Appl. No. 5313—VIHOLD CORP. (and J & C HOLDING, Contract Vendee) Southold Tow `",'"k / Location of Property: 19625 Soundview Avenue, Southold; Parcel 51-1-22.2. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the north side of Soundview Avenue in Southold. The property consists of a total area of 25,129 sq. ft. with 98 feet along the mean high water of the Long Island Sound and 103 feet along Soundview Avenue. The parcel is improved with a small, one-story frame building existing at 39.7 feet from the wooden wall along the bluff. Also existing is a wooden bulkhead along the mean high water of the Long Island Sound and upper wooden wall along the bluff, as shown on the July 27, 2002 survey prepared by Hillebrand Land Surveying, P.C., revised May 29, 2003. BASIS OF APPLICATION: Building Department's February 6, 2003 Notice of Disapproval denying a permit under Code Section 100-239A.1 to locate a proposed new dwelling less than 100 feet from the top of the bluff of the Long Island Sound, after removal of the existing building. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 15, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: The applicant proposes to remove the preexisting building containing nonconforming setbacks, and requests an area variance to locate a new single-family, two-story dwelling at 45 feet from the wooden wall along the bluff instead of the code required 100 feet. The remaining setbacks are proposed at 85 feet from the southerly front lot line, and side yards at 17 feet on the west side and 26 feet on the east side. ADDITIONAL INFORMATION: By letter dated May 9, 2003, an evaluation forwarded from the Suffolk County Soil and Water Conservation District with respect to its review of this proposal and the existing conditions at the site. The bluff was found by the County al lii Page 2-June 19, 2003 Appl. No. 5313-Vihold Corp./J & C Holdings 51-1-22.2 at Southold to be in stable condition with dense vegetative cover, including small trees, shrubs and fines. The upper bulkhead was found in sound condition, while the lower bulkhead at the toe of the bluff appeared to be in tact, and there was no physical access established to the beach from the top of the bluff The general topography is sloping away from the bluff face, and the land itself is entirely vegetated with grasses and some landscaping. The only other agency approval submitted for the record was Permit #5706 from the Southold Town Board of Trustees issued February 26, 2003. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board made the following findings: 1. Grant of alternative relief noted below will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The board believes the proposed 45 ft. setback would be too close and intrudes within the 100 ft. restricted building area. The property is a nonconforming lot consisting of 25,129 sq. ft., improved with a small building situated close to the east side line at 2.4 feet and close to the northerly bluff at 39.7 feet. The board concludes that the greater setback and conditions set forth below are more in keeping with the established character of the neighborhood and not be adverse or detrimental to nearby properties. The location of the new dwelling will also conform to the current code requirements with regard to minimum side yard and front yard setbacks. 2. The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue other than the area variance requested. Applicant can increase the setback from the bluff as noted in the grant of alternative relief noted below. 3. The requested variance at 45 feet is substantial, with a 55% reduction of the code's 100 ft. minimum setback; and while the board believes a setback at least 50 feet from the top of the bluff is substantial, it is less offensive. 4. The relief requested was self-created when this nonconforming lot was acquired with knowledge of a nonconforming building and limited building area. 5. No evidence has been submitted to this board to suggest that the grant of alternative relief will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a residence, while preserving and protecting the character of the neighborhood, and the health, safety, and welfare of the community. 111P Page 3-June 19, 2003 Appl. No. 5313-Vihold Corp./J &C Holdings 51-1-22.2 at Southold RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to DENY the requested variance, and ALTERNATIVELY to GRANT a variance allowing a 50 ft. minimum setback from the top of the bluff, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The maximum building height measured at the ridge line (i.e., roof peak, highest point of roof)will not exceed 32 feet above the average natural grade (41'). 2. The vegetation screening along the westerly twelve (12) feet of the premises opposite the house (the Buffer area) will not be removed, except to remove dead and diseased material and to properly prune and maintain the landscaping. In the event vegetative material is removed from the Buffer area so as to impair the screening, the applicant will cause screening shrubbery to be planted in the affected portion of the Buffer area along a line which is at least 10 feet from the westerly boundary of the property. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. He would like to review it with his wife this evening before giving his approval. The applicant is agreeable to the following conditions if the variance is granted: 1. The maximum building height measured at the ridge line (i.e., roof peak, highest point of roof), will not exceed 32 feet above the average natural grade (41'). 2. The vegetation screening along the westerly twelve feet of the premises opposite the house (the Buffer Area) will not be removed, except to remove dead and diseased material and to properly prune and maintain the landscaping. In the event vegetative material is removed from the Buffer Area so as to impair the screening, the applicant will cause screening shrubbery to be planted in the affected portion of the Buffer Area along a line which is at least 10 feet from the westerly boundary of the property. In response to concerns from Board members regarding the proximity of the house to the bluff, I enclose a revised map showing the proposed house located at a distance of 45 feet from the bluff (formerly 39.7) and moved slightly westerly so that the driveway and garage under will be coming in on the east side, rather than on Mr. Lancy's side. The applicant feels that this is a better house location given the angled nature of the lot and the topography of the lot. Even though this will put the house at a lower elevation than originally proposed and move the driveway away from Mr. Lancy, we are agreeable to the two conditions set forth above. This evaluation of the property located at 19625 Soundview Ave in Southold was conducted on May 9. No limitations were found. The bluff itself was found in stabile condition with dense vegetative cover, including small trees, shrubs and vines. The upper bulkhead was found in sound condition while the lower bulkhead at the tow of the bluff appeared to be in tact from our vantage point, though there was no access to the beach itself. The general topography of the property is sloping away from the bluff face and the land itself is entirely vegetated with grasses and some landscaping. One factor of concern is the placement of the well. The well is situated down slope of the septic system, as per the survey plan, although we were not actually able to locate the well on site. It is generally desirable to locate a well for potable water upslope of a septic system, though by reading the Suffolk County Department of Health Services Water Table Contours map it appears as though groundwater is flowing towards the Sound. Proper placement of the well would depend upon the actual groundwater hydrology. A possible solution would be to install an alternative septic system, which will ensure proper treatment of the wastewater before it reaches groundwater and/or the well. The Suffolk County Health Department is the governing agency in this matter and should be able to offer assistance. Overall, the property was found to be suitable for its current proposal. The bluff appears to be stabile and the hazard of erosion is slight.
