pouring of all foundation footings and they are 4 feet below grade.
At the westerly end of the deck, by the side platform, dirt was added to raise the platform
height to less than 18 inches.
I further certify that the existing railing system is safe for use and within code.

3. The variance granted herein is not substantial. The deck will maintain the existing 15 ft. side setback on

conforming lot in the R-80 District, is not permitted pursuant to Article XX1V Section 100-242A
which states[
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use, provided that such
action does not create any new non-conformance or increase the degree ofnomconformance
with regard to the regulations pertaining to such buildings."
The existing non-conforming single family dwelling, notes a single side yard setback of 15 feet.
Following the proposed addition, plans note a single side yard setback of 12 feet. Therefore, the
proposed addition/alteration is not permitted pursuant to Article HI, Section 100-32, which
states;
"No building or premises shall be used or no building or part thereof shall be erected or
altered in the A-C, R-80, R-120, R-200 and R-400 Districts unless the same conforms to
the Bulk Schedule and Parking Schedule incorporated into this chapter with the same
force and effect as if such regulations were set forth herein full."
Bulk schedule requires a single side yard setback of 20 feet.
