DENIAL OF A CERTIFICATE OF APPROPRIATENESS

RESOLUTION:
WHEREAS, 1945 Village Lane, Orient,NY, is on the Town of Southold Registry of Historic
Landmarks; and
WHEREAS, as set forth in Chapter 170 of the Town Code (Landmarks Preservation Code) of
the Town of Southold, all proposals for material change/alteration must be
reviewed and granted a Certificate of Appropriateness by the Southold Town
Historic Preservation Commission prior to the issuance of a Building Permit; and
WHEREAS, the Commissioners made a visit to the above referenced site to inspect the
proposed project, and
WHEREAS, during the Public Hearing on December 8, 2022,the applicant requested
permission to install solar panels on the roof of the Single Family Dwelling and the
roof of the Accessory Structure/Barn; and
WHEREAS, during the Public Hearing the applicant amended the application to limit the
installation of the Solar Panels only to the roof of the Accessory Structure/Barn,
and
WHEREAS, a Certificate of Appropriateness was issued on December 8, 2022, #12.1.8.22.2, for
the installation of Solar Panels only to the roof of the Accessory Structure/Barn;
and
Denial of a Certificate of Appropriateness,
HPC,Woodard, SCTM No. 1000-25-3-11
WHEREAS, the applicant appeared, again, during Commission meetings of February 23, 2023,
and March 23, 2023 to request permission to install Solar Panels to the roof of the
Single-Family Dwelling, as per the applicant's amended application; and
WHEREAS, the applicant's representative, Kevin Orlando of Long Island Power Solutions
appeared to describe the project; and
NOW THEREFORE BE IT RESOLVED,the Southold Town Historic Preservation
Commission found the solar panels to be inconsistent with the historic dwelling
design. The proposal is also found to be inconsistent with the Secretary of the
Interior Standards solar power policies. Said policy does not recommend placing
the solar panels in a highly visible location where it will negatively impact the
historic building. The applicant's requested placement on the front roof because
other locations on the main building nor placement on the ground were possible
options. Policy also recommends that other locations should be considered, and in
this case solar panels were granted, on the accessory barn. Said barn had been
altered and no longer qualifies as an historic accessory building and is set back
from the public right of way.
BE IT FURTHER RESOLVED,that the Southold Town Historic Preservation Commission
determined that the proposal as presented will have a substantial adverse effect on
the aesthetic, historic and architectural significance of the Orient National Historic
District, and denied the request for a Certificate of Appropriateness.
A motion was made to grant the relief requested, said motion was seconded, but the
motion failed to carry as five (5) members voted against the relief, and as a result the
application was DENIED.

RESOLUTION:
WHEREAS, 1945 Village Lane, Orient,NY, is on the Town of Southold Registry of Historic
Landmarks; and
WHEREAS, as set forth in Chapter 170 of the Town Code(Landmarks Preservation Code)of the Town
of Southold, all proposals for material change/alteration must be reviewed and granted a
Certificate of Appropriateness by the Southold Town Historic Preservation Commission
prior to the issuance of a Building Permit;and
WHEREAS, the applicant's representative, Sue Estabrooke of Long Island Power Solutions, submitted
a proposal on October 6,2022,to install solar panels on the roof of a single family
dwelling and an accessory building/barn; and
WHEREAS, the scope of work includes the installation of 59 black on black, anti-glare, anti-
reflective panels solar panel on the roofs of the Main House and a rear yard Barn,
facing south. Each panel will be installed with individual inverters with mounting
to be adjustable and sitting three inches above the plane of the roof; and
WHEREAS, the applicant's representative presented Commissioners with Engineered Plans(Site Plans,
Elevations,Renderings)prepared by Ralph Pacifico,L.P.E., last June 17,2022; and
WHEREAS, during the Public Hearing on December 8,2022,the applicant made a request to amend
the application to limit the installation of the Solar Panels only to the roof of the
Accessory Structure/Bad
NOW THEREFORE BE IT RESOLVED,that the Southold Town Historic Preservation Commission
determines that the installation of Solar Panels upon the roof of an Accessory
StructureBam in the above referenced application meets the criteria for approval under
Section 170-8(A)of the Southold Town Code; and

BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of

public policy.For the purposes of this subdivision,an unreasonable limitation includes,but is not limited to,any
restriction on use that:

• Follow the Secretary of the Interior Standards for Solar assures the Retention of

Issue: Enhancing the energy efficiency of a historic building is important. To that
end, it is often possible to install features such as solar panels and photovoltaic
cells provided they are installed in a sensitive manner. Because these elements
must be positioned to take advantage of unobstructed sunlight, the roof of a
historic structure is an obvious location. The roofline of a historic building is often
a distinctive feature. Therefore, the installation of solar panels should conform to
guidance regarding rooftop additions, i.e. that they be minimally visible, to avoid
altering the historic character of the building. Historic buildings with a flat roof or
parapet can usually accommodate solar panels because the panels will be
hidden, while properties with a hipped or gabled roof are generally not good
candidates for a rooftop solar installation. Solar panels on historic buildings
should not be visible from the 'public right of way such as nearby streets,
sidewalks or other public spaces.
In circumstances where solar collectors are not placed on rooftops, they should
only be positioned in limited or no-visibility locations in secondary areas of the
property. Vegetation or a compatible screen may also be an option to further
reduce the impact of these features on a historic property. For some historic
buildings, it may not be possible to incorporate solar panels and meet the
Secretary of the Interior's Standards for Rehabilitation.

these solar panels as they reach end of life. Because solar panels have a
functional life of about 30 years, a sharp increase in the number of end-of-life
solar panels is expected in the next decade. We may have up to 10 million tons
of PV waste by 2030, the majority of which is expected to be generated by the
utility sector. Most of this waste currently goes to landfills despite heavy metals
present in cells that could classify them as hazardous waste (e.g., arsenic,
cadmium, lead, silver). Homeowners are mandated to cover all costs of
decommission according to New York State DEC mandates at the time of
decommissioning.

matter with the Town Attorney's Office and tentatively place your application on the agenda as a pre-
