In the Matter of Ascertaining, Describing
and Recording "NORTH RILEY AVENUE" as a
Town Highway in the Town of Southold, County of
Suffolk and State of New York, a Highway used by
the Public for more than Ten Years.
ORDER ESTABLISHING
TOWN HIGHWAY BY
USER.
WHEREAS, the public for a period of more than ten years has used
the lands hereinafter described as a public highway in the Town of Southold,
Suffolk County, New York, and
WHEREAS, it is in all respects proper that such highway shall be
duly ascertained, described and entered on record as a town highway of the
said Town of Southold, and taken over by such Town and worked and kept in
repair by such Town,
NOW, THEREFORE, I, RAYMOND C. DEAN, the Town Superintendel
of Highways of the said Town of Southold, Suffolk County, New York, do
hereby ascertain, describe and enter on record as a town highway the
following, to wit:
ALL that certain tract, piece or parcel of land situate,
lying and being at Mattituck, in the Town of Southold, County
of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at the easterly terminus of the northerly line
of the proposed highway to be known as "East Legion Avenue",
said point of beginning being 832.40 feet easterly along said
northerly line from the easterly line of Bay Avenue; from said
point of beginning running f,~ve courses as follows:
(1) North 6 degrees 45 minutes 00 seconds West, 100.0
feet; thence
(2) North 83 degrees 15 minutes 00 seconds East, 50.0
feet; thence
(3) South 6 degrees 45 minutes 00 seconds East, 318.31
feet; thence
(4) South 83 degrees 15 minutes 00 seconds West, 50.0
feet; thence
(5) North 6 degrees 45 minutes 00 seconds West, 165. 38
feet to a monument at the easterly terminus of the southerly
line of said proposed highway to be known as "East Legion
Avenue"; thence across the easterly end of said "East Legion
Avenue", North 6 degrees 45 minutes 00 seconds West, 52.93
feet to the point of beginning.
The above described proposed highway being 50.0 feet
in width.
Annexed hereto and made a part hereof is a certain map prepared
by Otto W. Van Tuyl & Son, Licensed Land Surveyors, dated November 6,
1966, entitled "Map of Proposed Highways to be known as East Legion
Avenue and North Riley Avenue at Mattituck, Town of Southold, New York",
which said map shows the course of said highway outlined in red.

lished as Town Highways in December 1966 when they were
declared highways used by the public for more than ten

I would very much appreciate your advising m~ as to the status 'Of'the
above two streets in Mattitu~k..
Although I am quite certain they have never been dedicated to the Tcwn
of Southold, I note that they are r~in~ined by tb~ To~n.
We represent t_he e~ecutor of the Estate of Katherine Nutley. The prop-
erty is cn the East side of North Riley A~nue. It will probably .be put up
f~r sale shortly, and we would expect inc~,i~ies as to ~he status of the roads
as far as the Tcwn of Southold is ccncenaed;
