A meeting of the Southold Town Conservation Advisory Council was held Wed., March 8,
2023 in the Town Hall Conference Room and via Zoom.

CALL TO ORDER
John Stein called the meeting to order at 4:30PM.
REPORTS
Caroline Burghardt attended the Board of Trustees meeting held on Wed., February 15th
and reported the meeting was business as usual.
CLIMATE SMART COMMUNITIES
NEW BUSINESS
John Stein listened to the public hearing on February 28th regarding the MKS Realty,
Coastal Erosion Hazard Appeal. The Town Board held the public hearing open for two

weeks for written comment. Councilman Mealy encouraged the CAC to send written
comments to the Town Board. As chairperson, John will reaffirm the CAC's position.
John Stein suggested that Carol Brown and Maggie Merrill attend the next Town Board
meeting scheduled for Tues., March 14th as citizens, regarding the proposed Amendments
to Ch. 275 and Ch. 96.
APPROVAL OF MINUTES

8, 2023.
RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT
APPLICATIONS
Moved by John Stein, seconded by Maggie Merrill, it was
RESOLVED to SUPPORT the application of BROWNS HILLS ESTATES, INC. to
construct 186' community stairs to beach consisting of 4'X 6' platforms with last set of
aluminum retractable stairs. Elevation of stairs to be at least 3' above grade. Supports
posts and support materials to be constructed with treated lumber, all stair treads,
benches and railings to use untreated lumber. Project to include benches located on
platforms, handrails plus two fall protection railings on each side, an access gate at the
top of stairs plus an access gate at the lower platform. Project includes the removal of
existing stairs located at the immediate east of new stairs, to include revegetation of
disturbed areas on the bluff.

RESOLVED to SUPPORT the application of NANCY COLLINS to replace existing failing
bulkhead and return in place with a total of approx. 144'-of vinyl sheathing bulkhead; one
6'X 8' cantilevered platform, north aluminum ramp 10'X 2'2" with handrails, south
aluminum ramp 10'6"X 2'3" with handrails, water and electrical connections and replace in
place 4'X 126' continuous detached non-treated walkway with 4"X4" posts. Install a 10'
non-turf buffer along entire length of bulkhead. Reclamation dredging to a maximum of 4'
depth at mean low water along entire length of bulkhead to extend to a maximum of 10' off
bulkhead resulting in approx. 10 cy. of material to be placed behind bulkhead.

a 6' high fence and gate for the proposed trash enclosure (260 sf.) and refurbish existing
8'X 12' shed with new roof, fascia, siding, and removal of window and replacement of
doors.

and gate. Total enclosure 210 sf. Purpose of the concrete pad and fence enclosure is to
place a refrigerator/freezer unit for the motel. Legalize the "as-built" 8"X 39' concrete "L"
retaining wall (25.50 sf).

concrete walkway and deck, replace approx. 570 sf. of concrete walkway with wood
walkway, replace approx. 1192 sf. of existing wood deck and relocate 410 sf. with new
wood deck. Place approx. 37 If. of sand walk path set back 35' at closest point to MHW
line. Existing sand to remain. Planting plan in accordance with a portion of Planting
Schedule L-4.30 attributable to Lot 11 property and made part of this application. Install
(4) 10'X 4' drywells for a portion of the motel. Four (4) existing 10'X 4' drywells serving the
motel inner courtyard area with one (1) drywell and approx. 100 If. of existing drain lines.
Proposed (3) 8'X 4' drywells to serve the easterly roof area of the motel.

approx. 92 If. and walk path set back 18' at closest point to tidal wetlands line. Existing
sand to remain. Place approx. 8'X 6' sand walk path continuing from Lot 13 landward of
buffer to frame building. Planting Plan in accordance with a portion of Planting Schedule
L-4.4044.50 attributable to Lot 14 and made part of this application. Remove approx. 490
sf. of existing freshwater wetland vegetation. Construct a 180'X 10' drainage trench/stone
buffer as located on Utility Site Plan to accommodate stormwater from four (4) cottages
and garage. Install approx. 330 If. of drain lines from the four (4) cottages and garage to
the drainage trench. Install approx. 2400 sf. of additional indigenous plantings between
stone buffer and freshwater vegetation line to further protect wetland. Additional planting
area at approx. 5 to 1 greater than area removed. Restore area from stone buffer within

approx. 12,500 sf. of sand from wood bulkhead to Trustee jurisdiction line as show on a
portion of Planting Schedule L-4.50 attributable to Lot 15. Existing sand to remain. Place
approx. 1500 sf. of sod. Planting Plan in accordance with a portion of Planting Schedule
L-4.50 attributable to Lot 15 and made part of this application. Install 224 sf. of non-
permanent outdoor seating area. Remove approx. 1250 sf. of existing freshwater wetland
vegetation. Construct a 265X 10' drainage trench/stone buffer as located on Utility Site
Plan to accommodate storm water from two (2) adjacent cottages of Lot 14. Install approx.
75 If. of drain lines to serve the two adjacent cottages. Install approx. 3800 sf. of additional
indigenous plantings between stone buffer and freshwater vegetation line to further
protect wetland. Additional planting area at approx. 3 to 1 greater than area removed.
Restore area from stone buffer and within Trustee jurisdiction in accordance with a portion

RESOLVED to NOT SUPPORT the application of JOEL B. SINGER for the existing 26'X
16.1' detached garage in the front yard to be demolished. Proposed 28'X 30' 1.5 story
garage to be constructed in the front yard with a 6'X 4' outdoor shower enclosure with
gravel base and proposed pool equipment on 3'X 14' pad at grade with a 36" high fence
enclosure around pool equipment. Proposed 48" wide walkway 55' If. Proposed 18'X 45'
inground pool with 8'X 8' hot tub enclosure inside the pool and new 48" high pool fence
around the pool. Existing gravel driveway with 30" maximum driveway retaining wall to
retain existing grade of the lawn.

RESOLVED to NOT SUPPORT the application of M&R NORTH FORK PROPERTIES
INC. C/O MARK SCHILL for the construction of a 3,960 sf. two-story dwelling, covered
porch, front steps and covered rear porch with steps. Proposed generator behind
proposed garage on a 3'X 5' concrete pad. Buried 1,000 gallon propane tank installed
adjacent to the garage. Proposed I/A sanitary system installed in accordance with SCDHS
standards and all roof run-off will be directed to on-stie drywells. A 10' wide non-
disturbance planted buffer will be added along the wetlands line and a 10' wide non-turf
buffer will be added landward of the non-disturbance buffer for a total of 20' buffer along
wetlands line. Approx. 300 cy. of clean fill to be added surrounding the proposed house to
raise the grade. A silt fence will be installed surrounding the entire work limits until work is
fully stabilized.

RESOLVED to SUPPORT the application of PATRICK FLANAGAN, EVA FLANAGAN,
MORTON D. DUBIN, STEPHEN E. RAVN & DANIELLA C. RAVN to construct a 4'X 126'
fixed walkway with staircase, raised a min. of 4' above wetlands and a continuous railing
set at 3' on the landward side. The decking shall be composed of thru-flow continuous.
The first 56' of walkway to be supported with 4" square green heart pilings set at 8' OC
and cross braced. The remaining 70' of walkway to be supported with 8" dia. pilings at 8'
OC. Construct three (3) 4'X 24' fixed docks, with thru-flow decking, 8" dia. pilings and 5
step float stop aluminum dock ladders, total area of fixed walkway and docks, 792 sf.

RESOLVED to SUPPORT the application of MICHAL KATCHER & DANIEL KATCHER
to construct an in-ground swimming pool 18'X 44.5' with spa 11'X 5', construct a 120 sf.
cabana 20'X 6' with a Y2 bath an unfinished pool storage space. The cabana will be
serviced by underground electric from the house and the proposed bathroom will be
connected to the existing I/A OWTS septic system approved under SCDHS. The
proposed cabana will also have an attached outdoor shower. Run-off from the cabana,
outdoor shower and patio will drain into an 8' dia. underground leaching pool. Cabana will
have an open-air pergola on the south side that will be approx. 205 sf. Construction of a
patio that will surround the in-ground pool and is 1,136 sf. in total area of which 361 sf. is
situated within 1 00' wetland setback. Underground drainage pool for the pool backwash.
280 sf. of an existing concrete ramp/slab to be removed in the area landward of an
existing 20' non-turf buffer. Approx. 430 If. of perimeter fencing is proposed. A
combination of landscape vegetation and lawn will occupy the area landward of the non-
turf buffer and existing 20' non-turf buffer will have some areas where native vegetation
will be installed.

of existing bulkhead with vinyl bulkhead and 12 If. of vinyl bulkhead return on north side of
property and connect to adjacent bulkhead on south side of property. Remove and
replace existing dock as follows: 4'X 55' fixed dock with thru-flow decking at 15' from north
property line and elevation 4.5' @ 2.5 above MHW election. Remove and replace existing
ramp with 30'X 16' aluminum hinged ramp to 6'X 20' float secured by 2'10" OCCA piles.

RESOLVED to SUPPORT the application of SHLOMO & ALICE WEINBERG to install a
swimming pool 12'X 30', spa 12'X 8' and to modify/expand the existing seaward deck to
surround the proposed pool and spa. Applicant also proposes to install a stair assembly
along the southerly side of the proposed deck consisting of a 4'X 4' platform and 6'X 4'
stairs.

generator with screening location, and amend size of in-ground swimming pool to 20'X
30'.
