The Board discussed with Mr. Karas the location of the signs
on his property. )
THE CHAIRMAN: What wording will be on the sign?
MR. KARAS: "Greenport Snack Bar, Restaurant - Sea Food~"
and an arrow pointing across the street to the sna~k bar.
THE CHAIRMAN: Are there any other questiom anyone would
1/ke to ask Mr. Karas?
(There was no response.)
THE CHAIRMAN~ We~Duld like it understood that if this appli-
cation is granted, you may be required to move this sign back~ as
Giovanelli and Schultze plan to build a gas station and public
garage on the next lot and the sign may interfere with the vision
of the public on approaching their propertyQ

MR' KARAS: Sunrise said I should put the sign wherever
it is agreeable to the Board.
THE CHAIRMAn: Is there anyone present who wishes to speak
again~ this application?
(There was no response.)
Resolution was offered by Mr. Gillispie, seconded by Mr.
Grigonis~ and carried~ WHEREAS application of Peter Karas~ a/c
O~ga Karas~. having been considered at Public Hearing No. 326
on November 17, 1960, and the Board finding that public con-
venience and welfare and justice will be served and the legally
established or permitted use of neighborhood property and
adjacent use districts will not be substantially or permanently
injured and the spirit of the Ordinance would be observed~ there-
fore be it
RESOLVED that Peter Karas~ a/c Olga Karas be granted
permission to erect and maintain a directional sign on the
property of Sunrise Coach Lines, Inc.,West Front Street~
Greenport~ New York. Size of the sign to be 52 in. by 100 in.~
lower edge shall be no less than 3 ft. from the ground level,
upper edge not more than 15 ft. 6 in. above the ground level.
This sign to be located no closer to the front property line
than the line established by the E. E. Johnson sign to the
west. Wording to be: "Greenport Snack Bar~ Restaurant -
Sea Food"~ with an arrow pointing across the street.
This sign is subject to the same regUlations and controls
which affect non-conforming signs.
Vote of the Board: Ayes:- Mr. Gillispie~. Mr. Bergen, Mr.
Rosenberg, and Mr. Grigonis.
PUBLIC ~EARING: Appeal No.327 - Upon application of Lloyd
Clark, Sound View Avenue~ Southold, New York, for a variance in
accordance with the Zoning Ordinance~ Article III, Section 307,
for permission to reduce westerly side yard on property located
on the north side of Sound View Avenue, Southold~ New York,
bounded north by George Rorke~ east by C. E. Knoblock, south by

Sound View Avenue~ and west by Eugene Gentile, Fee paid $15,00.
The Chairman opened the hearing by reading notice of dis-
approval issued by the Building Inspector, application for a
variance, legal notice of hearing, affidavit attestin~ to its
publication in the official newspaper and letter from applicant.
THE CHAIRMAN: IS there anyone present who wishes to speak
for this application?
MR. LLOyd CLARK~ Sound View Avenue~ Southold~ NewYork:
have nothing more to add to the application.

(Mr. Clark presented a blue print for the Board's perusal
and a model of his house with the proposed addition. )
THE CHAIRMAN: Wh.yl is it necessary to locate the addition
on this side of the house?

MR. CLARK: The addition will/~he laundry room, a playroom
for the children and another garage will replace the present one.
I have four children and therefore need the additional bedroom
and a playroom.
THE CHAIRMAN~ Are there any other questions?

THE CHAIRMAN: Is there anyone present who wishes to speak
against this application?'
(Th.ere was no response,)
Resolution was offered by Mr, Bergen~ seconded by Mr.
Grigonis, and carried, WHEREAS application of Lloyd Clark having
been considered at Public Hearing No. 327 on November 17, 1960,
and the Board finding that strict application of the Ordinance
would produce undue hardship because this dwelling%ms erected
on an odd shaped lot prior to zoning and it was not centered. The
addition must be on the west side Because of layout of the rooms.
The hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district because this is one of the oddest shaped
lots in the area. Also, mostof the other dwellings in the

in the neighborhood maintain the minimumside yard requirement~
The variance does observe the spirit of the Ordinance and would
not change the character of the district because the use~will be
residential in keeping with the neighborhood; therefor~
it
RESOLVED that Mr. Lloyd Clark be granted permission to build
addition to existing one family dwelling, maintaining a 5 ft.
westerly side yard.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Rosenberg~
Mr. Bergen~ and Mr. Grigonis.
PUBLIC HEARING: Appeal No. 328 - Upon application of
William T. King~ 228 Date Palm Driver Lake Park, Florida, for
a special exception in accordance with tt~ Zoning Ordinance,
Article III. Section 306, for permission to reduce front yard
setback on a corner lot. Location of property: Bayview Avenue,
Gremnport~ New York, Lots No. 1 and 2 on map of Summer Haven.
Fee paid $15.00.
The Chairman opened the hearing by reading applicat ion for
a special exception~ legal notice of hearing,, affidavit attesting
to its publication in the official newspaper, a letter from the
applicant and a letter from Robert White, a neighbor on Bayview
Avenue.
THE CHAIRMAN: Is there anyone present who wishes to speak
for this application?
(There was no response.)
(The Board discussed the established setback on Bayview
H~enue. The Board also discussed the setback on the Town Road
which Mr. King requests to be 10 ft. It was th.e opinion of
the Board that the setback should be 20 ft. since J. King, the
property owner .on the opposite corner maintains a 20 ft. setback
and also because the Town Road runs to the water.)

Resolution was offered by Mr, Gillispie, seconded by Mr.
Bergen, and carried, WHE~ application of William T. King,
having been considered at Public ~Hearing No. 328 on November 17,
1960, and the Board finding t/lab the public convenience and
welfare and justice will be served and the legally established or
permitted use of neighborhood property and adjacent use districts
will not be substantially or permanently injured and the spirit
of the Ordinance would be observed~ therefore be it RESOLVED
REeOLVED that William T. King be granted permission to
reduce setback requirements to no less than 20 ft. on north
side of lots marked 1 & 2 on map of Summer Haven~ Bayview
Avenue~ Greenport. Southerly side yard'to be no less than 10
ft. Setback on Bayview Avenue to be no less than 9 ft. The
purpose of maintaining a 20 ft. setback on the north side of
property is because of the existence of a Town road leading to
the water and the fact the property owner on the opposite corner,
John King~ maintains a 20 ft. setback from the Town road.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, Mr.
Rosenberg, and Mr. Grigonis.
The minutes of the meeting of October 27, 1960, on motion
of Mr. Rosenberg~ sec0. nded by Mr. Bergen,. and carried, were
approved as submitted.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
Rosenberg, and Mr. Grigonis,
The minutes of the meeting of November 10~ 1960, on motion
of Mr. Rosem_berg~ seconded by Mr. Grigonis~ and carried, were
approved as submitted.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr.
RoseD_bergt and Mr. Grigonis.
On motion of Mr. Bergen, seconded by Mr, Rosenberg~ and
carried, the Board of Appeals set 7:45 P.M. (E.S.T.), Thursday~
December 1, 1960~ Town Clerk Office, Main Road~. Southold, New
York as time and place for hearing upon application of James
and Adele Rich~ Wells Avenue, Southold, New York~ for a variance

in accordance with the Zoning Ordinance, Article III, Section
300, Subsection 7, for permissiOn to locate private garage
with reduced setback. Location of property: south side of
Wells Avenue, Southold, New York, Lot No. 7 on map of George
H. Wells.
Resolution was offered by F~r. Rosenberg~ seconded by Mr.
Grigonis~ and carried, setting 8:00 P.M. (E.S.T.), Thursday,
December 1~ 1960., Town Clerk Office, Main Road~ S0uthold,. New
York, as time and place for hearing upon application of Donald
Frederick, a/c Arthur Uelar~ and wife, sound View Avenue~ Southold,.
New york, for a variance in accordance with the Zoning Ordinance,
Article III, Sect'ion 307, for permission to reduce westerly side
yard on property located on north side of Sound View Avenue,
Southold~_ New York,. bounded north by sound, east by Edward Kamps,
iS0uth by Sound View Avenue, and west by A. & M, Baker.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,. Mr.
Rosenberg~ and Mr. Bergen.
On motion of Mr. Grigonis, seconded by Mr, Bergen~ and
carried, the Board of Appeals set 8:15 P.M., (E.S.T.) ~ Thursday,
December 1, 1960, Town Clerk Office~. Main Road, Southold, New
York as time and place for hearing upon application of Sun
Valley Manor,. Inc., 176 Central Avenue~ Patchogue, New York, a/c
John W. Doyle, 106 Fruita Street, Port Jefferson, New York, for
a variance in accozdance with the Zoning Ordinance, Article III,.
Section 307,.' for permission to reduce easterly side yard on
property located on the northerly side of WatervieW Drive,
Southold, New York, bounded north by Goose Creek~ east by Mary
Weiss~ south by Waterview Drive~ and west by Eastern Suffolk
Realty, Inc.
Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen,. Mr.
Rosenberg, and Mr. Bergen.
(The Board forwarded a letter to Brookhaven Board of
Appeals requesting any information they might have on ~un
Valley Manor, Inc. )
IT ~AS FURTHE~ RESOLVED that legal notice of hearings be
published in the official newspaper under date of November 23~ 1960.
