Re Site Plan Determination — Zuhoski Agricultural Storage Building

Dear Mr. Zuhoski:
The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, April 10, 2023:
WHEREAS, this agricultural site plan is for a proposed 30'W x 401 (1,200 sq. ft.)
agricultural storage building on a 2.79 acre parcel in the AC Zoning District, Cutchogue;
and
WHEREAS, on March 16, 2023 Steven Zuhoski, applicant, submitted a Site Plan
Application for review; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in §280-
133 for those applications involving uses strictly related to agriculture as long as they
are not necessary to further the objectives set forth in Town Code §280-129 to maintain
public health, safety, and welfare. The Planning Board has found that this application is
eligible for a waiver of certain elements of the Site Plan requirements because it is an
agricultural use, the details of which are included in the Staff Report dated March 27,
2023; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 B (5), has the discretion to vary or waive the parking requirements for Site
Plan Applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the Site Plan Requirements chapter of the Town Code. The Planning Board
has found that this application is eligible for a waiver of parking requirements because

there is no need to provide for parking - the application is for an agricultural use, the
building is for storage and owner use only, and the parcel is large in size relative to the
proposed structure; and
WHEREAS, on March 27, 2023, the Southold Town Planning Board formally accepted
the agricultural application as complete for review; and
WHEREAS, on March 27, 2023, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that
the proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(4),which states that the following actions are not subject to
review under this Part: "agricultural farm management practices, including construction,
maintenance and repair of farm buildings and structures, and land use changes
consistent with generally accepted principles of farming"; and
WHEREAS, on March 30, 2023, the Planning Board, pursuant to Southold Town Code
§280-131(C), distributed the application to the required agencies for their comments;
and
WHEREAS, on April 5, 2023, the Southold Town Fire Marshall stated there were no
objections to the proposed site plan; and
WHEREAS, on April 7, 2023, the Southold Town Code Enforcement officer verified that
there were no open violations on the subject parcel; and
WHEREAS, on April 10, 2023, the Southold Town Planning Board determined that all
applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan
Approval of the Town of Southold, have been met; therefore be it
RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan
Application requirements as noted above; and be it further
RESOLVED, that the Southold Town Planning Board hereby waives the parking
requirements as noted above; and be it further
RESOLVED, that the Southold Town Planning Board hereby grants Approval with
Conditions, listed below, of the site plan of property for Steven Zuhoski prepared by
Steven Zuhoski, dated March 16, 2023, and authorizes the Chairman to endorse the
Site Plan after Condition A below is met:
Conditions:
A. Prior to endorsement of the site plan, a use certification must be obtained
from the Chief Building Inspector as required by Town Code.
B. No exterior lights were reviewed or approved in connection with this site plan.
Any exterior lights on or around the outside of this storage building must be

This agricultural site plan is for the proposed construction of a 1-story 1,200 sq. ft.

1. Existing.
a. 2.79 Acres with multiple existing agricultural buildings. Adjoining parcel with
±37.4 acres of active farmland with County Development Rights.
2. Proposed:
a. Construct a 40' L x 30' W agricultural storage building (18' high at peak).
i. There are no proposed or planned interior divisions of the floor area as the
building will be used for storage.
b. Drainage: gutters and leaders
Staff: This proposed project is situated on and adjacent to active farmland, and
the location of the barn, the topography, and the use of gutters and leaders will
ensure that no stormwater will leave the site because of this building.
3. Bulk Schedule/Code Re uirements AC Zoning District):
a. Lot Coverage: Maximum: 20%
Staff: This farm includes over 37 acres of active farmland, and even with the
existing structures remains below the maximum lot coverage of this zoning
d istrict.

b. Parking:
i. Storage building: 1 per 1000 sf of gross floor area
ii. 1200 = 1000 = 1.2 or 2 stalls required
Staff: As an agricultural application with existing parking areas, the fact that
no public would be entering this barn, and ample land area to accommodate
the parking of farm vehicles, this parking requirement was recommended to
be waived (§ 280-133 C) at the Planning Board work session on March 27,
2023.
c. Setbacks for the proposed building (AC):
i. Required side yard: 20'
ii. Provided side yard: 25'
4. Exterior Lighting: None proposed at this time.
5. State Environmental Quality Review Act SEQRA :
The proposed action is a Type 11 Action as it falls within the following description
of 6 CRR-NY 617.5 (c)(4), which states that the following actions are not subject
to review under this Part: "agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land
use changes consistent with generally accepted principles of farming".
6. Alignment with Town Code and Comprehensive Plan:
§ 280-97 Right to farm.
(A) The Town Board of the Town of Southold finds that farming is an essential
activity within the Town of Southold. Farmers provide fresh food, clean air, economic
diversity and aesthetic open spaces to all the citizens of our Town. In addition, land
in agricultural uses requires less tax dollars for services than does land with
residential or commercial development. Accordingly, farmers shall have the right to
farm in Southold without undue interference from adjacent landowners or users. For
the purpose of reducing future conflicts between people residing on tracts adjacent
to farmlands and farmers, it is necessary to establish and give notice of the nature of
the farming activities to future neighbors of farmland and farming activities.
(B) Agricultural activities conducted on farmland, undertaken in compliance with
applicable federal, state, county and Town laws, rules and regulations, are
presumed to be good agricultural practices and presumed not to adversely affect the
public health safety and welfare. We find that whatever nuisance may be caused to
others by such uses and activities, so conducted, is more than offset by the benefits
from farming to the community. Therefore, all such activities shall be protected farm
practices within the Town of Southold.

§ 280-99 Right to undertake protected farm practices.
(A) Farmers shall have the right to undertake protected farm practices in the active
pursuit of agricultural operations, including, but not limited to: clearing; grading;
plowing; aerial and ground spraying; the use of legal agricultural chemicals
(including herbicides, pesticides and fertilizers); raising horses, poultry, small
livestock and cattle; processing and marketing produce; installing water and soil
conservation facilities; utilizing farm crop protection devices; designing and
constructing and using farm structures, including barns, stables, paddocks, fences,
greenhouses and pump houses; using water; pumping; spraying; pruning and
harvesting; disposing of organic wastes on the farm; extensive use of farm laborers;
training and others in the use and care of farm equipment, animals; traveling local
roads in properly marked vehicles; and providing local farm produce markets near
farming areas.
(B) These activities can and do generate dust, smoke, noise, vibration and odor.
These activities may occur on holidays, Sundays and weekends, at night and in the
day. Such activities are presumed to be reasonable. Such activities do not constitute
a nuisance unless the activity has a substantial adverse effect on the public health,
safety and welfare.
Chapter 9 Southold Town Comprehensive Plan
The Southold Town Comprehensive Plan contains an entire chapter dedicated to
agriculture, and it states, "Agriculture and related businesses are in the top five
economic engines of our economy." The first goal of Chapter 9 is to "Retain and
Advance the Industry of Agriculture." This proposed agricultural storage building
meets the goal of retaining and advancing the industry of agriculture by providing
needed storage infrastructure for the active vineyard on site.
IV: Staff Update:
1. After internal scoping and review, the following expedited process was agreed
upon for this agricultural storage building:
a. Due to the small size of the proposed building relative to the
surrounding farmland — calculations and engineered drainage solutions
are not necessary. The applicant has confirmed their plans for dealing
with drainage on site as noted under proposed construction.
b. As this is a Type II Action, there is no required SEQRA coordination.
c. After consultation with the LWRP Coordinator, no further
environmental review is necessary at this time.
d. There are no proposed bathrooms or water to the storage building, so
no referrals were necessary to SCWA or SCDHS.

e. Due to small size of proposed project and parcel location, the Suffolk
County Planning Commission would consider this a matter for local
determination.
f. In a scoping meeting with the Fire Marshal and Chief Building
Inspector, the project was reviewed, and no concerns were raised. The
proposed building:
i. has sufficient egress with two man doors, and one bay door,
ii. has sufficient road access,
iii. must maintain proper distances from existing buildings per state
code,
iv. should have no public access and must be for agricultural
purposes.
V: Items to Consider:
Based on the above analysis and update, all site plan requirements listed in §280-
133 of the Town Code have been met or have been recommended to be waived,
and it is recommended that the above referenced site plan application be scheduled
for determination by the Planning Board at tonight's April 10, 2023, public meeting.

notable slope along the western edge of the parcel on the adjacent land. It is
recommended that the applicant supply further details on stormwater
management and drainage calculations.

in agricultural uses requires less tax dollars for services than does land with
residential or commercial development. Accordingly, farmers shall have the right to
farm in Southold without undue interference from adjacent landowners or users. For
the purpose of reducing future conflicts between people residing on tracts adjacent
to farmlands and farmers, it is necessary to establish and give notice of the nature of
the farming activities to future neighbors of farmland and farming activities.
(B) Agricultural activities conducted on farmland, undertaken in compliance with
applicable federal, state, county and Town laws, rules and regulations, are
presumed to be good agricultural practices and presumed not to adversely affect the
public health safety and welfare. We find that whatever nuisance may be caused to
others by such uses and activities, so conducted, is more than offset by the benefits

from farming to the community. Therefore, all such activities shall be protected farm
practices within the Town of Southold.
§ 280-99 Right to undertake protected farm practices.
(A) Farmers shall have the right to undertake protected farm practices in the active
pursuit of agricultural operations, including, but not limited to: clearing; grading;
plowing; aerial and ground spraying; the use of legal agricultural chemicals
(including herbicides, pesticides and fertilizers); raising horses, poultry, small
livestock and cattle; processing and marketing produce; installing water and soil
conservation facilities; utilizing farm crop protection devices; designing and
constructing and using farm structures, including barns, stables, paddocks, fences,
greenhouses and pump houses; using water; pumping; spraying; pruning and
harvesting; disposing of organic wastes on the farm; extensive use of farm laborers;
training and others in the use and care of farm equipment, animals; traveling local
roads in properly marked vehicles; and providing local farm produce markets near
farming areas.
(B) These activities can and do generate dust, smoke, noise, vibration and odor.
These activities may occur on holidays, Sundays and weekends, at night and in the
day. Such activities are presumed to be reasonable. Such activities do not constitute
a nuisance unless the activity has a substantial adverse effect on the public health,
safety and welfare.
Chapter 9 Southold Town Comprehensive Plan
The Southold Town Comprehensive Plan contains an entire chapter dedicated to
agriculture, and it states, "Agriculture and related businesses are in the top five
economic engines of our economy." The first goal of Chapter 9 is to "Retain and
Advance the Industry of Agriculture." This proposed agricultural storage building
meets the goal of retaining and advancing the industry of agriculture by providing
needed storage infrastructure for the active vineyard on site.
V: Items to consider:
1. Accept the application as complete for review to begin the process as specified
below; in addition, consider the following:
a. Due to this being an agricultural application, the following items may be
waived:
i. Environmental Assessment Form;
ii. Property Survey;
iii. Parking requirements;

supplies from the farm and will not open to the public.

property lines. If none exist within 500 feet of the subject property, indicate
the distance to the nearest intersection with a public street.

subject parcel and include key elements of those existing sites (e.g.
buildings, curb cuts, parking area(s), landscaping, etc.).
vi. Existing zoning, including zone lines and dimensions.
vii. Existing contours with intervals of two feet or less, referred to mean sea
level as per United States Geological Survey datum.
viii. Existing paved areas, including parking areas, sidewalks and vehicular
access between the site and public streets.
ix. The locations, dimensions, grades and flow directions of any existing
culverts, waterlines or sewage disposal systems, as well as other
underground and aboveground utility poles and utility lines within and
adjacent to the property.
x. The location and details of aprons, curbs, sidewalks, fencing (type and
location), and grading, including existing and proposed topography with
two-foot contours (on site and 200 feet beyond the property line) and spot
elevations for buildings and all structures, drainage calculations, details of
drainage structures and watershed areas, where applicable.

2. Consider waiving the Public Hearing for this Agricultural site plan.
3. Classify the action as Type II (agriculture) under SEQRA;
