WHEREA~, applicat~ on has been duly made to the Town Super~
intendent of Highways of the Town of Southold, in the County of
Suffolk ami State of New York, for the laying out of two certain
toga highways to be known as
MADISON ~TR~. and WI~MARTH AVENUE (EXTENSION)., and
Wti~EA~, GEORGE W. SMITH is the owner of the premises to be
dedicated as hereinafter provided, and
a~e the only persons, firm or corporation having any interest in
the lands through ~hich the highways are proposed to be opened,
NOW, THER~O~E, the said GE.0RGE W. SMITH and
in consideration of the sum of ONE ($1e00) DOLLAR, to each of them
in hand paid, by HAROLD PRICE, Town Superintendent of Highways of
the Town of Southold, the receipt whereof is hereby acknowledged,
and in further consideration of the laying out of two new highways
at Greenport, in the Town of Southold, Suffolk Co~ty, New York, to
be known as
MADISON STg~WT and WILMARTH AVENUE (EXTENSION),
DO HEREBY DEDICATE, RELEASE AND CONVEY TO THE SAID TOY OF SOUTHOLD,
~or highway purposed, the following lands, to wit:-
MADISON ST~k-S~T
arJ. that tract or parcel of land situate, lying and being
north of the Village of Greenport, in the Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:-
BEGINNING at a concrete monument set on the southerly line
of North Road 210.0 feet easterly along said southerly line from
its intersection with the easterly line of Middleton Road (said
point being about 800 feet westerly from the westerly line of Main
Street); running thence 5 courses, as follows:
(1) South 13 degrees 53 minutes 20 seconds East, 225.0 feet to a
concrete monument; thence
(2) South 6 degrees 17 minutes 40 seconds East, 151.33 feet to a
concrete monument; thence
(3) South 13 degrees 53 minutes 20 seconds East, 150.0 feet to a
concrete monument; thence
(4) South 21 degrees 29 minutes 00 seconds East, 151.33 feet to a
concrete monument; thence
(5) South 13 degrees 53 minutes 20 seconds East, 165.60 feet to a
concrete monument set on the northerly line of a proposed highway
to be known as "Wilmarth Avenue (Extension)"; running thence North
87 degrees 36 minutes 50 seconds East, 50 feet, or more, to a con-
crete monument set on the easterly line of the premises herein
described and the northerly line of said "Wilmarth Avenue (Extension)";
running thence in a northerly direction along said easterly line of
"Madison Street" the following 5 courses:
(1) North 13 degrees 53 minutes 2Q seconds West, 179.10 feet; thence
(2) North 21 degrees 29 minutes O0 seconds West, 151.33 feet; thence
(3) North 13 degrees 53 minute'sS) seconds West, 143.36 feet; thence
(4) North 6 degrees 17 minutes 40 seconds West, 151.33 feet; thence
(5) North 13 degrees 53 minutes 20 seconds West, 227.44 restate a
concrete monument set on said southerly line of the North Road; thence
along said southerly line, 2 courses, as follows:
(1) South 77 degrees 57 minutes 30 seconds West, 25.28 feet; thence
(2) South 76 degrees 14 minutes 20 seconds West, 24.73 feet to the
point of beginning.
ALL that tract or parcel of land situate, lying and being
north of the Village of Greenport, in the Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:-
BEGINNING at a point on the northerly line of the premises
herein described at the southwesterly corner of "Madison Street"
(which point is marked by a concrete monument); running thence
South 8? degrees 36 minutes 50 seconds West, 142.87 feet to an
iron pipe set at the easterly terminus of an "un-named highway" as
shown on "Map of Fleetf£&~d," filed in the Suffolk County Clerkts
Office as Map No. 1351; running thence across the easterly end of
said "un-named highway" South 13 degrees 53 minutes 20 seconds
East, 51.02 feet to an iron pipe and the easterly terminus of the
southerly line thereof; rmmuing thence North 8? degrees 36 minutes
50 seconds East, 245.99 feet to a concrete monument and the westerly
terminus of Wilmarth Avenue as heretofore laid out in August, 1930);
running thence across tie westerly end of said Wilmarth Avenue as
heretofore lald out, North 4 degrees 01 minute 30 seconds West~
50.02 feet to a concrete monument and the westerly terminus of the
of the northerly line thereof; running thence South 87 degrees
minutes 50 seconds West, 60.84 feet to a concrete monument set at
the southerly terminus of the easterly llne o£ ~M~xlison Street");
r,,hning thence across the southerly line of"Madison Street" 50 feet
or more to the point or place of beginning.
AND the said ~E0~E W. SMITH, and
do hereby release said Town from all damages by reason of the laying
out of the said above described new highways,

this Dedication and Release this 27th day of July , 1954.

jAYS WITH THE CONSENT
~ TEE TOWN BOARD.
~AND ORDER, that two town highways shall be, and the same are hereby
laid out in said Town as fellows, and are to be known as "MADISON
~TREET" and "WI~MAP~H AV~2~UE (EXT,:NSION)", each of which shall be
fifty feet in width:-
MADISON STREET
ALL that tract or parcel of land situate, lying ~d being
north of the Village of Greenport, in the Town of Southold~ County
of Suffolk and State of New York, bounded and described as follows:-
BEGINNING at a concrete monument set on the southerly line
of North Road 210.0 feet easterly along said southerly line from
its intersection with the easterly line of Middleton Road (said

ORALAPPLICATION having been duly made to me the Town
Superintendent of Highways for the Town of Southold, Suffolk County,
New York, for the laying out of two certain Town Highways, in the
said Town of Southold, by GEORGE W. SMITH and others, liable to be
assessed for highway taxes in said Town, and the written consent
of the Town Board of said Town having been given as prescribed by
law, and a dedication and release from damages having been executed,
acknowledged and delivered b2 the owners of the l~ds through which
the proposed highways are proposed to be lald out, a copy of which
is hereto annexed, and nothing having been paid to any claimant
for such damages,
NOW, THERE~0RE, I, the Town Superintendent of Highways of
the Town of Southold, Suffolk County, New York, DO HEREBY DETERMINE
(1) South 13 degrees 53 minutes 20 seconds East, 225.0 feet to a
concrete monument; thence
(2) South 6 degrees 17 minutes 40 seconds East, 151.33 feet to a
concrete monument; thence
(3) South 13 degrees 53 minutes 20 seconds East, 150.0 feet to a
concrete monument; thence
(4) South 21 degrees 29 minutes 00 seconds East, 151.33 feet to a
concrete monument; thence
(5) South 13 degrees 53 minutes 20 seconds East, 165.60 feet to a
concrete monument set on the northerly line of a proposed highway
to be known as "Wilmarth Avenue (F~xtension)"; running thence North
87 degrees 36 minutes 50 seconds East, 50 feet or more to a con-
crete monument set on the easterly line of the premises herein
described and the northerly line of said "Wilmarth Avenue (~xtension)"~
running thence in a northerly direction along said easterly line of

point of beginning.
WILMARTH AVENUE (EXTE~SION)
AL~ that tract or parcel of laud situate, lying and being
north of the Village of Greenport, in the Town of Southold, County
of Suffolk sad State of New York, bounded and described as follows:
BEGINNING at a point on the northerly line of the premises
herein described at the southwesterly corner of "Madison Street"
(which point is marked by a concrete monument); running thence
South 87 degrees 36 minutes 50 seconds West, 142.87 feet to an
iron pipe set at the easterly terminus of an "un-named highway" as
shown on "Map of Fleetfield," filed in the Suffolk County Clerk's
Office as Map No. 1351; running thence across the easterly end of
said "un-named highway" South 13 degrees 53 minutes 20 seconds
East, 51.02 feet to an iron pipe and the easterly terminus of the
southerly line thereof; running thence North 87 degrees 36 minutes
50 seconds East, 245.99 feet to a concrete monument and the westerly
terminus of Wilmarth Avenue as heretofore laid out in August, 1930);

CONSENT OF TOWN BOARD
UPON READING AND FILING the dedication and release of
GEORGE W. SMIT~, dated July 27th , 195~, and duly acknowledged,
dedicating and releasing the necessary lands for two certain pro-
posed town highways to be known as "MADISON STPJ~wI'" and "WILMARTH
AVENUE (EXTE~$ION)", be it
RESOLVED, that Consent be and the same hereby is given that
the Town Superintendent of Highways of the Town of Southold, make
an order laying out the aforesaid Town Highways to consist of the
lands described in the said dedication and release and to extend
as delineated upon the map annexed to the application, all in
accordance with the provisions of Section 171 of the Highway Law
of the State of New Yorke

EF~EBY CERTIFY to the TOWN OF SOUTHOLD, a municipal corporation
having its principal offices at Southold and at Greenport, in the
Town of Southold, Suffolk County, New York, that I have examined
the title to the premises described in a certain DEDICATION AND
RELEASE executed by George W. Smith and dedicating to said Town
of Southold two certain highways to be known as MADISON STREET, and
WI~MARTH AVENUE (EXTE~SION), which dedication and release is
dated and executed on July 27, 195~, and the premises described
in a certain deed of even date executed by George W. Smith to said
Town of $outhold, conveying an irregular parcel of land fronting
on said Wilmarth Avenue Extension, and I DO FURTHER CERtiFY THAT
upon the basis of examination of the records of the Suffolk County
Clerk's Office, the Suffolk County Treasurer's Office, and the
Suffolk County Surrogate's Office, that the title to the aforesaid
premises is vested in GEORGE W. SMITH in fee simple free from all
encumbrances, and that he has good right to dedioate and convey
the same ·
