SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicants' property is an 15,682 sq. ft. parcel
with frontage along Hilltop Path, a 20' wide right-of-way, which extends off the easterly
side of Horton's Lane in Southold. The property is improved with a one-story frame
house as shown on the survey prepared 11-16-2000 by John C. Ehlers, L.S.
BASIS OF APPLICATION: Building Department's January 22, 2003 Notice of
Disapproval, amended June 25, 2003, citing Sections 100-244, 100-30A.4, and 100-33,
in its denial of a building permit to construct 635+- sq. ft. of additions to existing dwelling
at less than 35 feet from the front lot line, and to locate an accessory carport in a yard
other than the Code required rear yard. The pool which was proposed in the original
building permit application to the Building Department and addressed in the January 22,
2003 Notice of Disapproval, was not included in applicants' appeal for variances.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 24, 2003,
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct additions as
shown on the survey map dated 11-16-2000, amended 01-15-2003, prepared by John
C. Ehlers, L.S. and shown on the site plan prepared for the applicants dated 6-21-2003,
with a ZBA date stamped of June 26, 2003. The additions are shown at the south and
east sides of the existing dwelling, with a setback proposed of 34'3" at its closest point to
the southwest (front) property line, and of 28'2" at its closest point to the southeast
(front) property line. The height from the existing grade is proposed at 23'5" to the top
(ridge) as shown on the 6-21-2003 east elevation sketch, and for additional roof line
details are shown on similar sketches prepared 6-11-03 (west elevation), 6-21-03 (east
and south elevations),. 6-25-03 (north elevation).

Also requested is a proposed 18'x24' accessory carport in the yard northwest of the
existing dwelling. The carport is proposed at 9.4' from the closest property line
(northwest), and at least 60 feet from the front lot line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character
of the neighborhood or a detriment to nearby properties. Hilltop Path is a right-of-way
that serves as the applicant's driveway, and is a grassy, lawn buffer between the
property and adjacent wooded lots. Hilltop Path provides access not only to this lot but
to two other parcels, CTM 54-1-21 of similar size, and CTM 54-1-16 consisting of 3.5+-
acres. The 3.5+- nearby parcel may also be accessed from Sunset Path, another
adjacent private right-of-way, which combines with Hilltop Path, as access for the
surrounding neighborhood directly to North Sea Drive, a town street. The opposite side
of the premises has a steep slope which limits the options to build. The adjacent

the applicant to pursue, other than an area variance. The available area to build is very
limited, due to the present location of the home (for more than 40 years), steep slope of
the land, and the fact that the property has two front yards, both adjacent to Hilltop Path,
a private 20-ft. wide private right-of-way.
3. A) The relief granted is not substantial. The code requirement is 35 feet, and the
applicants' request is for a reduction of a small section at the southeast corner section of
the addition, for a 7 ft. setback reduction; a small section at the southwest corner of the
addition will be for a setback reduction of 9 inches.
B) The relief granted with respect to the location of the carport is not substantial.
The location requested will give the appearance of a carport addition at the north side of
the house. The applicant will also be removing the as-built shed.
4. The difficulty was self-created when a carport and additions were designed without
conformity to the current Town Code requirements.
5. There is no evidence that the grant of the variances will have an adverse effect or
impact on physical or environmental conditions in the neighborhood or district. The
applicants will retain all excavated soil on the site and re-grade the landscape for the
new construction area to prevent erosion, containing all runoff within the property
boundaries.

6. Grant of the variances are the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a detached carport and additions to the dwelling, while
preserving and protecting the character of the neighborhood and the health, safety and
welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Member Oliva, and duly carried, to
GRANT the variances as applied for, and as shown on the survey map dated 11-
16-2000, amended 01-15-2003, prepared by John C. Ehlers, L.S. and shown on
the site plan prepared for the applicants dated 6-21-2003, with a ZBA date
stamped of June 26, 2003, and 6-21-2003 east elevation sketch, 6-11-03 (west

The proposed additions and alterations, on this non-conforming 15,682 square foot parcel with two
front yards in the Residential R-40 District, are not permitted pursuant to Article XXVk Section 100-
244,which states that non-conforming lots, measuring less than 20,000 s �et in total size, require
a minimum front yard setback of 35 feet. Plans note a proposed setbac of 33.7f et on one street and
28.3 from another.
In addition, the proposed accessory carport is not permitted pursuant to Article IIIA Section 100-
30A.4, which states;
"Accessory buildings and structures or other accessory uses shall be subject to the same
requirements as 100-33 of the Agricultural Conservation District,"which states;
"In the Agricultural-Conservation District and Low-Density Residential R-80,R-120,R-200,
and R-400 Districts, accessory buildings and structures or other accessory uses shall be located
in the required rear yard."
The proposed accessory carport is noted as being located in the side yard.
Total lot coverage, including all existing, will be 13 percent.
This Notice of Disapproval was amended on January 22,2003, to reflect a new survey submitted
by the applicant. This Notice of Disapproval was further amended on June 25,2003, after the
applicant decided to remove a proposed in-ground swimming pool from the plan, as well as
remove an existing"as built" shed from the property.

Enclosed please find the original and six (6) copies of the above referenced application
including the following:
1. Notice of disapproval dated 10/25/2002 and amended 1/22,2003, with copy of
building permit attached;
2. Application for area variance;
3. Building plans prepared by Kennedy-Grant Architecture Interior Design & Planning
dated 12/16/2002;
4. Survey of above referenced premises prepared by John Ehlers Land Surveyor dated
1/15/2003 with existing structures, proposed additions, dimensions and setbacks; and
5. $600.00 check for filing fee payable to the Southold Town Clerk.
As soon as the weather improves, my clients will submit some excellent photos of the
flagged construction areas and surrounding premises.
Finally, my clients are working with their architect to eliminate the need for pre-existing
nonconforming shed that is presently located in the front yard. If the proposed new
construction can include a storage area in the basement mechanical room, then my clients
will not require a variance for the shed. We will obtain an amended notice of disapproval
if necessary, well in advance of the ZBA hearing for this project.
