(631) 765-1809 I �✓ FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 16, 2023 ZBA FILE: # 7750 NAME OF APPLICANT: Joseph M. and Joanne Mascia PROPERTY LOCATION: 1600 Deep Hole Road, (Adj. to Deep Hole Creek) Mattituck SCTM No. 1000-115-12-22 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated January 13,2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 24, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 10,986 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 46.02 feet along Deep Hole Creek, runs 50.00 feet along Deep Hole Drive,runs 238.83 feet on the North side,and runs 204.24 feet on the South side. The parcel is improved with an existing one-story frame house, a frame shed, and a dock. All is shown on a survey by Young and Young L.L.S. dated March 2,2022 and last updated July 14, 2022. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124 and the Building Inspector's October 11, 2022 Notice of Disapproval based on an application to construct additions and alterations to an existing single-family dwelling; at; 1) less than the code required minimum side yard setback of 10 feet; 2) less than the code required minimum combined side yard setback of 25 feet; located at: 1600 Deep Hole Road, (.Adj. to Deep Hole Creek)Mattituck,NY. SCTM No. 1000-115-12-22. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to an existing dwelling that will result in a side yard setback of 2.7 feet and a combined side yard setback of 14.7 feet. Town Code requires a minimum combined side yard setback of 25 feet and a minimum side yard setback of 10 feet. Page 2, March 16,2023 #7750, Mascia SCTM No. 1000-115-12-22 ADDITIONAL INFORMATION: The existing dwelling has the benefit of pre-co No Z6817 dated December 16, 1975 for a one family dwelling,C/O Z-25102 dated June 20, 1997 for alterations,and a Trustees Wetland Permit No. 4434 for an existing dock, catwalk and ramp. Two letters of support from neighbors on Deep Hole Drive were received by the Board The distance from the existing dwelling of 2.7 feet from the southerly lot line depicted on the site plan prepared by Mark Schwartz, Architect, differs from the distance of 2.6 depicted on the survey prepared by Howard W. Young, LS. last revised March 2,2022. For the purpose of granting setback relief,the Board will refer to the survey prepared by Mr.Young. The applicant proposes to renovate the existing dwelling with a modest 439 sq. ft. first floor addition create an ensuite master bedroom and a 55 sq. ft. covered front porch entry with code conforming setbacks. Also proposed is a 440 sq. ft. second story loft addition. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a single-family waterfront neighborhood. The existing house is a pre-existing non-conforming house built prior to zoning that is sited at an angle to the property lines on a long and narrow lot(238 feet long by fifty feet wide). Pre-existing non-conforming structures are common in this neighborhood and there are many other two-story dwellings in the neighborhood so the proposed additions are in keeping with neighborhood character. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing house does not conform to required setbacks. Any additions and alterations will require area variance relief. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 42%relief for the combined side yard setback and 66% relief for the single side yard setback from the minimum code requirements. However, the subject dwelling has existed at these setbacks for over 66 years and no new ground disturbance in the sideyards or reduction in the existing side yard setbacks is proposed. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Further, the applicant proposes to install a new IA wastewater sanitary system landward of the existing dwelling. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVALS) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,siteplan andlor survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured., and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. IT IS THE'PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. The subject parcel is a non-conforming .25 acre (10,986 SF) lot in the R- 40 zoning.district that has been in the Mascia family for nearly 50 years. It is located on Deep Hole Drive in Mattituck adjacent to the Deep Hole Estates community. As depicted on the survey provided, due to the diagonal configuration of the house, the existing footprint lies 2.6 feet from the southern property line and 12 feet from the northern property line at its closest points. As such, variance relief is required as per the Walz interpretation. The proposed additions and alterations consist of a modest 439 SF first level addition to create an ensuite master bedroom and a covered porch in the front of the house, within allowable front and side yard setbacks. In addition, a 440 SF second level loft addition will constructed substantially above the first floor addition for family entertainment and the roof will be pitched from front to back to improve the aesthetics of the house. The applicant also intends to relocate and upgrade the sanitary system in the front yard. For the following reasons, the Applicant submits that a Variance from Section 280-124 is warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The surrounding neighborhood is characterized by one and two story waterfront dwellings of varying sizes, many of which are constructed on substandard lots and have undergone renovations. The second story construction will take place within the footprint of the existing structure with no new ground disturbance. While the proposed second-story addition will increase the height of the house, it will not extend the nonconforming side yard setbacks and the expansion is well within allowable lot coverage. The subject parcel is also surrounded by two story dwellings so this expansion will be consistent with the character of the nearby properties. Despite the reduced side { yard setback, the increased height of the house will not impact water views of the neighbors. RECI.IVE 2. The benefit sought by the Applicant CANNOT I oe acH*&4W2bome feasible method for the applicant to pursue other than an area variance; _11� because: Zoning Board Of APPt!iS The Applicant is seeking the benefit of additional living space and a functional entry way to their home to accommodate their family. The Certificate of Occupancy on file confirms that this home was constructed prior to the implementation of the current bulk schedule requirements. Because of the Walz Interpretation, any addition to this house will require variance relief despite the fact that there will be no increase in the nonconformity of the existing setback. 3. The amount of requested relief is not substantial because: While variances for the side yard and combined side yard may be mathematically substantial, there is no new ground level disturbance in the side yards since the construction will only increase the height of the house and result in a structure that is similar to many other homes in the surrounding neighborhood. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the pre-existing nonconforming setbacks were established years ago when the home was constructed. There are numerous other two-story homes with nonconforming setbacks in the neighborhood many of which have been renovated. Granting of variance relief to allow similar improvements will not,have an adverse impact on the .physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In fact, the Applicant will be relocating the sanitary system landward of the house and upgrading to an I/A nitrogen friendly system. 5. Has the alleged difficulty been self-created? Mascia and Joanne Mascia, are appealing the Building Inspector's Notice of Disapproval, dated October 11, 2022, for a building permit to construct additions and alterations to an existing single family dwelling, consisting of a modest first floor addition and second floor loft addition, which new construction will constitute an increase in the degree of the pre-existing nonconforming side yard setback at less than 10-feet on one side and less than 25-feet on the combined side yard setback required under Town Code Section 280-124 on lots measuring up to 19,999 square feet in total size. The subject parcel is a non-conforming 0.25-acre (10,986 SF) lot in the R-40 zoning district that has been in the Mascia family for nearly 50 years. It is located on Deep Hole Drive in Mattituck adjacent to the Deep Hole Estates community. As depicted on the-survey provided, due to the diagonal configuration of the house, the existing footprint lies 2.6-feet from the southern property line and 12-feet from the.northern property line at its closest points. As such, variance relief is required as per the Walz Interpretation. The proposed additions and alterations consist of a modest 439-SF first level addition to create an ensuite master bedroom and a covered porch in the front of the house, within allowable front and side yard setbacks. In addition,' a 440-SF second level loft addition will be constructed substantially above the first floor addition for family entertainment and the roof will be pitched from front to back to improve the aesthetics of the house. The Applicants also intend to relocate and upgrade the sanitary system in the front yard. For the following reasons, the Applicants submit that a Variance from Section 280-124 is warranted. RECEIVED FEB 28 2023 POINT I -773-D 3-p THE APPLICANT HAS MET THE TEST FOR THE G ?bW Board AREA VARIANCE SET FORTH IN TOWN LAW §267-B Under §267-B, the Applicant must demonstrate compliance with the following standards to be eligible for the issuance of a variance: (a) whether the grant of the variance will cause an undesirable change in the character of the neighborhood or will create a detriment to nearby properties; (b) whether the benefits sought by the applicant can be achieved by some method feasible for the applicant to pursue other than an area variance; (c) whether the requested area variance is substantial; (d) whether the grant of the variance will have an adverse effect or impact upon the physical or environmental conditions in the neighborhood or in the affected area of the Town; and (e) whether the difficulty causing the applicant to request an area variance was self-created which consideration shall be relevant to the determination of the Board but shall not necessarily preclude the grant of the variance. The Grant Of The Variance Will Not Cause An Uc *F*910 d of Appeals Change In The Character Of The Neighborhood Or Cr to Nearby Properties. The surrounding neighborhood is characterized by one-story and two- story waterfront dwellings of varying sizes, many of which are constructed on substandard lots and have undergone renovations. The second story construction will take place within the footprint of the existing structure with no new ground disturbance. While the proposed second story addition and roof pitching will increase the height of the house, it will not extend the nonconforming side yard setbacks and the expansion is well within allowable lot coverage. The subject parcel is also surrounded by two-story dwellings so this expansion will be consistent with the character of the nearby properties. Despite the reduced side yard setback, the increased height of the house will not impact water views of the neighbors. Letters in support from both adjacent neighbors have been submitted for the record. 2. The Benefits Sought to Be Achieved by Applicant Cannot Be Feasibly Achieved by Some Method Other Than the Requested Area Variance The Applicants are seeking the benefit of additional living space and a functional entry way to their home to accommodate their family. The Certificate of Occupancy on file confirms that this home was constructed prior to the implementation of the current bulk schedule requirements. Because of the Walz Interpretation, any addition to this house will require variance relief despite the fact that there will be no increase in the nonconformity of the existing setback. RECEIVED 3. The Area Variance Sought is Not Substantial. FEB 2`8 2023 `-7V While variances for the side yard and combined side yard ma Ening Board of Appeals mathematically substantial, there is no new ground level disturbance in the side yards since the construction will only increase the height of the house and result in a structure that is similar to many other homes in the surrounding neighborhood. 4. The Grant of the Variance Will Not Have an Adverse Impact on the Physical or Environmental Conditions in the Neighborhood or District. As stated previously, the pre-existing nonconforming setbacks were established years ago when the home was constructed. There are numerous other two-story homes with nonconforming setbacks in the neighborhood and many of which have been renovated. Granting of variance relief to allow similar improvements will not have an adverse impact on the physical conditions in the neighborhood and, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. In fact, the Applicants will be relocating the sanitary system landward of the house and upgrading to an I/A nitrogen-friendly system. 5. The Self Created Nature Of the Alleged Difficulty Should Not Preclude the Granting of Area Variance Relief. To the extent that the difficulty is self-created, pursuant to New York Town Law§267-B (3), a self-created hardship "shall not necessarily preclude the granting of an area variance." =Bd CONCLUSION For the reasons set forth herein, it is respectfully submitted that the standards of Town Law Section 267-B have been met and, as such, relief from the requirements set forth in Southold Town Code Section 280-124 is warranted.
