PATAKI RANDY A. DANIELS CiOV EPNOR SECRETARY OF STATE _ --------------------------------------------------------- In the Matter of the Petition of: DECISION Suzanne Egan For a Variance to the New York State PETITION NO. 2003-0103 Uniform Fire Prevention & Building Code ----------------------------------------------------------- Upon the application of Suzanne Egan, filed pursuant to 19 NYCRR 450 on February 18, 2003 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to an existing building of Al (single family) occupancy, two stories in height, of type 5 (wood frame) construction, located at 37415 Main Road, Orient, Town of Southold, Suffolk County, State of New York. The petitioner is seeking relief from 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow an existing bathroom, built on the second floor, with a horizontal ceiling height of 7 feet 111 inches, sloping down to 5 feet 2 inches, at the knee wall] FINDINGS OF FACT 1. The existing bathroom was constructed on the second floor of the building. 2. The horizontal ceiling height in the bathroom is 7 feet 111 inches, sloping down to 5 feet 2 inches 3. With the placement of the fixtures, the 5 feet 2 inch ceiling height is adequate for normal usage. 4. The petitioner has proposed to install fire and smoke detecting devices in the second floor as required by the Uniform Code. 5. The local Code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. WWW.DOS.STATE.NY.US • E-MAIL: INFOID05.5TATE.NY.US Petition No. 2003-0103 Page 2 CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a bathroom built on the second story with a ceiling height of 7 feet 11% inches, sloping down to 5 feet 2 inches at the knee wall, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner shall install fire and smoke detecting alarm devices in the second story in conformance with the Uniform Code. 2. That the building shall conform to all other applicable sections of the Uniform Code This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. The joists were originally located at 16" O.C. However, a conflict has happened with the plumbing piping and two beams. To clear the conflict, the two beams were cut and bridged to a new beam installed in the middle of the two. As a result, the beam spacing for this new beam became widened from 16" to 24" O.C.. And, as I stated above, this solution is still structurally sufficient.
