The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, December 18, 2023:
WHEREAS, this agricultural site plan is for the proposed construction of a 3,125 sq. ft.
agricultural storage building and 4 hoop houses, on a 5-acre parcel in the AC Zoning
District, Southold; and
WHEREAS, on April 14, 2023, Kevin Perry, Applicant's Agent, submitted a Site Plan
Application for review; and
WHEREAS, on April 24, 2023, the Southold Town Planning Board formally accepted the
agricultural application as complete for review; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving uses strictly related to agriculture as long as they
are not necessary to further the objectives set forth in Town Code §280-129 to maintain
public health, safety, and welfare; and
WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work
session staff report on April 24, 2023, the Southold Town Planning Board agreed to
waive certain application requirements of§ 280-133 for this application which involves
uses strictly related to agriculture; and

WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 B (5), has the discretion to vary or waive the parking requirements for Site
Plan Applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the Site Plan Requirements chapter of the Town Code; and
WHEREAS, the Planning Board has found that this application is eligible for a waiver of
parking requirements because there is no need to provide for parking as the application
is for an agricultural use, and the parcel is large in size relative to the proposed
structure; and
WHEREAS, on April 24, 2023, pursuant to Southold Town Code §280-131(H), the
Southold Town Planning Board agreed to waive the requirement for a public hearing
regarding this application which involves uses strictly related to agriculture; and
WHEREAS, on April 24, 2023, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that
the proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(4),which states that the following actions are not subject to
review under this Part: "agricultural farm management practices, including construction,
maintenance and repair of farm buildings and structures, and land use changes
consistent with generally accepted principles of farming"; and
WHEREAS, on May 4, 2023, the Planning Board, pursuant to Southold Town Code
§280-131(C), distributed the application to the required agencies for their comments;
and
WHEREAS, on May 8, 2023, the Southold Town Code Enforcement officer verified that
there were no open violations on the subject parcel; and
WHEREAS, on May 24, 2023, the Southold Town Fire Marshall stated there were no
objections to the proposed site plan; and
WHEREAS, on May 31, 2023, the Southold Town Chief Building Inspector reviewed
and certified the proposed use as a permitted use in the Agricultural Conservation (AC)
Zoning District; and
WHEREAS, on June 5, 2023, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold, have been met; and
WHEREAS, on June 5, 2023, the Southold Town Planning Board determined that this
proposed action is a Type II Action under SEQRA as described above; and
WHEREAS, on June 5, 2023, the Southold Town Planning Board waived the
requirement for a public hearing and certain Site Plan Application requirements as
noted above; and

This agricultural site plan application is for the proposed construction of a 3,125 sq. ft.
agricultural storage building and 4 hoop houses, on a 5-acre parcel in the AC Zoning
District, Southold.
Existing:
5 Acres with existing agricultural buildings, farm road, and fencing. Adjoining parcel
with ±20.5 acres of active farmland with Town Development Rights.
Proposed:
• Construct a 3,125 sq. ft. agricultural storage building (26' 11" high at peak);
200 sq. ft. barn loading dock;
0 100 sq. ft. refrigerator
• Four hoop houses, totaling 6,100 sq. ft.
• Drainage: gutters and leaders, and two 8' diameter x 7' deep drywells.
* There are no proposed bathrooms or water to the storage building at this time.
Ill. Staff Update:
1. The Planning Board granted approval to the site plan on June 5, 2023.
2. The applicant applied for a building permit in November 2023 and the plans they
submitted had minor differences from the approved plans. They noted that this
was done to accommodate the system of their final fabricator, Harvest Moon.
3. On December 11, 2023 the applicant submitted a letter to the Planning Board
along with a clarification on the changes.

b. Building Section has changed. The roofline originally stepped down on
both sides but now it steps down on only one side. (Sheet A.3 is now
replaced by Sheet 10)
c. The ridge height has increased up to 28' 9", and there is a "monitor
light" section on top that has a total height of 33'. The height is
compliant with the Bulk Schedule for the AC Zoning District.
d. Building Elevations have changed to accommodate the new roof line,
and additional windows have been included. (Sheet AA is now
replaced by Sheets 2, 3, 4, & 5)
e. The compliance notes have been updated to respond to requests for
clarification by the Building Department. The proposed exterior lighting
information remains the same as the approved plans.(Sheet A.5 is now
replaced by Sheet 18)
IV. Items to Consider:
Based on the above analysis and update, it is recommended that the above
referenced site plan application be granted an amended approval by the Planning
Board at tonight's December 18, 2023, public meeting.

III. Analysis
This agricultural site plan application is for the proposed construction of a 3,125 sq. ft.
agricultural storage building and 4 hoop houses, on a 5-acre parcel in the AC Zoning
District, Southold.
1. Fxistinq
a. 5 Acres with existing agricultural buildings, farm road, and fencing. Adjoining
parcel with ±20.5 acres of active farmland with Town Development Rights.
2. Proposed:.
a. Construct a 3,125 sq. ft. agricultural storage building (26' 11" high at peak);
b. 200 sq. ft. barn loading dock;
c. 100 sq. ft. refrigerator
d. Four hoop houses, totaling 6,100 sq. ft.
e. Drainage: gutters and leaders, and two 8' diameter x 7' deep drywells.
Staff:
This parcel is covered with Prime Agricultural Soils, including: Haven loam and
Riverhead sandy loam. These are well-draining soils with very low to medium
potential for surface runoff. The parcel is active farmland, with an adjoining ±20.5
acres of farmland. As such, the proposed gutters, leaders, and drywelis will
ensure that no stormwater will leave the site as a result of this building.
3. Bulk Schedule/Code Requirements 'AC Zoning District
a. Lot Coverage: Maximum: 20%
b. Proposed: 4.4%

c. Parking:
i. Storage building: 1 per 1000 sf of gross floor area
ii. 3125 - 1000 = 3.125 or 4 stalls required
Staff: No parking stalls proposed. As an agricultural application with low lot
coverage, and room for parking of the vehicles for farm employees, this
parking requirement may be waived (§ 280-133 C).
d. Setbacks for the proposed building (AC): All sufficient.
4. Exterior Lighting:
Four (4) exterior light fixtures are noted on Sheet A.2 Building Plans, and can be
seen on the Sheet AA Building Elevations. Lumens per lamp and a footcandle
diagram are shown on Sheet A.5 Compliance Notes. The photometric plan
depicts a footcandle diagram.
Staff: Details on the submitted cut sheet and email from applicant include: type
of fixture, lumens per lamp, mounting height, color temperature, location, and
orientation. Submitted specifications meet Town Code Chapter 172
requirements.
5. State Environmental Quality Review Act SEQRA :
The proposed action is a Type 11 Action as it falls within the following description
of 6 CRR-NY 617.5 (c)(4), which states that the following actions are not subject
to review under this Part: "agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land
use changes consistent with generally accepted principles of farming".
6. Alignment with Town Code and Comprehensive Plan:
§ 280-97 Right to farm.
(A) The Town Board of the Town of Southold finds that farming is an essential
activity within the Town of Southold. Farmers provide fresh food, clean air, economic
diversity and aesthetic open spaces to all the citizens of our Town. In addition, land
in agricultural uses requires less tax dollars for services than does land with
residential or commercial development. Accordingly, farmers shall have the right to
farm in Southold without undue interference from adjacent landowners or users. For
the purpose of reducing future conflicts between people residing on tracts adjacent
to farmlands and farmers, it is necessary to establish and give notice of the nature of
the farming activities to future neighbors of farmland and farming activities.
(B) Agricultural activities conducted on farmland, undertaken in compliance with
applicable federal, state, county and Town laws, rules and regulations, are

presumed to be good agricultural practices and presumed not to adversely affect the
public health safety and welfare. We find that whatever nuisance may be caused to
others by such uses and activities, so conducted, is more than offset by the benefits
from farming to the community. Therefore, all such activities shall be protected farm
practices within the Town of Southold.
§ 280-99 Right to undertake protected farm practices.
(A) Farmers shall have the right to undertake protected farm practices in the active
pursuit of agricultural operations, including, but not limited to: clearing; grading;
plowing; aerial and ground spraying; the use of legal agricultural chemicals
(including herbicides, pesticides and fertilizers); raising horses, poultry, small
livestock and cattle; processing and marketing produce; installing water and soil
conservation facilities; utilizing farm crop protection devices; designing and
constructing and using farm structures, including barns, stables, paddocks, fences,
greenhouses and pump houses; using water; pumping; spraying; pruning and
harvesting; disposing of organic wastes on the farm; extensive use of farm laborers;
training and others in the use and care of farm equipment, animals; traveling local
roads in properly marked vehicles; and providing local farm produce markets near
farming areas.
(B) These activities can and do generate dust, smoke, noise, vibration and odor.
These activities may occur on holidays, Sundays and weekends, at night and in the
day. Such activities are presumed to be reasonable. Such activities do not constitute
a nuisance unless the activity has a substantial adverse effect on the public health,
safety and welfare.
Chapter 9 Southold Town Comprehensive Plan
The Southold Town Comprehensive Plan contains an entire chapter dedicated to
agriculture, and it states, "Agriculture and related businesses are in the top five
economic engines of our economy." The first goal of Chapter 9 is to "Retain and
Advance the Industry of Agriculture." This proposed agricultural storage building
meets the goal of retaining and advancing the industry of agriculture by providing
needed storage infrastructure for the active vineyard on site.
IV. Staff Update:
1. After internal scoping and review, the following expedited process was agreed
upon for this agricultural storage building:
a. The applicant has confirmed their plans for dealing with drainage on
site as noted under proposed construction.
b. As this is a Type II Action, there is no required SEQRA coordination.
c. After consultation with the LWRP Coordinator, this application is
exempt from LWRP review.

d. There are no proposed bathrooms or water to the storage building at
this time, so no referrals were necessary to SCWA or SCDHS.
e. Due to small size of proposed project and parcel location, the Suffolk
County Planning Commission would consider this a matter for local
determination.
f. The project was reviewed by Code Enforcement and the Town Fire
Marshal, and no concerns were raised.
V. Items to Consider:
Based on the above analysis and update, all site plan requirements listed in §280-
133 of the Town Code have been met or have been recommended to be waived,
and it is recommended that the above referenced site plan application be
scheduled for determination by the Planning Board at tonight's June 5, 2023,
public meeting.

IV: Analysis
This agricultural site plan application is for the proposed construction of a 3,125 sq. ft.
agricultural storage building and 4 hoop houses, on a 5-acre parcel in the AC Zoning
District, Southold.
1. Existing
a. 5 Acres with existing agricultural buildings, farm road, and fencing. Adjoining
parcel with ±20.5 acres of active farmland with Town Development Rights.
2. Posed:
a. Construct a 3,125 sq. ft. agricultural storage building (26' 11" high at peak);
b. 200 sq. ft. barn loading dock;
c. 100 sq. ft. refrigerator
d. Four hoop houses, totaling 6,100 sq. ft.
e. Drainage: gutters and leaders, and two 8' diameter x 7' deep drywells.
Staff:
This parcel is covered with Prime Agricultural Soils, including: Haven loam and
Riverhead sandy loam. These are well-draining soils with very low to medium
potential for surface runoff. The parcel is active farmland, with an adjoining ±20.5
acres of farmland. As such, the proposed gutters, leaders, and drywells should
provide adequate drainage for the site.

3. Bulk Schedule/Code Re uirements AC Zoning District):
a. Lot Coverage: Maximum: 20%
b. Proposed: 4.4%
c. Parking:
i. Storage building: 1 per 1000 sf of gross floor area
ii. 1200 _ 1000 = 1.2 or 2 stalls required
Staff: No parking stalls proposed. This agricultural storage barn is for farm
equipment, tools, and supplies. There will be no public access as proposed.
As an agricultural application with very low lot coverage, and room for parking
of the vehicles for farm employees, this parking requirement may be waived
(§ 280-133 C).
d. Setbacks for the proposed building (AC): All sufficient.
4. Exterior Lighting:
Four (4) exterior light fixtures are noted on Sheet A.2 Building Plans, and can be
seen on the Sheet AA Building Elevations. Lumens per lamp and a footcandle
diagram are shown on Sheet A.5 Compliance Notes. The photometric plan
depicts a footcandle diagram.
Details on the submitted cut sheet and note from applicant include: type of
fixture, lumens per lamp, mounting height, color temperature, location, and
orientation.
5. State Environmental Quality Review Act SEQRA :
The proposed action is a Type II Action as it falls within the following description
of 6 CRR-NY 617.5 (c)(4), which states that the following actions are not subject
to review under this Part: "agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land
use changes consistent with generally accepted principles of farming".
6. Alignment with Town Code and Comprehensive Plan:
§ 280-97 Right to farm.
(A) The Town Board of the Town of Southold finds that farming is an essential
activity within the Town of Southold. Farmers provide fresh food, clean air, economic
diversity and aesthetic open spaces to all the citizens of our Town. In addition, land
in agricultural uses requires less tax dollars for services than does land with
residential or commercial development. Accordingly, farmers shall have the right to
farm in Southold without undue interference from adjacent landowners or users. For
the purpose of reducing future conflicts between people residing on tracts adjacent

to farmlands and farmers, it is necessary to establish and give notice of the nature of
the farming activities to future neighbors of farmland and farming activities.
(B) Agricultural activities conducted on farmland, undertaken in compliance with
applicable federal, state, county and Town laws, rules and regulations, are
presumed to be good agricultural practices and presumed not to adversely affect the
public health safety and welfare. We find that whatever nuisance may be caused to
others by such uses and activities, so conducted, is more than offset by the benefits
from farming to the community. Therefore, all such activities shall be protected farm
practices within the Town of Southold.
§ 280-99 Right to undertake protected farm practices.
(A) Farmers shall have the right to undertake protected farm practices in the active
pursuit of agricultural operations, including, but not limited to: clearing; grading;
plowing; aerial and ground spraying; the use of legal agricultural chemicals
(including herbicides, pesticides and fertilizers); raising horses, poultry, small
livestock and cattle; processing and marketing produce; installing water and soil
conservation facilities; utilizing farm crop protection devices; designing and
constructing and using farm structures, including barns, stables, paddocks, fences,
greenhouses and pump houses; using water; pumping; spraying; pruning and
harvesting; disposing of organic wastes on the farm; extensive use of farm laborers;
training and others in the use and care of farm equipment, animals; traveling local
roads in properly marked vehicles; and providing local farm produce markets near
farming areas.
(B) These activities can and do generate dust, smoke, noise, vibration and odor.
These activities may occur on holidays, Sundays and weekends, at night and in the
day. Such activities are presumed to be reasonable. Such activities do not constitute
a nuisance unless the activity has a substantial adverse effect on the public health,
safety and welfare.
Chapter 9 Southold Town Comprehensive Plan
The Southold Town Comprehensive Plan contains an entire chapter dedicated to
agriculture, and it states, "Agriculture and related businesses are in the top five
economic engines of our economy." The first goal of Chapter 9 is to "Retain and
Advance the Industry of Agriculture." This proposed agricultural storage building
meets the goal of retaining and advancing the industry of agriculture by providing
needed storage infrastructure for the active vineyard on site.
V: Items to consider:
1. Accept the application as complete for review to begin the process as specified
below; in addition, consider the following:

Staff: This building will be used only to store farm equipment and related
supplies from the farm and will not open to the public.

subject parcel and include key elements of those existing sites (e.g.,
buildings, curb cuts, parking area(s), landscaping, etc.).
iv. Existing zoning, including zone lines and dimensions.
v. Existing contours with intervals of two feet or less, referred to mean sea
level as per United States Geological Survey datum.
vi. Existing paved areas, including parking areas, sidewalks and vehicular
access between the site and public streets.
vii. The locations, dimensions, grades and flow directions of any existing
culverts, waterlines or sewage disposal systems, as well as other
underground and aboveground utility poles and utility lines within and
adjacent to the property.
viii. The location and details of aprons, curbs, sidewalks, fencing (type and
location), and grading, including existing and proposed topography with
two-foot contours (on site and 200 feet beyond the property line) and spot
elevations for buildings and all structures, drainage calculations, details of
drainage structures and watershed areas, where applicable.

Thank you for reviewing our Barn Proposal.
Through our related partnership,the North Fork Flower Farm,we grow and sell cut
flowers and herbs to designers, markets,wholesalers, and the public as bunches or
finished floral pieces. Our design practice guides our planting; we pride ourselves on
the variety of our offerings and the constant introduction of new species, varieties, and
colors.
We started our farm on leased land and barn in Orient in spring of 2016. The market
received us warmly and our business grew. We lost our lease, in 2021, and began a
search for suitable agricultural land. We looked at every available parcel between Orient
and Riverhead and fortunately were able to purchase these 25.5 acres in Southold
Hamlet.
We moved onto the parcel beginning in fall of 2021. We brought in electrical power,
constructed a well with underground distribution for irrigation, re-graded the road,
enclosed 17 acres with deer fence, established and tilled beds, enriched the soil with
compost, and transplanted over an acre of perennials from our old farm.
Farming ornamental cut flowers has a long tradition on the East End. The climate and
soil are conducive to growing flowers and the community is increasingly appreciative of
fresh locally grown product. The North Fork,with its inventory of preserved land, must
expand our ag markets and nurture a variety of agricultural pursuits.
