SCTM# 1000-25-3-11 RESOLUTION: WHEREAS, 1945 Village Lane, Orient,NY, is on the Town of Southold Registry of Historic Landmarks; and WHEREAS, as set forth in Chapter 170 of the Town Code (Landmarks Preservation Code) of the Town of Southold, all proposals for material change/alteration must be reviewed and granted a Certificate of Appropriateness by the Southold Town Historic Preservation Commission prior to the issuance of a Building Permit; and WHEREAS, the Commissioners made a visit to the above referenced site to inspect the proposed project, and WHEREAS, during the Public Hearing on December 8, 2022,the applicant requested permission to install solar panels on the roof of the Single Family Dwelling and the roof of the Accessory Structure/Barn; and WHEREAS, during the Public Hearing the applicant amended the application to limit the installation of the Solar Panels only to the roof of the Accessory Structure/Barn, and WHEREAS, a Certificate of Appropriateness was issued on December 8, 2022, #12.1.8.22.2, for the installation of Solar Panels only to the roof of the Accessory Structure/Barn; and Denial of a Certificate of Appropriateness, HPC,Woodard, SCTM No. 1000-25-3-11 WHEREAS, the applicant appeared, again, during Commission meetings of February 23, 2023, and March 23, 2023 to request permission to install Solar Panels to the roof of the Single-Family Dwelling, as per the applicant's amended application; and WHEREAS, the applicant's representative, Kevin Orlando of Long Island Power Solutions appeared to describe the project; and NOW THEREFORE BE IT RESOLVED,the Southold Town Historic Preservation Commission found the solar panels to be inconsistent with the historic dwelling design. The proposal is also found to be inconsistent with the Secretary of the Interior Standards solar power policies. Said policy does not recommend placing the solar panels in a highly visible location where it will negatively impact the historic building. The applicant's requested placement on the front roof because other locations on the main building nor placement on the ground were possible options. Policy also recommends that other locations should be considered, and in this case solar panels were granted, on the accessory barn. Said barn had been altered and no longer qualifies as an historic accessory building and is set back from the public right of way. BE IT FURTHER RESOLVED,that the Southold Town Historic Preservation Commission determined that the proposal as presented will have a substantial adverse effect on the aesthetic, historic and architectural significance of the Orient National Historic District, and denied the request for a Certificate of Appropriateness. A motion was made to grant the relief requested, said motion was seconded, but the motion failed to carry as five (5) members voted against the relief, and as a result the application was DENIED.
