the first part, and
MARION WIPF,as Trustee of the Marion Wipf Trust Agreement dated October 19,2022,having an
address of 940 West Creek Avenue,Cutchogue, NY 11935,the party of the second part,
WITNESSETH,that the party of the first part, in consideration of Ten and 00/100—($10.00)—Dollars, and
other good and valuable consideration paid by the party of the second part,does hereby grant and release
unto the party of the second part,the heirs or successors and assigns of the party of the second part
forever,
All that certain plot,piece or parcel of real property,together with the improvements erected thereon,
situate,lying and being at Fleets Neck,near Cutchogue,Town of Southold,County of Suffolk and State of
New York,bounded and described as follows:
BEGINNING at a point on the westerly side of West Creek Avenue where the northerly line of land now or
formerly of Christopher Groocock intersects said westerly side of West Creek Avenue;running thence
along said the northerly line of land now or formerly of Christopher Groocock,South 72 degrees 24' 20"
West 202 feet to the ordinarily high water mark of Wickham's Creek;thence along said ordinary high
water mark on a tie line North 14 degrees 08' 20"West 88.79 feet to land now or formerly of Ronald
Barrett;thence along said land North 65 degrees 47' 50"East 226 feet to a concrete monument on the West
side of West Creek Avenue;thence along the westerly side of the West Creek, South 3 degrees 56' 20"
East 118 feet to the point or place of beginning.
TOGETHER with all the right,title and interest of the party of the first part of,in and to land below high-
water mark and under the waters of Wickham's Creek adjacent to said premises.
BEING AND INTENDED TO THE BE the same premises conveyed to the party of the first part and her
husband,Alexander C.Wipf by deed dated November 11, 1984 and recorded in the Suffolk County
Clerk's Office on February 13, 1985, in Liber 9734 Page 297.

TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and
roads abutting the above-described premises to the center lines thereof;TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.The word"party"shall be construed as if it read"parties"whenever the
sense of this indenture so requires.
