BOUNDARY AGREEMENT
AGREEMENT made this 1.1 day of October 2022 between isidoros Kordas and Jennifer
Kwon, owner of property known as 27 Sound Road Greenport, New York 11944 (Tax Map
Designation: Section: 035.00; Block: 01.00; Lot: 004.007) ("Owner"), and Santo Pantane, owner
of property known as 485 Sutton Place Greenport, New York 11944 (Tax Map Designation:
Section: 033.00; Block: 05.00; Lot: 006.00) ("Adjoining Owner").
WITNESSETH
WHEREAS, Owner is the owner in fee simple of 27 Sound Road Greenport, New York 11944
(Tax Map Designation: Section: 035.00; Block: 01.00; Lot: 004.007) ("Owner's Property") and
Adjoining Owner is the owner in fee simple of 485 Sutton Place Greenport,New York 11944
(Tax Map Designation: Section: 033.00; Block: 05.00; Lot: 006.00) ("Adjoining Owners
Property"), both parcels situate in Suffolk County and State of New York; and
WHEREAS, the parties desire to fix and definitely establish the boundary line between the two
parcels mentioned above respectively owed by them.
WHEREAS at the time of the survey a rock wall existed which has since been removed (as
shown on the attached survey) a "high boulder wall" (the "High Boulder Wall") which
encroaches upon the Owner's Property up to 12.3 feet south of thesoutherly lot line of
Adjoining Owner's Property;
WHEREAS said High Boulder Wall is also encroaching upon the Adjoining Owner's Property
up to 4.6 feet north of said southerly line of Adjoining Owner's Property;
NOW THEREFORE, in consideration of the premises and of the sum of one dollar by each of
the parties hereto to the other in hand paid, the receipt of which is acknowledged, the parties, for
themselves, their successors and assigns, covenant and agree that said High Boulder Wall may
remain undisturbed, for as long as it shall stand (unless removed by Owner or Adjoining
Owner's election); and Owners agree by reason of this agreement that they will make no claim to
the fee of that portion of land upon which said High Boulder Wall is located north of the
southerly line of the Adjoining Owners Property; and Adjoining Owners agree by reason of this
agreement that they will make no claim to the fee of that portion of land upon which said High
Boulder Wall is located south of the southerly line of the Adjoining Owner's Property;
WHICH said southerly line (the`Boundary Line") is shown on the survey of Alphonse Pesce,
Jr., dated August 23, 2022, ("Survey") attached herein as "Exhibit A", which is intersected at
points by the High Boulder Wall.
AND Owner revises, releases and quitclaims to Adjoining Owner and its assigns forever right,
title and interest in and to any land lying to the north of the Boundary Line so established and,
Adjoining Owner revises, releases and quitclaims to Owner and its assigns forever right, title and
interest in and to any land lying to the south of the Boundary Line so established.
AND that any erections in the exact position as the existing driveway/curb is presently located
will not affect the boundary lines as set forth herein, and on the survey nor create an event by
which an adverse possession claim can be made.
Owner and Adjoining Owner mutually agree and covenant that this Boundary Line Agreement
shall run with the land and shall be binding on and inure to the benefit of the successors in
interest of the parties and the parties to record this Boundary Line Agreement in the Suffolk_
County Clerk office.
IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall run with the land
and be binding upon and ensure to the benefit of the successors in interest of the parties.
IN WITNESS WHEREOF, the parties have set their hands and seal on the day and year written
above.
