LAY OUT
TOWN HIGHWAYS
TO THE SUPERINTENDENT OF HIGHWAYS OF THE
TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK:
The undersigned, Bayview Land Corp., a domestic
corporation with an office at 347 Glen Cove Ave., Sea
Cliff, NY, liable to be assessed for highway taxes in the
Town of Southold, hereby apply to you to lay out highways
in said Town known as Long Creek Drive, Park Avenue and
Pond Avenue as more particularly described in the annexed
dedication and release.
Hereto annexed and made a part hereof is
showing the courses of said proposed highways.

of new highways at Southold, Town of Southold, to be known
as Long Creek Drive, Park Avenue, Pond Avenue, Recharge
Area #1 and Recharge Area #2 do hereby consent that such
laying out be made in accordance with said application.

DEDICATION AND
RELEASE OF LAND
WHEREAS, application has been duly made to the Town
Superintendent of Highways of the Town of Southold, in the
County of Suffolk, New York, for the laying out of certain
town highways through the lands of the undersigned,
NOW, THEREFORE, Bayview Land Corp, a domestic
corporation with an office at 347 Glen Cove Ave, Sea Cliff,
NY, do hereby dedicate, release and convey to the Town of
Southold, a municipal corporation, with its principal
office at Main Road, Southold, County of Suffolk, State of
New York, for highway purposes, the following lands, to
wit:
See Schedule A annexed hereto.
The Town of Southold is hereby released from all
damages by reason of the laying out of said highways.
This dedication and conveyance is made in the regular
course of business actually conducted by the undersigned.

WRITTEN application having been duly made to me, the Town
Superintendent of Highways for the Town of Southold, Suffolk
County, New York, for the laying out of Town Highways in the
said Town of Southold by Bayview Land Corp., liable to be
assessed for highway taxes in said Town, and a dedication and
release from damage having been executed, acknowledged and
delivered by the owners of the land through which the proposed
highways are proposed to be laid out, and copy of which is
annexed hereto, and nothing having been paid to any claim for
such damages:

entitled, "Subdivision Map of Long Pond Estates, Section One, situate at
Southold, Town of Southold, County of Suffolk, State of New York", and
filed in the Suffolk County Clerk's Office on December 27, 1985 as Map No.
8037, together with release executed by the owners thereof; and
WHEREAS, the Southold Town Highway Superintendent has inspected the
aforesaid highways and has advised the Town Board that said proposed
highways comply in all respects with the specifications for the dedication
of highways in the Town of Southold; now, therefore, be it
RESOLVED that in accordance with Section 171 of the Highway Law of the
State of New York, consent be and the same is hereby given to the
Superintendent of Highways to make an order laying out the aforesaid
highways, to consist of lands described in said application as shown on
certain maps attached to said application; and be it further
RESOLVED that the Town Clerk be and she hereby is authorized and
directed to forthwith cause the dedication, release and deed to be recorded

Gentlemen:
A final inspection of this project was conducted on 12/7/88 and we
find that the following items must be addressed:
1)
Remove plastic covers under catch basin and leaching pool
covers and clean drainage system, as required (i.e. south side
of Pond Avenue at intersection of Park Avenue) see SBB letter
dated 8/16/88.
2) Swale areas were disturbed due to tree planting work, and must
be top dressed, graded and reseeded.
3) Stop sign and street sign must be installed at ~n[ersection of
Park Avenue and Pond Avenue. (These signs were in place at
the last inspection 8/15/88, but are now missing.)
We recommend that the items on the list above be remedied before
the bond is released..

Dear Sir:
An inspection to ascertain the completion of the remedial work
reflected in SBB letter dated 6/12/89, "final inspection" was conducted
on 8/8/89.
We find that the following items have to be completed:
1. Pavement replacement has been completed joints must be
sealed.
2. Mowing of the R.O.W. was in progress, but the vegetation in
the flow line and at curb joints haq not been addressed.

Plastic covers have been broken, or ripped, which will impede
storm water entry to the- drainage structures. These plastic
coverings must be completely removed.
We recommend that the developer notify the Planning Board upon
completion of these items and another inspection be scheduled.

& Kimberly Lane, the Dedication and Release and Deed were transmitted
to the Chicago Title Company, Riverhead, for recording on September
21st. A copy will be transmitted to you as soon as I receive it back.
With respect to Long Creek Drive, Park Avenue and Pond Avenue,
etc., the last correspondence I have is a letter to you, dated September
19th,. from Assistant Town Attorney Berntsson stating the roads have not
been approved by Superintendent of Highways Jacobs. I will send him
a copy of your letter so he will be up to date on the status of this matter.

to the above. Just for clarification, I have approved the dedication
papers from a legal standpoint, however, I am not aware that the roads
have been approved by the Superintendent of Highways. Until that is done,
the Town Board will not act upon the offer of dedication.

Dedication of Roads and Recharge Area in Subdivision known as
Lon9 Pond Estates. Section One (Bayview Land Corp.)
I have reviewed the legal documents in regard to the above-referenced
matter. There was one error on the first page of the description of the
roads. Attached is a copy of the letter from the attorney in this matter
along with the corrected page 1 of Schedule A. The correction should be
made each place the description is found, which I believe to be the
"Dedication and Release", the Certificate of Title by Peerless Abstract
Company and the Deed.

I am in receipt of your letter of August 4, 1989, re the
above. The park and recreation area is not intended for dedica-
tion. We seek to dedicate only the roads ~n~ Recharge Area #1 and
#2. As to the Recharge Areas #1 and #2, I enclose a copy of filed
map from which the metes and bounds description on the propoccj
deed was created.
Finally, I have reviewed the "as built" survey and the filed
map and I am forwarding herewith a revised description correcting
the typographical error that you pointed out in your August 4th
letter.
I would apprecipate you expediting your review and clearance of
the dedication as this matter was first forwarded to the Town two
months ago and we are anxious to conclude it in a timely matter
