LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: April 13, 2023 Re LWRP Coastal Consistency Review for DOMELUCA, LLC SCTM# 1000-23-1-2.10 Inter-Science Research Associates, Inc. on behalf of DOMELUCA II, LLC requests a Wetland Permit to construct a sod face revetment with a 2'9" maximum height and 150 linear feet long at proposed concrete bench, natural turf reinstatement, horticultural soil and upturned natural turf; construct a concrete bench with an effective height of 1'3" and 15' in length at proposed sod face revetment with a 2'0" foot rest, and 4'0"smooth surface customized concrete seating; and a proposed 4' wide gravel path that meanders through the property. Located: 14895 Route 25, East Marion. SCTM# 1000-23-1-2.10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, I recommend that the proposal is INCONSISTENT with LWRP Policy 6 and with the LWRP. 1. No grading or filling should occur within the 100' wetland and bank setbacks. 2. The proposed Deer fencing at the wetland boundary (Flags) and top of bluff zone buffer adversely impact the beneficial use of the upland/wetland ecotone by wildlife who depend on the adjacent habitat for food and cover. 3. Deer fence within a non-disturbance buffer is disturbance and contrary to the function and values that the buffer is expected to deliver. 4. It is recommended that the Deer fence be moved to the 100' setback line or denied. Deer fencing and grading should be added to the description. The grading should be carefully assessed. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: Honorable Lori Hulse, Attorney John G. Stein,Chairperson , Town Hall,53095 Main Rd. Lauren Standish,Secretary P.O.Box 1179 Southold,NY 11971 Telephone(631)765-1889 Fax(631)765-1823 Conservation Advisory Council Town of Southold At the meeting of the Southold Town Conservation Advisory Council held on Wed., April 5, 2023, the following recommendation was made: Moved by Carol Brown, seconded by Inga Van Eysden, it was RESOLVED to SUPPORT the application of DOMELUCA, LLC for revetment walls and concrete bench as per site plans and details provided by Stimson, Landscape Architects, Located: 14895 Route 25, East Marion. SCTM#23-1-2.10 Inspected by: Carol Brown, Inga Van Eysden The CAC Supports the application with non-toxic materials that do not degrade over time. Box 1179 Southold,New York 11971 Southold Town Board of Trustees Re: Domeluca II,LLC Dear Mr. Goldsmith: r Per the advice of Elizabeth Cantrell, the following project description is provided to more fully delineate what is proposed on the Site Plan for Domeluca II LLC: 1. Proposed Deer Fencing. The proposed deer fencing, shown on the Site Plan drawn by Stimson Landscape Architect, was approved by the town in the permitting for this property. 2. Proposed Gravel Path. The proposed gravel path is 4 foot wide and meanders throughout the property. It appears to be wholly above the wetlands setback. The path does appear to be within the 100 foot bluff setback and does require a permit.. 3. Existing Driveway to be Modified. An alternate layout is proposed. The portions of the driveway that are within the wetlands setback, however, remain as approved by the town in the permitting for this property. 4. Areas to be Seeded. The area of disturbance to be seeded with native coastal grass seed mix was approved by the town in the permitting for this property. It is duly noted that the town approval for the proposed deer fencing, the existing driveway to be modified and areas to-be seeded were approved in the prior Wetlands/Coastal Erosion Management Permits issued by Southold Town Board of Town Trustees. It does appear that the proposed gravel path is within the 100 foot bluff setback and therefore does require a new approval. This path connects the Domehica II LLC parcel with Domeluca LLC to the east. i 4 PROVIDING ENVIRONMENTAL PLANNING.DESIGN& REGULATORY PERMITTING SERVICES E 1 i' i i t i 1 ' I I i Should you have any questions on this project or the property in general, please do not hesitate to contact this office.
