Telephone SO 5-2660 MINUTE~ Southold Town Board of Appeals June 2~ 1960 A regular meeting of the Southold Town Board of Appeals was held 7.:30 P.F~, Thursday, June 2, 1960 at the Town Clerk Offices Main Road, Southold~_ New York. There were present: Messrs. Robert W. G illispie,. Jr.., Chairman~ Robert Bergen~ Herbert Rosenberg~ and Charles Grigonis, Jr. Absent: Mr- Serge Doyen,, Jr. Also present: Mr. Howard F~ Terry, Building Inspector. PUBLIC ~ARING: 7:30 P.M. (E.D.S.T.),P Appeal No. 279 - Upon application of Mattituck Merchants Association, Love Lane,: Mattituck~ New York,. for a special exception in accordance with the Zoning Ordinanc e~_ .Article III~ Section 300~ Subsection 114 for permission to erect and maintain a directional sign on the property of Mrs. Hull Chew, Southeast side of Main Road, Mattituck, New York. No fee required. Southold Town Board of Appeals -2- June 2, 1960 The Chairman opened the hearing by reading application for a special exception,~ legal notice of hearing and affidavit attesting to its publication in the official newspaper. The letter of permission from the property owner was also read. T~E C~IRMAN: Is there anyone present who wishes to speak for this application ? MP~ ALVIS J. LUTZ, Mattituck~_ New York: Th.e purpose of this sign is more or less explained in the application. Love Lane iS off Route 25 and strangers passing through will not readily see it unless it is called to their attention. With that in mind we wish to ask for a sign pointing out the shopping center so people will know what to look for. What will be the wording on the sign? MP~ LUTZ: Blinker." "Mattituck Shopping Center, Turn Left At The T~E CHAIRMAN: Have you specified in 'the application what the size of the sign will be? MP~ LUTZ: It is 4 ft. by 8 ft~ It has scotch lite on it so that it can be seen with the headlights. CHAIRMAN: The letters will be painted on? MP~ TERRY: The sign is painted but the letters are scotch lite reflectiv.e paint. THE CHAIRMAN: Is there anyone else present who wishes to speak for this application? M~. TERRY: I think it is essential to the village because of the actual location off t~e beaten path and it needs something to attract the shoppers attention to the area. \ THE CHAIRFa~N: Is there anyone present who wishes to speak against this application? (There was no response.~ Southold Town Board of Appeals -3- june .2, 1960 Resolution was offered by Mr. Bergen~ seconded by Mr. Grigonis and carried~ WHEREAS application of Mattituck Merchants Association having been considered at Public Hearing No. 279 on June 2~ 1960, and the Board finding that the public convenience and welfare and justice will be served and the legally established or perm~hed use of neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be obs.erved~, therefore be it RESOLVED that the application be granted as applied permitting-the erection of a 4 ft. by 8 ft? direction sign by the Mattituck Merchants Association with the words "Mattituck Shopping Center,.. Turn Left at the Blinker~'' on the property of M_rs. ~ull S. Chew~ southeast side Main Road, Mattituck~ New York. Sign to be no higher than 15 ft. 6 in. from the ground level, lower .edge shall be no closer than 3 ft. to the ground level~ and sign is to be located no closer than 5 fto to any property line. This permit will be revoked for cause. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Roser~erg, and Mr. Grigonis~ PUBLIC HEARING: 7:35 P.M. (F~D.S.T.)~ Appeal No. 280 Upon application of Mattituck Merchants Association~ Love Lane~.. Mattituck, New York,~ for a special exception in accordance with the Zoning Ordinance, Article III~. Section 300~_ Subsection for permission to erect and maintain a directional sign on the property of Miss Caroline Bell, south side Hamilton Avenue (County Route 27A)., Mattituck, New York. No fee required. The Chairman opened the hearing by reading application for a special exception~ legalnotice of hearing and affidavit attesting to its publication in the official newspaper. The letter of permission from the property owner was also read. THE CHAIRMAN: Is there anyone present who wishes to speak for this application ? M~. LUTZ: I would say the same applies to this as the previous one. The shopping center is off Route 27A and not visible to strangers passing through. Southold Town Board of Appeals -4- June 2~ 1960 MP~- TERRY~ Th/s is also off the main road and they need some type of identification, M~ LUTZ: There are two highways. THE CHAIRMAN: Will you be putting a sign to the east of town? MR. LUTZ: That may be in the future. It will depend on our finances. Right now we feel we need to alert the people coming from the west, THE CHAIRMAN: Is there anyone present who wishes to speak against this application? (There was no response.) Resolution was offered by F~r. Bergen~ seconded by Mr, Rosenberg and carried~..WHEREAS application of Mattituck Merchants Association having been considered at Public Hearing No. 280 on June 2, 1960 and the Board finding that the public convenience and welfare and justice will be served andthe legally established or permitted use of neighborhood property will not be substantially or permanently injured and the spirit of the Ordinance will be observed~ therefore be it RESOLVED that the application be granted as applied permitting the erection of a 4 ft~ by .8 ft. directional sign by the Mattituck Merchants Association with the words "Mattituck Shopping Center, Next Right Turn" with an arrow incorporated in the sign~ on the proper ty of Miss Caroline Bell, south side Hamilton Avenue (County Route 27A)~. Mattituck~ New York. Sign to be no higher than 15 ft. 6 in, from the ground level, lower edge shall be no closer than 3 ft. to the ground level, and sign ~S to be located no closer than 5 ft. to any property line. This permit will be revoked for cause. Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen, Mr. RoseD_berg~ and Mr. Grigonis, The minutes of the mee~/~g*o~ May 19,~ 1960 on motion of Mr. Grigonis, seconded by Mr. Rosenberg and carried~ were approved as submitted. Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen, Mr. Rosenberg~. and Mr. Grigonis. South01d Town Board of Appeals -5- June 2, 1960 The minutes of the meeting of May '26, 1960 on motion of Mr. Grigonis~ seconded by Mr. Rosenberg,~ and carried, were approved as submitted. Vote of the Board: Ayes:- Mr, Gillispie, Mr. Bergen, Mr. Rosenberg, and Mr. Grigonis, The Building Inspector advised the Board that Mr. John J, Klein, Jr. had called the office and advised he does not wish to apply for a special exception at this time, After the building is constructed he will apply for a special .exception to put a sign on the side of the building above the window. On motion of Mr. Rosenberg~ seconded by Mr. Bergen~ and carried~ it was RESOLVED that the Board of Appeals forward a letter to. Supervisor Tuthill requesting that arrangements he made to return to Mr. John J, Kleiner. Jr~ ~._ Main Road & Bay Avenue,. Mattituck~. New York,~ his $15,00 fee- for application for Special Exception No. 278 dated May 16~. 1960. On June 1~ 1960 Mr. Klein requested that this appeal be withdrawn prior to its presentation to the Board of Appeals. Vote of the Board: Ayes:- Mr.. Glllispie~. Mr. Bergen,. Mr. Roser~berg~. and Mr. Grigonis, The Board received a letter from Walsh,,_ Aarons~ Salonger & Fleishaker~ 33 West 42nd Street~ New York 36~. New York stating that their client James C. Whelan wishes to sell land to Peter E. Bruno at New' Suffolk, A copy of the deed description was attached to the letter and they wish to ascertain whether there are any zoning regulations against the building of a one-family house on the plot of land. On motic~ of Mr, Gillispie,,_ seconded by Mr. Bergen, and carried~, it was RESOLVED that the aforementioned letter be referred to Mr, Terry~. Building Inspector~ for reply to. Mr. Aarons, Vote of the Board: Ayes:- Mr, Gillispie~.. Mr. Bergen~ Mr. Roseberg~ and Mr. Grigonis. Southold Town Board of Appeals -6- June 2, 1960 The Chairman advised the members that the Greenport Rotary Club had extended an invitation to the Board of Appeals to be present at their meeting Thursday noon~ June 94 1960. It was decided all members would attend. The Board replied to the letter from Howard Terry~ Building Inspector requesting an interpretation of the Zoning Ordinance, Article X~ Section 1003A as it pertains to commercial labor can%ps. As stated to Mr. terry over the telephone~. Mr. Gillispie stated that Counsel takes the position that this camp is essentially a "non-farm" commercial labor camp, Further; that application for a special exception for such a coma~rcial camp is properly made only in a. "business" zoner since he considers the camp to be in the nature of an accessory use for a business, namely~ the commercial grading of potatoes. bit.
