July 2, 1904,C. H. Bateman,Engineer and Surveyor,as and by Lot No.3. Said map being filed in the Office of the Clerk of the
[1 County of Suffolk on May 23,1887 as map No.433zand more particularly bounded and described as follows:
BEGINNING at a point on the south side of Front Street distant 100.80 feet easterly when measured along southerly side of Front
Street from the corner formed by the intersection of the southerly side of Front Street with the easterly side of Eighth Street;
RUNNING THENCE North 89 degrees 33 minutes 30 seconds East 50.40 feet to a monument and land now or formerly of Richter;
THENCE South 7 degrees 06 minutes 20 seconds West along land last mentioned 126.82 feet to a monument at the southeasterly
comer of the premises herein described;
RUNNING THENCE North 89 degrees 58 minutes West and along land now or formerly of Singleton and along land now or formerly
of Goldin 50.29 feet to a point;
RUNNING THENCE North 7 degrees 04 minutes 50 seconds East and along other land of the party of the first part herein 126.39 feet
to the southerly side of Front Street and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party to the first part by deed from Rose Mary Gagen dated
December 17,1969,and recorded in the Suffolk County Clerk's Office on December 17,1969 in Liber 6676 page 280.
RESERVING HOWEVER,a legal life estate in the above-described premises with the buildings and improvements thereon erected,
in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT,exercisable as often as she
may choose,to change her remaindermen as follows:
TO or among any one or more members of a class consisting of the parry of the first part's descendants, in any degree,whether
presently living or bom hereafter,.in such proportions and amounts,without regard to equality,outright or in trust,as the party of the
first part may direct and appoint during their lifetime by a properly written and acknowledged instrument,and recorded prior to death,
making specific reference to this power of appointment. The party of the first part may not appoint themselves,their estates,their
creditors or to the creditors of their estate,under any circumstances.
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and roads abutting the above
described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the patty of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises
have been encumbered in any way whatever,except as aforesaid.
AND the parry of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first part will receive
the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.The word"partyshall be construed as if it read"parties"when ever the
sense of this indenture so requires.
