Telephone SO 5-26(S0 UTES Southold Town .Board of Appeals May 12, 1960 A regular meeting of the $outhold Town Board.of Appeals was held 7:30 P.M., ThursdaY, May 12, 1960 at the Town Clerk Office, Main Road, Southold, New York. There were present: Messrs. Robert'W. Gillispie, Jr., Chairman, Robert Bergen, Herbert Rosenberg, and'Charles Grigonis, Jr. Also present: .Mr. Howard M. Terry, Building Inspector. Absent: Mr. Serge Doyen, Jr. PUBLIC HEARING: 7:30 P.M., Appeal No. 272 - Upon appli- cation of'William Victoria, a/c Victoria~ Cottagesa Bay View Road, Southold, New York, for a.special exception in accordance with the ZoningOrdinance, Article III, Section 300, Subsection 11, for permission to erect and maintain a directional advertising sign-on the land oflLeander Glover, south side of Middle Road, Cutchogue, N.Y., Nor th by Middle Road; East by Grimm, South by other land of Glover and West by Szawinski estate. Fee paid $15.00. ~ Southold TownBoard of.Appeals -2- May 12, 1960 The Chairman opened the hearing by reading application for a special exception, legal notice of hearing and affidavit'attesting to its publication in the official newspaper. TheChairman also read letter of consent from the property owner. THE CHAIRMAN: Is there anyone present.who wishes to speak for this application? MRS. WILLIAM VICTORIA: (Stated she appeared for the application. ) THE CHAIRMAN: Has the sign been moved? MRS. VICTORIA: No, I am .waiting for permission. THE CHAIRMAN: Is there anyone present who wishes to spea~ against this application? MR. ROSENBERG: How far back is it being moved? MR. TERRY, Building Inspector: It is. entirely in the street now. You can see the property marker in the picture that appears in the file. THE CHAIRMAN: This is an enlargement of the sign as I recall you said, is that right? MRS. VICTORIA: We were adding the crown to the sign to make it more attractive and eye catching. We repainted it~a different · color to attract the driver's attention. THE CHAIRMAN: by 6 ft. ? The dimension is presently approximately 4 ft. .MRS. VICTORIA: o n the Main Road° No, it is 6 ft. by 8 ft. The.same as the one THE CHAIRMAN: The sign size permitted for this type of sign is actually 6 ft. 6 in. by 12 ft. 6 fn. MR. ROSENBERG: Providing.there is no advertising on it. THE CHAIRMAN: If no one wishes to say anything else in favor or in opposition to this application I will. offer a Resolution granting this application. Southold Town Board of Appeals -3- May 12, 1960 Resolution was offered by Mr. Gillispie, seconded by Mr. Grigonis, and carried, WHEREAS application of William Victoria a/c Victoria's Cottages, having been considered at Public Hear-' lng No. 272 on.May 12, 1960, and the Board f~ding that the public.convenience and welfare and justice will be served .and the legally established or permitted use of neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed, therefore be it RESOLVED that the application-be granted as applied for with~ithe condition that this sign, which is the relocation of a non-conforming sign which has been enlarged within the permissible limits, be relocated in the same location at least five (5) feet from any property line. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. .Mr. WilliamKronk, Bowery Lane, Southold, appeared before the Board of Appeals for an informal discussion. Mr. Kronk stated that at the Town Board meeting on May 10th he was advised that the Town Board would have to issue licenses to those junk dealers in the Town who requested them. He stated he is of the opinion the un- licensed junk dealers should be given summonses and fines for not operating with a license for this length of time. Mr. Kronk said he is the only licensed junk dealer in the TOWn and he has to keep records which are inspected regularly. He feels it is not fair for the other junk dealers to operate without~any restrictions at all. .The Chairman advised Mr. Eronk that the Board of Appeals is inspecting junk yards a few at a time to see that they are putting in their planting of hedge or stockade as approved and they intend to continue their program until all junk yards are screened. The Chairman also advisedMr. Kronk that the licensing of junk yards is not a matter of concern to the Board of Appeals since it is a State law and the Town Board issues the licenses. The minutes of the meeting of April 21, 1960, on motion of Mr. Gillispie, seconded by Mr. Grigonis, and carried, were approved as submitted. Vote .of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. Southold Town Board of Appeals -4- May 12, 1960 PUBLIC HEARING: Appeal of~Thomas and Florence Jurzenia, a/c Silver Sands Motel, No. 270, for a special exception in accordance with Article III, Section 300, SubsectiOn 11. This public hearing was recessed from 7:45 P.M., Thursday, April 21, 1960 at the request of the applicants. Fee paid.S15.00. On Thursday,.April.21, 1960 the hearing was opened and the legal notice and application read. THE CHAIRMAN: Is there anyone presentwho wishes to speak for this application? ~R, THOMAS JURZENIA, Greenport, New York: There is no way we have of advertising whose motel it is. We now have only "motel" on the roof. As you know we have a bad situation there on the corner. We would like to establish a very definite identity. THE CHAIRMAN: How big .are the letters that are there now? MR. JURZENIA: The existing letters are 2 ft. THE CHAIRMAN: Ho~ far areyou from the 'Main Road? MR. JURZENIA: I would say about 1000 to 1200 ft. About 400 yards. I have here a sketch of the proposed sign. MR. HOWARD TERRY: He is exactly 1300 ft. fromtheMain Road. The sign he now has was authorized as part of the original building plan. MR. ROSENBERG: This new sign is over 50 sq. ft. MR. JURZEN,IA: I can bring that size down to 50 sq. ft. That is just a rough sketch. Resolution was offered by Mr. Bergen, seconded by Mr. Rosenberg andcarzi~d, WHER~%S application of Thomas and Florence .Jur.zenia, a/c Silver Sands Motel, having been considered at Public Hearing No. 270 on May 12, 1960, and the Board finding that the public convene'rice-and welfare and justice will be served and the legallYestablished or permitted use~of neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed, therefore be it Southold Town Board of Appeals -5- May 12, 1950 RESOLVED that the application be granted as applied for with the condition that the size of the sign is not to exceed 50 sq. ft., nor 6.ft. 6 in. in height, nor.12 ft. 6 in. in width consider- ing that the size of the sign, when letters are mounted independently, is predicated upon straight lines drawn tQ intersect the high and low points of the characters of the sign. Vote of the Board: AYes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting of April 28, 1960, on motion of Mr. Rosenberg, sea nded by Mr. Grigonis, and carried, were approved as.submitted. Vote of the Board: Ayes:~- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting of May 5, 1960,.on motion of Mr. B~rgen, seconded by Mr. Grigonis, and carried, were approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr, Bergen, Mr. Rosenberg, and Mr. Grigonis. The minutes of the meeting of May 9, 1960, on motion of Mr. Grigonis, seconded by Mr. Rosenberg, and carried, were approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and.Mr. Grigonis. The Chairman advised that Mr. A. Straussner advised him by telephone that he had decided not to complete his applications. The next meeting of the Southold Town'Board of Appeals will be held 7:30 P.M., Thursday, May 19, 1960.at the Town Clerk Office, Main Road, Southold, New York. On motion of Mr. Bergen, seconded by Mr. Grigonis and carried, it was RESOLVED that the Board set 7:30'P.M., Thursday, May 26, 1960 at.the Town Clerk Office, Main Road, Southold, New York, as time and place for hearing upon application of Thomas Jurzenia, a/c Silver Sands Motel'and Jack ~'e~in, a/c Sound Shore Motel, Greenport, New York, for a special exception in accordance with Southold Town Board.of Appeals -6- May 12, 1960 the Zoning.Ordinance, Article III, Section 300, Subsection 11, for permission to replace an existing directional sign with a two-panel directionalsign. Location of property: southeast corner of intersection of North Road and Chapel Lane, Greenport, New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis. On motion ofMr. Rosenberg, seconded by Mr. Bergen, and carried, it was RESOLVED that 7:45 P.M. (E.D.S.T.), Thursday, May 26, 1960, Town Clerk Office, Main Road, Southold, New York, be set as time and place for hearing upon application of Thomas Jurzenia, a/c Silver SandsMotel and Jack Levin, a/s .Sound Shore Motel, Greenport, New York, for a special exception in accordance with.the Zoning Ordinance, Article III, Section 300, Subsection 11, for permission to,place an existing directional sign with a two-panel directional sign. Location of property: southwest corner of intersection.of North Road and Albertson Lane, Greenport, New York. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis.
