(631) 765-1809 outhold 1`®wn Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 16,2023 ZBA FILE: 7743 NAME OF APPLICANT: Timothy Quinn/TG3 Holdings, LLC PROPERTY LOCATION: 1 Mulford Court, Orient,NY SCTM#1000-14-2-1.6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A14-25,and the Suffolk County Department of Planning issued its reply dated December 15, 2022, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 24, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore INCONSISTENT with the LWRP. It was recommended that the pool be reoriented to increase the distance from the erosion hazard area. The Board agreed that reorienting the pool may create more disturbance to the bluff area, and that the existing footprint should remain. With the conditions imposed herein, the Board now finds the proposed action to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 253,803.49 square foot parcel located in the Residential R-80 Zoning District. The northerly property line measures 194.78 feet and is adjacent to Long Island Sound. The easterly property line measures 1242.11 feet and the southerly property line measures 219.04 feet and the driveway opens to Mulford Court, the westerly property line measures 12.42.30 feet. The property is improved with a two-story frame residence with an existing 20 ft. x 40 ft. in-ground swimming pool surrounded by a wood deck located at the rear of the residence facing seaward. There is an 80 ft. x 120 ft. tennis court located landward of the residence as shown on the survey map prepared by Kenneth M. Woychuk,LS and dated April 1,2019. BASIS OF APPLICATION: Request for Variance from Article XXII, Sections 280-116A (1) and the Building Inspector's September 12, 2022, Notice of Disapproval based on an application to demolish and reconstruct an accessory in-ground swimming pool; at; 1) located less than the code required 100 feet from the top of the bluff: located at: 1 Mulford Court, Orient,NY. SCTM#1000-14-2-1.6. RELIEF REQUESTED: The applicant requests a variance to demolish and reconstruct a new gunite accessory in- ground swimming pool The proposed construction, on this conforming 253.809.49 square foot parcel located in the Residential R-80 Zoning District, is not permitted pursuant to Article XXII, Section 280-116A(1),which states,"All Page 2,March 16,2023 #7743,Quinn SCTM No. 1000-14-2-1.6 buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The proposed pool construction has a distance of 60.5 feet from the top of the bluff. Drawings for the 20 ft. by 40 ft. gunite swimming pool were prepared by Havoje Marnika, LPE of HM Engineering and dated November 7, 2022. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2, 2023, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to demolish the current in-ground vinyl swimming pool which was granted a Certificate of Occupancy April 12, 1991. The applicant proposes to locate a gunite swimming pool in the same footprint location, and replace the old wood deck with new pavers. This seaside neighborhood has many swimming pools located in the rear seaward side. The applicant's property is well screened on both sides and will not disturb neighbors as the old pool was in place since 1991. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Moving the pool to another location further landward or re- orienting the pool to be parallel to the dwelling instead of perpendicular to the dwelling to increase the bluff setback would cause further disturbance to the area near the bluff. Locating the new pool in the same footprint as the existing pool causes the least land disturbance and is more of a maintenance situation for a pool that is in need of replacement after many years. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 39.5%relief from the code. However, the old pool was legally permitted, and the applicant wishes to replace it, in kind, with a new gunite pool. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for and shown on the survey map prepared by Kenneth M. Woychuk, LS and last revised November 14, 2022. i Page 3, March 16,2023 #7743,Quinn SCTM No. 1000-14-2-1.6 SUBJECT TO THE FOLLOWING CONDITIONS: 1. TIMOTHY OUINN/TG3 HOLDINGS LLC #7743 — Request for a Variance from Article XXII, Section 280- 116A(1) and the Building Inspector's September 12, 2022 Notice of Disapproval based on an application to demolish and reconstruct an accessory in-ground swimming pool; at; 1) located less than the code required 100 feet from the top of the bluff; located at: 1 Mulford Court,Orient,NY. SCTM No. 1000-14-2-1.6. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 4. Minimize the loss of life, structures, and natural resources from flooding and erosion. Portions of the parcel are located within the CEHA. The location of the proposed pool is contrary to preventing the loss of structure near hazardous areas. The structures within these areas are subject to repetitive loss from storm surge-induced bluff erosion events over time and should be avoided and/or minimized. Setbacks should be maximized. It is recommended that the pool is reoriented to increase the distance from the erosion hazard. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Presently the current property.owner, TG3 Holdings LLC, would like to remove and replace the pool in the same location and configuration, which is depicted both on the survey connected with the variance approval(copy attached) and the, current survey prepared by Kenneth M.Woychuk, dated April 1,2019,two copies of which are attached hereto. Because the new swimming pool would be constructed in the same location and configuration as the existing ZBA approved pool structure, I am writing to request that the Board consider issuance of a de minimis letter or some other form of waiver letter indicating that the'Board would not need to grant additional variance relief to permit the in-place replacement:of the same pool structure the Board allowed to remain in the same location in 1991. Gilbert, Jr. Southold Z.B.A. is correct. MR GILBERT: There is more space there. I guess there is a least four or five feet. CHAIRMAN GOEHRINGER: Sometime in the mid 80's we imposed which was originally 239, I 'm sorry 139.4 which ended up to be in the new zoning code 239.4 or 239d. In all cases it reflects the •bulkhead or the lip of the bluff on the Long Island Sound. MR GILBERT: Thank you. CHAIRMAN GOEHRINGER:' You are very welcome Mr. Gilbert. Thank you. Hearing no further questions I make a motion closing the hearing reserving decision until later. All in Favor - AYE. Appl. No. 4006 Applicant(s) : Eric and Mary Ann Alexander Location of Property: Peconic Bay Blvd. , Laurel County Tax Map No. : 1000-128-4-20 . The Chairman opened the hearing at 8:02pm and read the notice of hearing and application for the record. CHAIRMAN GOEHRINGER: I have a copy of the survey done by Young and Young. The most recent date is May 29, 1975. Indicating a rather large one story frame house and garage on this 19665 sq ft lot and a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Is there somebody who would like to be heard in behalf -of this application? The Alexander' s have requested a recess until the next regularly scheduled meeting unless there's any questions from Board Members I' ll grant that request. Thank you. The date will be March 22,, 1991 and I offer that as a resolution gentlemen. All .in Favor - AYE. Appl. CHAIRMAN GOEHRINGER: This is ar application that was opened Page 12 - February 22, 1991 u - Public Hearing Mitchell Marks Southold Z.B.A. at the last regularly scheduled meeting and was asked for a recess. You are welcome to use the microphone and state your name. MR MARKS: I contracted a builder to build a pool in my backyard and supposedly he was going to comply with all local variances and ordinances. After the pool was built it turned out that it was approximately 12 to 16 feet too close_ to the rear property line which is on the water, which faces the water.. I have a letter, I had an architect take a look at the property and take a look at the plantings that we did, I have submitted this to the Board. Which basically says that he feels that to move the pool back would probably cause more damage then to keep the pool where it is. Also the neighbor to the east of my property recently received a variance to build a pool which was less then half the distance between my pool and the top of the bluff, the rear of the house I'm sorry. The top of the bluff is approximately 58 feet from the top where mine is I think 88 feet. CHAIRMAN GOEHRINGER: I measured it. 76 from the closest blow out on the top of the lip of the bluff to the edge of the deck. MR MARKS: 76 feet instead of 100. CHAIRMAN GOEHRINGER: Right. You are talking pool and I'm talking about closest construction. Closest construction is really the deck. MR MARKS: Right there' s another 10 feet which makes 88, 86. The deck is just laying on top of the dirt. The other thing is I don't think it would really abduct any of the neighbors to having it where it is opposed to moving it back. It' s visible by property, the lot to the right and it' s a relatively a large piece 'of property. I don't. think it' s going to disturb them too much. CHAIRMAN' GOEHRINGER: Will anything change other then what we see except for the fact that you will put a permanent fence around it?. MR MARKS: No. CHAIRMAN GOEHRINGER: Overhead lighting? MR MARKS: Nothing. I mean I would probably next year I would build, I would replace the steel pipes with wooden pipes. Page 13 - February 22., 1991 Public Hearing - Mitchell Marks Southold Z.B.A. CHAIRMAN GOEHRINGER:. Right: You have no intentions of enclosing it? MR MARKS: No. CHAIRMAN' GOEHRINGER: I have no problems with it, to be perfectly honest with you. I have no idea how my fellow Board Members feel about it. Only because of where the property slopes. It slopes away from the bluff toward the pool and we are concerned about sloping toward the bluff and an erosion factor. That would only occur, godforbid if you lost the whole bluff. I doubt seriously in that case. MR MARKS: I put fertilizer on the bluff and throw some grass seed on it a couple times a year. It' s also watered regularly. CHAIRMAN GOEHRINGER: It looks great. MR MARKS: Do you want the letter from the architect? CHAIRMAN GOEHRINGER: Sure. Thank you very much sir. Is there anybody else who would like to speak in favor of this application? Is there anybody who would like to speak against the application? Questions from Board Members? Hearing no further questions I make a motion closing the hearing reserving decision until later.
