(631) 765-1809 0 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF MARCH 16,2023 ZBA FILE:•773 8 NAME OF APPLICANT: Charles Salice PROPERTY LOCATION: 2315 Pine Tree Road, Cutchogue SCTM No. 1000-104-3-1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated November 4, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (L)WRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 24, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is an 18, 877 sq. ft. non-conforming parcel located in an R-40 Zoning District. The property has a road frontage of 70. 45 feet along Pine Tree Road, then turns east for 292.43 feet towards Little Creek, it then turns south for 66.72 feet along Little Creek, before returning 272. 9 feet back to Pine Tree Road. The property is improved with an existing one and a half story residence with a detached two-car accessory garage. The existing construction is codified with a Certificate of Occupancy# 5916, dated May 16, 1974. All as shown on survey prepared by Joshua R. Wicks, LS, dated March 11, 2022. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's September 9, 2022 Notice of Disapproval based on an application to construct additions and alterations to an existing single family dwelling and construct an accessory garage; at; 1)the dwelling is located less than the code required minimum side yard setback of 10 feet; 2) the accessory garage is located less than the code required minimum side yard setback of 5 feet; located at: 2315 Pine Street Road, (Adj.to Little Creek) Cutchogue,NY. SCTM No. 1000-104-3-1. RELIEF REQUESTED: The applicant requests variance relief to 1) attach the existing accessory garage to the principal dwelling with a side yard setback of 2 feet where a 10-foot minimum is required, and 2) to construct an accessory garage in the front yard with a side yard setback of 2 feet where a 10-foot minimum is required. Page 2, March 16,2023 #7738, Salice SCTM No. 1000-104-3-1 ADDITIONAL INFORMATION: As per testimony of the applicant's agent at the public hearing, an Innovative Advanced(I/A)sanitary system will be installed. The existing overhead electrical wire that currently leads to a utility pole on the neighbor's property will be removed, and underground service will be installed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b M. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This neighborhood along the shore of Little Creek is comprised of mid to large size homes which are all two stories in height. The subject lot is very long and narrow measuring 70 feet in width and 292 feet deep. The setback variance for the existing accessory garage is a technical variance, as the structure already legally exists with a non-conforming side yard setback which will be maintained when it is attached to the existing dwelling thereby extinguishing the accessory use. Additionally,the attached garage,to be converted to a guest suite, is proposed to remain a one-story structure and the large home on the adjacent lot has a very large side yard setback from the subject property. The side yards are also very well screened by mature vegetation The proposed new accessory garage will have the same side yard setback as the existing accessory garage, will be the same size as the current detached garage,and will be sited to avoid obstructing the existing entrance to the dwelling, Granting the side yard variances for both the existing garage, and the proposed accessory garage will not change the character of this neighborhood, and would be aesthetically more appealing. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the non-conforming setback of the existing accessory garage, any proposed alterations to it would require variance relief. Since this property is waterfront, the proposed new accessory garage will be in a conforming front yard,but as stated above,the proposed accessory garage if placed with a conforming side yard setback minimum of 10 feet would block the entrance to the current residence and obstruct the desirable entry views to the creek. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial. a) The attached garage represents an 80% relief from the code. However, the structure is currently existing with a valid certificate of occupancy, and the proposal is to attach it to the house. This proposal will not increase the level of non-conformance of the structure which is proposed to remain one-story,and the subject side property line is densely planted with mature landscape screening. b) The proposed accessory garage represents an 80% relief from the code. However,the proposed structure is located in the conforming front yard with a set back from the street of approximately 122 feet, is proposed to be one story and is adjacent to a lot with a very large two story dwelling that is sited at a far distance from the shared property side line, 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and Conditions by this Board, including an IA sanitary system. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. y Page 3,March 16,2023 #7738, Salice SCTM No. 1000-104-3-1 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a converted attached garage and new proposed accessory garage while preserving and protecting the character of the neighborhood and the health, safety`and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Lehnert,seconded by Member Weisman(Chairperson),and duly carried, to GRANT the variances as applied for and shown on the Site Plan and Architectural Plans drawn by John Anthony Nastasi, Registered Architect, last revised August 31,2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Installation of an Innovative Advance(I/A) Sanitary System as approved by the Suffolk County Department of Health Services. 2. Convert the current overhead electrical service,which attaches to the neighboring property to an underground service that remains on the subject property. 3. Silt fencing shall be installed prior to construction to protect the neighboring property from construction debris and runoff during the construction phase. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to,comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVALS GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may,require anew application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted.by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted.
