Dear Norman,
Please accept my apology for the significant delay for in sending this letter! In an
e-mail dated Oct. 6th, I advised you of the Land Preservation Committee determination;
however, I neglected to send the follow-up letter I said I would send.
The Land Preservation Committee members have reviewed your original
application and subsequent information, the most recent information presented by e-
mail on August 12, 2022 and presented to the Committee by you at the August 30, 2022
meeting. The proposal is to install an Erfgoed Cultivation Floor on 10-15 acres of land
within the area subject to Town PDR. The proposal was reviewed by the Town
Agricultural Advisory Committee, and the AAC concluded that the proposal is
considered equipment.
At the September 27, 2022 Land Preservation Committee meeting, the Committee
passed the following motion, with Eric Keil recusing himself:
The Land Preservation Committee has reviewed and discussed Norman Keil's
request to install an ErfGoed Floor on 10-15 acres of land within the area subject
to Town PDR. The original request was reviewed by the Town Agricultural
Advisory Committee (AAC) in December 2020, and the AAC considered the
Erfgoed Floor to be irrigation equipment. Norman Keil presented additional
information pertaining to the proposed ErfGoed Floor in an e-mail dated August
12, 2022 and at the August 30, 2022 Land Preservation Committee meeting. The
Land Preservation Committee reviewed the information and found that the
proposed ErfGoed Floor is consistent with the purposes and other terms and
conditions of the recorded Easement.
The Committee's finding does not mean that such uses will be approved or
permitted by other Town Departments or agencies. The Committee's finding does not
mean that you can proceed with construction. All improvements are subject to all
applicable Town Code requirements. The Committee's finding allows you to proceed
with pursuing any applicable approvals that are required by Town Code.
The Committee's review is for the uses and improvements mentioned above
only. You will need to return to the Committee if there are changes to the proposal.

Upon the application of 5645 Aldrich Lane LLC, filed pursuant to 19 NYCRR 1205 on December
15, 2020, and upon all other papers in this matter,the Department makes the following determination:
NATURE OF faRIE E AND BgLIEF,,SOUGHT
The petition pertains to an addition and alterations to an existing building of a mixed F-1/S-1/R-3/B
(Factory/Storage/Residenbal/business) occupancy, 1 story in height, approximately 11,603 square feet in
area, of Type VB construction and located at 5645 Aldrich Lane, Mattituck, Town of Southold, County of
Suffolk, State of New York.
Relief is requested from:
19NYCRR Part 1221,Building Code of New York State(2020),Section 903.2.8,which provides
as follows: An automatic sprinkler system installed in accordance with Section 903.3 shall be
provided throughout all buildings with a Group R fire area.
[The petitioner requests relief to allow an automatic sprinkler system to be installed in accordance with
Section 903.3 in only the R-3 occupancy portion of the building.)

1. The building that is the subject of this petition is being used in conjunction with a wholesale nursery
business. At the current time, the building is being used for storage of plants and motorized farming
equipment, processing, and offices.
2. At this time the Petitioner wishes to construct living quarters for 10 persons who would be employed
to work in the wholesale nursery business over the office of approximately 1,554 square feet in area.
Because the living quarters will only be for a maximum of 10 persons, this would be classified as a

congregate living facility and an R-3 occupancy.
3. Because the proposed living quarters will used by a maximum of 10 persons and the area is less than
one-third of the floor area or space in which it is located, as per exception 1 of Section 505.2.3 of the
2020 BCNYS, this area can be considered a mezzanine that is not required to be open to the space
that it is located.
4. Section 1101.1 of the 2020 Existing Building Code of New York State(EBCNYS)stipulates that.... An
addition to a building or structure shall comply with the Uniform Code as adopted for new construction
without requiring the existing building or structureto comply with any requirements of those codes or
these provisions, except as required by this chapter. Where an addition impacts the existing building.
or structure, that portion shall comply with this code.
5. Section 903.2.8 of the 2020 Building Code of New York State(BCNYS)stipulates that... An automatic
sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings
with a Group R fire area. To be compliant with this requirement for new construction, the sprinkler
system would have to be installed throughout the entire building.
6. The Petitioner has stated that, at this time, there is not an adequate water supply to the building for
an automatic sprinkler system to be installed throughout the building and that bringing the required
water supply to the building and the full installation,would be both physically and financially infeasible.
7. The Petitioner has proposed that the new living quarters will be separated from the rest of the building
with 2-hour fire rated barrier wall and floor assemblies as per Section 707 of the 2020 BCNYS.
8. It is proposed that the new living quarters and exits therefrom,will have an automatic sprinkler system
installed as per NFPA 13D as permitted by Section 903.3.1.3 of the 2020 BCNYS.
9. There is an existing stairway and a proposed new stairway from the first story to the proposed area
where the living quarters are to be constructed.The existing stairway may not have the required riser
height or tread depth. It is proposed that, this existing stairway be reconfigured to meet the
requirements for riser height and tread depth as found in exception 3 of Section 1011.5.2 of the 2020
BCNYS.
10. It is proposed that the existing and new stairway will have a continuous 2-hour fire rating within the
enclosure to the exterior.

11. The local code enforcement official has been consulted in this matter and does not object to the
granting of a variance under the provisions of 19 NYCRR 1205.6.
CONCLUSION OF LAW
The proposed variance will not substantially adversely affect the Code's provisions for health, safety
and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would
entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be
unnecessary in light of alternatives which,without a loss in the level of safety,achieve the intended purpose
of the code.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from the 2020 Building Code of
New York State, Section 903.2.8, to allow an automatic sprinkler system to be installed in accordance
with Section 903.3 in only the R-3 occupancy portion of the building, be and is hereby PROPOSED TO
BE GRANTED with the following conditions:
1. That the new living quarters will be separated from the rest of the building with 2-hour fire rated
barrier wall and floor assemblies as per Section 707 of the 2020 BCNYS.
2. That that the new living quarters and exits therefrom, will have an automatic sprinkler system
installed as per NFPA 13D as permitted by Section 903.3.1.3 of the 2020 BCNYS.
3. That the existing stairway be reconfigured to meet the requirements for riser height and tread depth
as found in exception 3 of Section 1011.5.2 of the 2020 BCNYS.
4. That the existing and new stairway will have a continuous 2-hour fire rating within the enclosure to
the exterior.
5. That carbon monoxide detectors shall be installed on each level of the building as required by the
applicable provisions found in Section 915 of the 2020 Fire Code of New York State.
6. That the addition and alterations will meet all other applicable provisions of the Uniform Code.

Re: Site Plan Determination — 5645 Aldrich Lane Farm Labor Camp

Dear Mr. Kimack:
The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, November 7, 2022:
WHEREAS, this amended agricultural site plan is for a proposed 1,600 sq. ft. interior
conversion of the second floor of an existing storage area to a 10-person capacity Farm
Labor camp within an existing 2-story 10,000 s . ft, agricultural office and storage
building. The building is located on a 5-acre reserve area (SCTM1000-120.-3-11.13)
with existing accessory farm buildings attached to ±34.5 acres of farmland (SCTM1000-
120.-3-11.14) with Development Rights held by Southold Town in the AC Zoning
District; and
WHEREAS, on March 2, 2020, Michael Kimack, authorized agent, submitted an
Amended Site Plan Application for review; and
WHEREAS, on March 17, 2020, in a state of emergency response to the COVID-19
public health pandemic, the Town of Southold closed its offices to non-essential
employees including the Planning Department„ and
WHEREAS, on May 26, 2020, the Town of Southold re-opened its offices to non-
essential employees at 50% capacity; and
WHEREAS, at their work session on July 6, 2020, the Southold Town Planning Board
accepted the arnended site plan application as complete for review with certain
information to be submitted immediately; and

WHEREAS, on July 6, 2020, the Southold Town Planning Board, pursuant to State
Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that
the proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(3) agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land use
changes consistent with generally accepted principles of farming; and
WHEREAS, on July 16, 2020, Mike Kimack, authorized agent, submitted information as
required; and
WHEREAS, pursuant to Southold Town Code §280-133(C) and as detailed in work
session staff report on July 6, 2020, the Planning Board agreed to waive certain
application requirements of§ 280-133 for this application which involves uses strictly
related to agriculture (but excepting retail winery operations); and
WHEREAS, on August 24, 2020, the Planning Board, pursuant to Southold Town Code
§280-131 C., distributed the application to the required agencies for their comments;
and
WHEREAS, on September 14, 2020, a Public Hearing was held and closed; and
WHEREAS, on September 17, 2020, the Zoning Board of Appeals (ZBA) issued Special
Exception approval #7412SE for a Farm Labor camp for up to ten (10) seasonal
workers; and
WHEREAS, on October 16, 2020, the Southold Town Code Enforcement officer verified
that there were no open violations on the subject parcel; and
WHEREAS, on October 27, 2020, the Town of Southold Local Waterfront Revitalization
Program Coordinator reviewed the proposed project and determined it to be exempt
from the Southold Town LWRP policies with certain recommendations issued; and
WHEREAS, on November 4, 2020, the Southold Town Engineer reviewed the proposed
application and determined that the proposed plan meets the minimum requirements of
Chapter 236 for Storm Water Management; and
WHEREAS, on November 5, 2020, the Southold Town Land Preservation Committee
determined the proposed Farm Labor camp use as consistent with the Declaration of
Covenants & Restrictions pertaining to the residential use of the Reserve Area which
shall be limited to farm-related housing for use by farm employees and/or farm
managers and/or farm owners; and
WHEREAS, on November 9, 2020, the Southold Town Fire Inspector stated there were
no objections to the proposed site plan; and
WHEREAS, on November 11, 2020, the Mattituck Fire District determined that there
was adequate fire protection and access for the proposed action; and

WHEREAS, on November 13, 2020, the Agricultural Advisory Committee provided
comments supporting the proposed project for approval; and
WHEREAS, on December 18, 2020, the Southold Town Planning Board determined
that with exception of approval from the Suffolk County Department of Health Services
and a Use Certification from the Building Department, all applicable requirements of the
Site Plan Regulations, Article XXIV, §280— Site Plan Approval of the Town of Southold
have been met; and
WHEREAS, on August 13, 2021, the Southold Town Chief Building Inspector reviewed
and certified the proposed Farm Labor Camp as a use permitted by Special Exception
#7412SE in the A-C Zoning District; and
WHEREAS, on August 5, 2022, the Suffolk County Department of Health Services
(SCDHS) granted a wastewater permit for a Rooming House (10 Beds) @ 750gpd
Ref#C-20-0044; therefore be it

In addition, please be aware of the following Town Code requirements:

storm water run-off containment systems must be inspected by the Town
Engineer at the time of installation.
➢ Approved site plans are valid for eighteen months from the date of approval,
within which time all proposed work must be completed, unless the Planning
Board grants an extension.
➢ Any changes from the approved site plan shall require Planning Board approval.
➢ Prior to the issuance of a Certificate of Occupancy, the Planning Board must

The attached plan, when duly signed by a representative of the department, in conjunction with these
conditions, constitutes a permit to construct a water supply and/or a sewage disposal or collection system for
the property as depicted. The applicant should take note of any conditions of approval, which may be
indicated on the plan or enclosed herein. Construction must conform with applicable standards including
"Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other than
Single Family Residences." Omissions, inconsistencies or lack of detail on the plan do not release the
applicant from the responsibility of having the construction done in conformance with applicable standards.
Issuance of this permit shall in no way relieve the design professional of responsibility for the adequacy of
the complete design.
The permit (plan) expires three (3) years after the approval date. Any modification which may affect the
proposed sewage disposal or water supply systems requires submission of a revised plan and additional fees
(if applicable) for reapproval prior to construction. No inspections will be performed by the department on
expired permits.
Permits may be renewed, extended, transferred, or revised in accordance with the procedures described in
Instructions to Renew, Extend, or Transfer an Existing Permit for Other than Single Family
Residences (Form WWM-081).
It is the applicant's responsibility to call the department in advance to arrange inspections of the sewage
disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as shown on
the approved plans. In certain cases, inspections of the soil excavation may be required to determine the
acceptability of the soils for sewage disposal systems. The department must be notified at least 48 hours
in advance to schedule an inspection by calling 852-5754; and excavation inspections must also be
confirmed by calling 852-5700 prior to 9:30 a.m., the morning of the inspection. Article VII of the
Suffolk County Code, "Septic Industry Businesses," requires that all installers of septic systems within
Suffolk County shall possess a valid license from the Suffolk County Office of Consumer Affairs. This off ce
can refuse to perform inspections or grant final approval for the construction of projects that are installed
by an unlicensed individual. It is, therefore, in your best interest to utilize a cesspool contractor with a valid
license to avoid substantial delays in your project.
Final approval issued by the Department. is necessary prior to the occupancy of new buildings,
additions to existing buildings, or for the use of sewage disposal or water supply systems.

In your letter, you explain that the New York Department of State Building Code requires an automatic
sprinkler system installed throughout the proposed living quarters and that a two (2)hour load bearing
fire wall must be installed, all which required a reconfiguration of the approved plans. The revised plans
dated August 19, 2022, (sheets A-4 & A-6) prepared by Mark Schwartz, Architect, show newly
configurated two hour load bearing walls, two hour fire gated doors, fire bearing staircases, as well as the
addition of bathrooms on the first floor.
Since the amended improvements will maintain the Special Exception granted by the Board of Appeals
ZBA File No. 7412SE, I have dete.rnined that your request is de minimus in nature. Be advised that all
other conditions will still apply.

Dear Leslie:.
The above referenced ZBA file is the construction of living quarters for ten (10) farm
workers on the second floor of the existing building.
Under the State of new York dept. of State building code 19 NYCRR Part 1221, section
903.2.8 requires an automatic sprinkler system be installed throughout a Group R rated
building, which is the rating for the existing building. The majority of the building is storage
and the cost to sprinkler the entire building would be prohibitive. In addition, the property
does not have adequate water supply for the entire building.
As such, we applied for a variance to just provide a sprinkler system for the new proposed
living quarters, In order to receive a variance, a two (2) hour load bearing wall with 2 hour
fire rated doors, provide a new reconfigured staircase and fire rate both staircases.
The owner proposes to install a first floor mens bathroom with handicapped access and a
womens bathroom for handicapped access. The bathroom additions are not part of the
zoning variance for the second floor workers living quarters .
I have enclosed a copy of the State variance and two (2) prints of the revised A-4
architectural drawing for your review.
I respectfully request you issue a de minimus letter in that the proposed revisions were a
requirement of the Department of State variance requirements..

RELIEF- IL's _E,—KU;, : The applicant proposes to convert the second story of an existing metal
agricultural building into a"farm labor camp" as defined by Southold Town Code for sleeping and living
accommodations for up to Ten(10)members of the farm's Iabor force.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on September 3,2020 at which
time written and oral evidence were presented. Based upon all testimony,documentation,personal
inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the
following facts to be true and relevant and makes the following findings:
The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-
142 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in
adjacent use districts. The parcel is located in an agricultural district and is surrounded by properties
which are in agricultural use. Lots 11.13 and 11.14 are divided to indicate that the 34.3821-acre portion is
encumbered by a Town of Southold conservation easement while the smaller portion,4.9704 acres,retains
its development rights. The requested special exception will not change the principle use of the subject
parcel. According to the Town of Southold Land Preservation Coordinator,the two tax map nos. 11.13 &
11.14, depicted by a dotted line in the SCTM album, have been created only to identify the portion of the
property that have been encumbered by a Conservation Easement; 34.3821 acres. Technically,the subject
tract of land is identified as one lot and is depicted as a solid line surrounding both lots in the SCTM
album.
B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in
the district wherein the requested use is located or of permitted or legally established uses in adjacent use
districts. The construction of a farm labor camp within an existing agricultural building will not change
the use of the subject property or the exterior appearance of the building.
C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not
be adversely affected by the proposed use and its location. The proposed farm labor camp is not located
near a residential building.
D. That the use will be in harmony with and promote the general purposes and intent of this chapter. The
proposed farm labor camp is accessory to parcels in agricultural production. The easement portion of the
parcel surrounding the subject development portion is in agricultural production.

E. That the use will be compatible with its surroundings and with the character of the neighborhood and
of the community in general, particularly with regard to visibility, scale and overall appearance. The
proposed farm labor camp will be built in an existing agricultural building.
F. That all proposed structures, equipment and material shall be readily accessible for fire and police
protection.
G.That the proposal shall comply with the requirements of Chapter 236, Stormwater Management
In making such determination, consideration was also given to:
A. The character of the existing and probable development of uses in the district and the peculiar
suitability of such district for the location of any of such permitted uses.
B. The conservation of property values and the encouragement of the most appropriate uses of land. The
subject parcel is restricted by an agricultural conservation easement and the proposed farm labor camp will
help keep the parcel in agricultural use by providing housing for people who work on the farm.
C. The effect that the location of the proposed use and the location that entrances and exits may have
upon the creation or undue increase of vehicular traffic congestion on public streets,highways or
sidewalks to assure the public safety.
D. The availability of adequate and proper public or private water supply and facilities for the treatment,
removal or discharge of sewage,refuse or other effluent(whether liquid,solid, gaseous or otherwise)that
may be caused or created by or as a result of the use.
E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases,
odors,smoke or soot.
F. Whether the use will cause disturbing emissions of electrical discharges, dust, light,vibration or noise.
G. Whether the operation in pursuance of the use will cause undue interference with the orderly
enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or
by other competent governmental agencies.
H. The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to
the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner
of the plot sought to be used within or adjacent to the plot wherein the use shall be located.
I. Whether a hazard to life, limb or property because of fire,flood,erosion or panic may be created by
reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the
property or structures thereon for the convenient entry and operation of fire and other emergency apparatus
or by the undue concentration or assemblage of persons upon such plot.
J. Whether the use or the structures to be used therefor will cause an overcrowding of land or undue
concentration of population.
K. Whether the plot area is sufficient,appropriate and adequate for the use and the reasonably anticipated
operation and expansion thereof. The parcel is over 39 acres therefore there is ample space for
agricultural production as well as a farm labor camp.
L. Whether the use to be operated is unreasonably near to a church, school,theater,recreational area or
other place of public assembly.
M. Whether the site of the proposed use is particularly suitable for such use.
N. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties
and land uses from possible detrimental impacts of the proposed use.
O. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff,
sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate.

without undue disturbance or disruption of important natural features,systems or processes and without

BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Dantes,
seconded by Member Acampora, and duly carried to
GRANT, the Special Exception, as applied for, and on the architectural drawings prepared by Mark K.
Schwartz,Architect, labeled S-1, S-2,A-1,A-2&A-3;dated February 24,2020.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The Special Exception Permit granted herein may involve a change in occupancy or a change in use or
a change within a classification of the occupancy.Therefore,as a condition of approval,the applicant must
contact the Building Department to make the determination whether or not a Building Permit is required
and that changes will be NYS Code compliant.
2. This Special Exception Permit requires an operating permit and inspection by a Building Inspector
from the Building Department that must be renewed annually. lt_iwshe a afiggrif rgsmp nsibiljty to contact
the Building Department on an annual basis to schedule the required inspection.Failure to do so may
require a public hearing before the Zoning Board of Appeals to review potential action to revoke the
Special Exception Permit granted herein.
3. This Special Exception permit requires that the applicant complete construction on the farm labor
camp and begin the approved special exception use in compliance with the conditions imposed by the
Zoning Board of Appeals within three(3)years of the date of approval by the Zoning Board of Appeals.
4. In accordance with the Zoning Board of Appeals,approval shall thereafter be deemed a lawful use as
if the same were permitted by this chapter without need for a special exception permit;provided,however,
that:
a. All conditions imposed by the special exception approval shall continue to apply unless they,by
their express terms,are of limited duration.
b. All conditions imposed on special exception approval uses generally or specifically by this chapter
shall continue to apply,regardless of whether any such conditions were expressly incorporated into the
special exception approval.
c. The Zoning Board of Appeals shall retain continuing jurisdiction over the same;
d. The duration of a special exception use may be limited to a specified time period as set forth in the
approval of the Zoning Board of Appeals, if the approval is silent as to the duration of the special
exception use,then said use shall be in perpetuity;
e. A special exception use which has been discontinued for a period of one year or more shall be
deemed abandoned
5. The applicant must obtain site plan approval from the Planning Board. Failure to do so will render
this Special Exception Permit null and void.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.

NOTE.- Violations of Conditions. A violation of any limitation or condition of a special exception
approval or of any provision of this chapter applicable to a special exception use shall constitute a
violation of this chapter. The Zoning Board of Appeals shall retain jurisdiction and shall have the right,
after a public hearing, to modify, suspend or revoke such approval or any term or condition thereof or to
impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town Code.
