The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, April 17, 2024:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Wetland Permit#10363 from Roberts Premier Development, LLC to Bailey
Investment Group II, LLC, as issued on April 19, 2023, and
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE
the Administrative Amendment to Wetland Permit#10363 for the as-built 1,079sq.ft.
pool patio around the existing, permitted pool; and for the as-built relocation of the pool
enclosure fencing that encroaches onto the neighbor of 800 Glenn Road; and as
depicted on the site plan prepared by Peconic Surveyors, last revised on March 25,
2024.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

TERMS AND CONDITIONS

The Permittee Roberts Premier Development LLC residing at 910 Glenn Road Southold, New
York as part of the consideration for the issuance of the Permit does understand and prescribe to
the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to.complete the work involved,but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Roberts:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 19, 2023, regarding the above matter:
WHEREAS, ROBERTS PREMIER DEVELOPMENT, LLC applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated March 2, 2023, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
April 19, 2023, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE-IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of ROBERTS PREMIER
DEVELOPMENT, LLC to construct a 16'x32' in-ground swimming pool with 1' wide coping;
install code compliant pool enclosure fencing with gates; install a pool equipment area; and to
install a drywell for pool backwash; with the condition to establish and perpetually maintain a 15'
non-turf buffer landward of the non-disturbance buffer; and as depicted on the survey prepared
by Peconic Surveyors, P.C., last dated April 13, 2023, and stamped approved on April 19, 2023.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at'a fee of$50.00 per inspection. (See attached schedule.)

Greetings,
I wish to express my opposition to the proposed swimming pool construction at 910 Glenn Road
Southold, NY for the following reasons:
1. All in ground pools will eventually leak and introduce chlorine into the potable ground water and
since the creek is downstream from this pool it will also introduce chlorine into the creek as well.
2. Any backwashing of the pool filter will also introduce chlorine into the potable ground water and the
creek since there is no municipal sewer service at this location.
3. Potential lighting issues that violate the town outdoor lighting code.
4. Noise code that the town government is mostly unwilling to enforce.
Lastly this reason is probably not in your purview but should be mentioned is lewd behaviors in the
middle of the day. I have witnessed these many times at the adjacent property which also has an
inground pool facing the creek and my property.
And both properties are in my line of sight.

My wife Maria Villa and I Fernando Villa, owners of the property located at 15 Sun Lane,Southold, NY are in receipt of
the attached letter and plan from Roberts Premier Development regarding the construction of a proposed swimming
pool at the adjacent property located at 910 Glenn Road.

As part of the public comment for the environmental review we want to express our opposition and environmental
concerns to the proposed swimming pool.
The 910 Glenn Road property has been an incredible environmental sanctuary over the years.
Since we bought our property across the creek in 2019, we have witnessed the richness of wild life and diversity that the
existing trees and vegetation provided to the fragile ecosystem and wetlands adjacent to the creek.
In addition to multiple birds that nested in the existing trees,year round multiple birds had their habitat there, along
their creek's edge has been a seasonal population of near extinct terrapin green turtles,wild turkeys, ducks,swans,
herons, ospreys, cormorants,geese, bufflehead, sea tucks, etc.
It is sad to see that with the construction of the new house by the current developer there is a clear threat to these
conditions.
80%of the trees are gone and a big house out of context is replacing what it was a safe environmental heaven.
The removal of native vegetation,ground cover and trees will affect storm water and could cause erosion on the
wetlands adjacent to the creek.
We respectfully ask the Trustees to monitor the restriction included and approved by the Trustees as outlined on their
site plan on permit#10212 dated September 14 2022.
We want to make sure This developer complies with the 25 feet non disturbance non turf buffer along the tidal
wetlands of west creek.
The DEC permit#1-4738-02199/00009 clearly states on article 13 & 14 No disturbance to the natural vegetation or
topography greater than 25 feet seaward.
We want to express also the concern that in-ground pools can potentially affect the groundwater and since the creek is
downstream there could be chlorine contamination into the creek.
We also feel that the proposed pool will be affecting the tranquility,well being and peace of our neighborhood. Noise
and light pollution are a concern that several neighbors share. G r it

1. All applicants for permits* including Town of Southold agencies, shall complete-this CCAF for
proposed actions that are'subject to the Town of Southold Waterfroimt Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt

Waterfront, Revitalization. Program. A proposed action: will be evaluated as to its significant
