(631) 765-1809 A 01; I 0 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 16, 2023 ZBA FILE: 7746 NAME OF APPLICANT: Leonard Williams PROPERTY LOCATION: 6925 Peconic Bay Blvd,Laurel SCTM No. 1000-126-10-16 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 22, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 52, 783 sq. ft. parcel located in an R-40 Zoning District. The property has a road frontage of 100.8 feet along Peconic Bay Boulevard, then runs north for 404.23 feet to the rear property line,then turns northeast for 198.8 feet, before returning south for approximately 404.00 feet along an irregularly shaped eastern property line back to Peconic Bay Boulevard. The property is improved with an existing 2-story residence, and accessory garage, and a shed in the front yard,all as shown on survey prepared by Michael J. Scalice,LS, last revised October 28,2022. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15 and the Building Inspector's November 28, 2022 Notice of Disapproval based on an application to construct an accessory garage; 1) located less than the code required minimum rear yard setback of 15 feet;2)located less than the code required minimum side yard setback of 15 feet; located at: 6925 Great Peconic Bay Blvd,Laurel,NY. SCTM No. 1000-126-10-16. RELIEF REQUESTED: The applicant requests variances to construct an accessory garage in the rear yard with side yard and rear yard setbacks of 5 feet, where the minimum required side and rear yard setback is 15 feet. ADDITIONAL INFORMATION: In testimony by both the agent and owner during the hearing, it was stated that the existing garage, which was built with a variance#5267 dated March of 2003 is a wood shop with a wood burning stove, with a Certificate of Occupancy#Z30091 received on March 17, 2004. The existing residence exists with a Certificate of Occupancy#Z-30090, dated March 17,2004. It was stated during the hearing that the owner wanted the proposed accessory garage to be close to the property line as he wanted it as far away from the house as possible, even though there was ample room for the building to comply with the zoning code required setbacks. The proposed garage will have electricity only,and no plumbing and will be used to house the applicant's antique cars Page 2, March 16,2023 #7746, Williams SCTM No. 1000-126-10-16 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2,2002 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood along the north side of Peconic Bay Boulevard consists of modest sized homes with mostly conforming accessory structures. The proposed accessory structure is situated on a corner section of the property which is wooded,but flat. The property already has an accessory structure that exists with variance relief outside of the allowable side yard. By granting this proposed variance,this accessory structure would change the character of this neighborhood by allowing more than one accessory structure to exist in a non-conforming location where conformity is easily possible. In addition,the proposed accessory garage measures 30 ft. x 20 ft. and 17.6 ft. in height and would have an adverse visual impact on an adjacent residential property in the proposed location which is very close to the shared property lines. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed structure can be built with the code conforming setbacks without the need for variance relief since there is ample room to do so in the area the property owner has chosen. Also, by building the proposed structure the applicant will still not exceed the allowable lot area coverage. 3. Town Law 4267-b(3)(b)(3). The variances proposed herein are mathematically substantial,both the side yard and rear yard variances represent a 67%relief from the Town Code.However,the proposed accessory building can easily be built without the need for variance relief in a conforming location. 4. Town Law§267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
