SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is located at the southerly end of Windy Point Lane and contains a total area of 13,153 sq. ft. The property is improved with a dwelling and shall frame shed as shown on the April 8, 2002 survey prepared by John T. Metzger, L.S. Also shown on the survey is a 10 ft. wide right-of- way extending through the applicant's lot to the adjacent property now or formerly of Robert B. Boger and Susan L. Johnson, and wetlands adjacent to the Corey Creek shoreline. BASIS OF APPLICATION: Building Department's February 11, 2003 Notice of Disapproval, citing Section 100-33C (ref. 100-244B), in its denial of a permit to demolish an existing accessory shed and to construct a new accessory shed building at less than 35 feet from the front lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 19, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to demolish the existing 8'1” x 6'6" shed located 1.5 feet from the northeast property line and build a new 8' x 12' shed three (3) feet from the northeast property line and at least 10 ft. from the northwest property line. The height of the shed is proposed at +-12 feet from the peak of the roof. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties, if granted,because: The new shed will merely replace a 40-year old deteriorating metal shed. The new shed will be consistent in both size and appearance with those presently found in the surrounding neighborhood and will, in fact, be far more attractive than the existing structure. The adjacent property owners,who I have know for over 25 years, have never expressed any concerns or complaints about the presence of a shed in this particular location. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance,because: The shed needs to be located at least 100 feet from the shore and near the existing well, which supplies domestic water to the house. The well must be located where it presently is because it needs to be as far as possible from the shore(to avoid salt water intrusion) and it must be situated away from my neighbors (and my) cesspools. Accordingly, based on the above facts, the shed can only be located where it presently is on the property. The original building permit application was denied because a 35-foot front yard set back is required. Based on the layout of the roadway (which is actually a private right of way), the location of the shed is considered by the code to be in the front yard,because this portion of the property faces the right of way. As a practical matter, however, this portion of the property serves as the back yard, because the main house faces away from this yard and both main house premise doors face the other side of the property. This unique situation can be seen when examining the survey and will become more apparent when the site inspection is performed. Additionally,this is the best location for a shed because it is the most"remote"part of the property, where such structures are typically located. • 3. The amount of relief requested is not substantial because: The location of the new shed will be approximately 22 feet from the front yard lot line,which is only 13 feet less than the 35-foot code. 4. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The shed location is approximately 105 feet from the wetlands and, therefore, causes no adverse impact on the wetlands. The shed location will be sufficient distance (approximately 10 feet) from the private right of way so as not to hinder vehicular passage. 6. Additional information about the surrounding topography and building areas that relate to the difficulty in meeting the code requirements: Based on the size and configuration of the lot and the placement of the main house, there is no other practical location for this shed. This conclusion is based on the need to be a certain distance from the wetlands, existing cesspools (well water considerations) and the right of way. Finally, I am certain that my neighbors will not object to the installation of a more attractive replacement shed, which will be in substantially the same location as the 40-year old existing, deteriorating shed. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wishes to build a new shed to replace the old shed, which was even closer to the private right-of-way than proposed. The applicant has a small lot of 13,153 sq. ft., which includes the area of a 10 ft. right-of-way and saltwater marsh area to the south of the house. There is no other room in the front yard to place the new shed. 3. The requested area variance is not substantial. In fact, the new 12' x 8' accessory shed is +-22 feet from the front yard line and about 10 feet from the right-of-way. 4. The difficulty was self-created at the time of purchase and when a new shed was planned and designed by the applicant. 5. There is no evidence to suggest that the grant of the setback variance for a small storage shed will have an adverse effect or impact on physical or environmental conditions in the neighborhood or district. 6. Grant of the variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new shed, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Chairwoman Tortora, and duly carried, to GRANT the variance as applied for, as shown on hand-drawn sketch on the map of John T.
