Hi Mr.Goldsmith,
Thanks for getting back to me about applying for a new wetland permit to replace the parts of the dock that were removed, I'll get a
permit expeditor prepare an application for me.
I understand that the current landward deck,that was incorporated into my current wetland permit in 2017,would not be permitted
anymore,so I want to make sure that the current wetland permit stays in place for that section.

Mr. Todebush,
After consulting with legal, since the ramp and float are no longer present (i.e. functioning), they cannot be
replaced without first obtaining a new wetland permit.
Since the existing fixed section is a functioning, permitted structure, you are allowed to repair up to 25% a
year. However, since you will need to apply for a new permit anyway for a potential new ramp and float, you
may want to incorporate any modifications to the existing fixed section in that permit application.
So under your current permits, you are allowed to repair up to 25% of the existing 50' x 4'fixed catwalk per
year. You are not allowed to reinstall any ramp, float, or pilings that are not currently in place and functioning.
If you would like to proceed with potentially installing a new ramp and float, or some other dock modification
like a longer fixed catwalk, you will need to apply for a Wetland Permit from the Trustee's office, as well as a
NYS DEC permit.
I would recommend hiring a competent permit expediter who is familiar with the process to assist you.

Hello Elizabeth and Diane,
Quick question for you, my grandmother obtained a wetland permit(#1161) on 7/12/76 to build a dock, ramp, float, and
pilings at her property at 1130 West Creek Avenue in Cutchogue. In 2017 the permit was amended to include the deck
that was also built in 1976,and transferred to my father. In 2021,the permit was transferred to me.
The ramp and floating sections were removed seasonally and haven't be installed in many years. I'm hoping to replace
many of the old boards on the existing structure and re-install the ramp and floating section.
I met the trustees at the property on 4/5/22 to confirm that the existing permits allow me to proceed with this project.
At that time, I was told they would check with the legal department,and confirm was percentage of the structure could
be replaced every year.At the site visit,we thought it was 25%? 1 followed up on 4/6/22 with a letter to the trustees
summarizing my understanding of the process, but I haven't heard back yet.
Attached are the permits I have, and the letter I sent on 4/6/22.
Can you please let me know how I can proceed?

Thank you very much for visiting my property at 1130 West Creek Avenue yesterday. As
discussed, I'd like to reinstall the ramp, float, and pilings in Wickham's Creek in front of my
property, as well as repair/replace existing decking and railings. You'd indicated that my
existing Wetland Permit#1161 allows me to do that. I've attached the existing approvals and
photos. I hope you can review to make sure my understanding is correct.
Attachment#1: Permit#1161, dated July 12, 1976, issued to my grandmother Minnie
Todebush, giving permission to place dock, ramp,float, and pilings in Wickham's Creek. The
dock remains in place,the ramp and float were removed seasonally, and the pilings were
removed when loosened by ice.
Attachment#2:Transfer of Wetland Permit ,,.,.,::.,to West Creek nf�±w,.. +„r
M.Todebush, dated December 13, 2017, and amended to include approval of the existing
12'x12' landward deck and staircase,which were part of the original 1976 construction.

I understand that I'm allowed to "repair" 25%of the structure annually, but am curious is
reinstalling the ramp,float, and pilings constitutes "repair"?The repairs I envision are existing
decking and railings, and I plan to the decking currently required allowing light to the wetlands.

To the Board of Town Trustees,
On July 12, 1976, the Board issues Wetland Permit#1161 to my grandmother, Minnie
Todebush, to build a dock, ramp, float, and pilings in Wickham's Creek, in front of our
property.
On December 13, 2017, the permit was transferred to my father, Peter Todebush, and
amended to include a 12'x12' landward deck and staircase that had been constructed
with the dock etc. in 1976. On July 14, 2021, the wetland permit was transferred to my
name as I now own the property.
Historically, the ramp and float were removed seasonally. Many years ago, ice loosened
the pilings, and the ramp and float were not reinstalled.
At this time, I'm planning to repair portions of the existing structure, and am interested in
reinstalling the ramp and float. I'm riot sure if any new approvals are required, or what
the proper procedure should be, and hope that you can meet me at the site on your next
visiting date, Tuesday April 51h, and advise me.
