That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. SCTM# 1000-132-1-30 Dear Ms. Lauth: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 19, 2023 regarding the above matter: WHEREAS, P.W. Grosser Consulting Engineer & Hydrogeologist, P.C., on behalf of U.S. DEPT OF HOMELAND SECURITY PLUM ISLAND ANIMAL DISEASE CENTER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated March 1, 2023, and WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 19, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of U.S. DEPT OF HOMELAND SECURITY PLUM ISLAND ANIMAL DISEASE CENTER for a Ten (10) Year Maintenance Dredge Permit for the Plum Island Harbor; the dredging is needed to allow the continued use of the harbor for passenger and freight ferries essential to the operation of the facility; spoils are proposed for use as beach/dune re-nourishment and placed directly on the shoreline south of the harbor to the location known as Pine Point, as was done with the maintenance dredging performed under NYSDEC Permit#1- 4738-01145/00012; an estimated yearly maintenance dredge would generate up to 4,400 cubic yards of spoils; and as depicted on the site plan prepared by Charles J. The total volume of dredged material (approximately 4,400 CY) would be placed above the plane of Spring High Water over an approximately 12,490 square yards (approximately 112,410 square feet or 2.58 acres)at Pine Point Beach with return flow to the waterway.Alternatively,the permittee would place dredged material at two upland diked area for placement.A 100-foot wide by 450-foot- long diked area would be located west of the dredge area and an approximately 80 to 240-foot- wide by 340-foot-long diked area would be located east of the dredge area. Material would be stored and dewatered with return flow to the waterway through a return flow pipe prior to disposal at an approved upland location. The permittees shall contact First Coast Guard District Private Aids to Navigation (PATON) Officer at (617) 223-8347 if any privately owned buoys need to be disestablished or moved. i L. The permittee shall ensure that the dredged material deposited on the shoreline is consistent with the existing, naturally-occurring grain size present at the placement area. i � M. The permittee shall ensure that the authorized beach placement area is finished to the same slope as the surrounding beach. The area shall be graded at a gentle uniform slope with no piles, ridges or holes left in the final graded beach placement materials. N. To protect ESA-listed species at the beach placement areas, the permittee shall not place dredged material on any beach from April 1 to September 1 of any calendar year. O. For dredging and/or placement of material occurring between September 1 and November 30 of any calendar year. Not more than seven (7) days prior to the commencement of dredging or beach placement activities, the permittee shall conduct and provide a Red Knot survey by a qualified biologist. In the event that Red Knot are observed within this period, prior to the start of work, or while work is being performed, the permittee shall maintain a 300 meter buffer surrounding the location of the Red Knot and notify the U.S. Army Corps of Engineers, Regulatory Branch, Eastern Section, at 917-790-8511 and the U.S. Fish & Wildlife Service (USFWS), Long Island Field Office (Region 5) at (631) 286- 0485 for further consultation and instructions. The surveys shall be conducted in the following manner: Inclement Weather: The permittee shall not conduct surveys in weather with strong winds (>24 mph), heavy fog (<200 m visibility), or steady rain. SURVEY PROTOCOL AND DATA COLLECTION: The permittee shall begin each survey of each area by indicating the start time. The permittee shall count and identify Red Knot (and other species) in the survey area. This includes birds that enter or leave the survey area during the survey. For shorebirds to be considered "using" the survey area, the birds need to be on the ground within the defined survey area for at least part of the time it takes to do the survey. Shorebirds that fly over the survey area but do not land in it should NOT be counted. The permittee shall record numbers as the survey is continued. The permittee shall complete surveys within the optimal 3-hour survey window around peak high tide. Once the area has been 1 thoroughly searched and all birds seen have been recorded, the count is considered complete. At that point, the permittee shall note the end time on the datasheet. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 4. Prohibition Period for Fish, Shellfish, Birds To protect spawning finfish, shellfish and nesting shorebirds, including threatened and/or endangered species, no regulated activities may occur between April 1 and September 30, inclusive, of any calendar year. s. Dredge Overcut There shall be a maximum of 2 foot overcut during dredge operation. 6. Grade Channel Side Slopes All side slopes of the dredge channel will have a maximum of 1:3 slope. i 7. No Equipment Below Mean Low Water Equipment operation below(seaward)mean low water is strictly prohibited. 8. Dredged Materials Above MLW All material shall be placed landward of mean low water ML 9. Dredge Material Discharge Pipe The dredge material discharge pipe shall be located within the dyked area but landward of mean high water and positioned to prevent damage to the dune face. If any scarping or scouring of the dune becomes evident as a result of the authorized activity, the dredging operation shall cease immediately until the situation is corrected and the office of Marine Habitat Protection has been notified. 10. Diffuser for Discharge Pipe The dredged material discharge pipe shall have a diffuser attached to - end of pipe. 11. Dredged Materials on the Beach All material deposited on the beach shall be of compatible (equal to or slightly larger) grain size to the naturally occurring beach. If at any time during the dredging operation the composition of the dredged material changes and becomes unsuitable for beach placement, dredging operations shall cease immediately and the office of Marine Habitat Protection shall be contacted with a proposed plan to correct the problem and/or for alternative placement. No further activity shall commence without DEC approval. 12. Erosion Control, As Needed Erosion control must be used, as needed, to prevent sediment from entering freshwater wetlands or any portion of the 100-foot adjacent area that is naturally vegetated.No sediment may enter freshwater wetlands or naturally vegetated adjacent area as a result of this project. 13. No Dredge Spoil Near Freshwater Wetlands No dredge spoil shall be stockpiled within 100 feet of any regulated freshwater wetlands. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 16. No Interference With Navigation There shall be no unreasonable interference with navigation by the work herein authorized. WATER QUALITY CERTIFICATION SPECIFIC CONDITIONS 1. Water Quality Certification The authorized project, as conditioned pursuant to the Certificate, complies with Section 301, 302, 303, 306, and 307 of the Federal Water Pollution Control Act, as amended and as implemented by the limitations, standards, and criteria of state statutory and regulatory requirements set forth in 6 NYCRR Section 608.9(a). The authorized project, as conditioned, will also comply with applicable New York State water quality standards, including but not limited to effluent - limitations,best usages and thermal discharge criteria, as applicable, as set forth in 6 NYCRR Parts 701, 702, 703, and 704. GENERAL CONDITIONS - Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 4. Prohibition Period for Fish, Shellfish, Birds To protect spawning finfish, shellfish and nesting shorebirds, including threatened and/or endangered species, no regulated activities may occur between April 1 and September 30, inclusive, of any calendar year. 5. Dredge Overcut There shall be a maximum of 2 foot overcut during dredge operation. 6. Grade Channel Side Slopes All side slopes of the dredge channel will have a maximum of 1:3 slope. 7. No Equipment Below Mean Low Water Equipment operation below(seaward)mean low water is strictly prohibited. 8. Dredged Materials Above MLW All material shall be placed landward of mean low water(MLW). 9. Dredge Material Discharge Pipe The dredge material discharge pipe shall be located within the dyked area but landward of mean high water and positioned to prevent damage to the dune face. If any scarping or scouring of the dune becomes evident as a result of the authorized activity,the dredging operation shall cease immediately until the situation is corrected and the office of Marine Habitat Protection has been notified. 10. Diffuser for Discharge Pipe The dredged material discharge pipe shall have a diffuser attached to end of pipe. 11. Dredged Materials on the Beach All material deposited on the beach shall be of compatible (equal to or slightly larger) grain size to the naturally occurring beach. If at any time during the dredging operation the composition of the dredged material changes and becomes unsuitable for beach placement, dredging operations shall cease immediately and the office of Marine Habitat Protection shall be contacted with a proposed plan to correct the problem and/or for alternative placement. No further activity shall commence without DEC approval. 12. Erosion Control,As Needed Erosion control must be used, as needed, to prevent sediment from entering freshwater wetlands or any portion of the 100-foot adjacent area that is naturally vegetated. No j sediment may enter freshwater wetlands or naturally vegetated adjacent area as a result of this project. 13. No Dredge Spoil Near Freshwater Wetlands No dredge spoil shall be stockpiled within 100 feet of any regulated freshwater wetlands. Water Quality Certification The authorized project, as conditioned pursuant to the Certificate, complies with Section 301, 302, 303, 306, and 307 of the Federal Water Pollution Control Act, as amended and as implemented by the limitations, standards, and criteria of state statutory and regulatory requirements set forth in 6 NYCRR Section 608.9(a). The authorized project, as conditioned, will also comply with applicable New York State water quality standards, including but not limited to effluent limitations, best usages and thermal discharge criteria, as applicable, as set forth in 6 NYCRR Parts 701, 702, 703, and 704. GENERAL CONDITIONS - Apply to ALL Authorized Permits: I. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department)to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department.
