THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON JULY 23, 1996:
WHEREAS, Peconic Properties Management, Inc. has made application to the
Town Board of the Town of Southold to dedicate certain roads in Southold,
New York, to be known as "JASMINE LANE", "APPLE COURT", and
"BLOSSOM LANE", as shown on subdivision map entitled, "Map of Southold
Villas", filed in the Office of the Clerk of the County of Suffolk on August
4, 1993 as Map No. A-434, together with release executed by the owner
thereof; and
WHEREAS, the Southold Town Superintendent of Highways has inspected
the said highways and has advised the Town Board that said proposed
highways comply in all respects with the specifications for the dedication
of highways in the Town of Southold; now, therefore, be it
RESOLVED that in accordance with Section 171 of the Highway Law of the
State of New York, consent be and the same is hereby given to the
Superintendent of Highways to make an order laying out the aforesaid
highways, to consist of lands described in said application as shown on
certain maps attached to said application; and be it
FURTHER RESOLVED that the Town Clerk be and she hereby is authorized
and directed to forthwith cause the dedication, release, and deed to be
recorded in the Office of the Clerk of the County of Suffolk, New York.

INC. dated May 14, 1995, for laying out of new highways at Southold, Town
of Southold, to be known as JASMINE LANE, APPLE COURT and BLOSSOM
LANE, do hereby consent that such laying out be made in accordance with said
petition.

York, and included within which land are proposed highways known as

entitled matter dated May 18, 1995;
NOW THEREFORE, in consideration of One ($1.00) Dollar to us in
hand paid by Raymond L. Jacobs, Superintendent of Highways of Said
Town of Southold, and in further consideration of laying out of the
new highways known as JASMINE LANE, APPLE COURT and BLOSSOM LANE do
hereby release and dedicate to the Town of Southold all the land
heretofore owned by us within said proposed highway as follows:
1. The highways are known as JASMINE LANE, APPLE COURT and
BLOSSOM LANE, as shown on a certain map entitled "Map of Southold

As per your request, I have inspected the above referenced subdivision. My last '
inspection, dated 4/27/95, was to be the final inspection prior to dedication. I have
enclosed a copy of this report for your reference. As of this date, the condition of the roads
have not changed and they are considered to be acceptable for dedication.
The street lights within the subdivision will also need to be accepted by the Town.
Once the Town has accepted the street lights, L.I.L.C.O. will be asked to energize the
lights.
The original name proposed for the main road entering the subdivision was Orchard
Lane. Because this name was a duplication of other roads in Southold, the name was
changed to Jasmine Lane.

Dear Ray:
As per your request, I have conducted a final inspection of
the above referenced subdivision, The remaining construction items
required for completion of the road system within this subdivision
have been completed.
The Street Lights have been installed and only require the
final connections to be made by L.I.L,C.O, The Street Trees that
the Planning Soard wanted moved have been relocated accordingly and
the sidewalks have been installed to meet the minimum requirements
of the Town Code, The areas on both sides of the new sidewalk have
been graded and re-seeded, The flow line between the curbing and
the asphalt pavement has been treated with a herbicide to kill the
grass that has started to grow,

The documents recently submitted for Jasmine Lane finally show that the
title to the roadway is free of mortgages. However, there were three
concerns stated in my last review memorandum of July 7, 1995, and the
other two have not been satisfied.
The Town Code requires a survey map and six sets of plans for review by
the Town Engineer. You should see if he is still awaiting this
information.
I had also asked for a deed showing a metes and bounds description of the
property. I am willing to waive thls requirement and go with the
description based on the recorded map, if the missing maps pose no
problem. However, if the applicant has to submit additional maps, I would
suggest that we get a revised deed with the metes and bounds description.

They include an Application for Dedication, Dedication and Release, Title
Report and Deed. The documents which must be submitted for road dedication
are listed in Southold Town Code A108-50. I have the following comments:
1. The code requires submission of a survey map and six sets of plans
showing that the roads are in conformance with highway specifications. This
information was not provided, and the Town Engineer indicates that he needs
these documents. Without these documents, it is difficult for me to evaluate
the accuracy of the legal description in the Title Report.
2. The Title Report indicates that the roads are covered by two mortgages.
The Town will not accept dedication of the roads unless they are transferred
free and clear of such encumbrances.
3. The Deed does not contain a metes and bounds description of the property
being transferred. Since such a description is included in the Title Report, I
would llke to have the Deed use the metes and bounds description.
Please advise the applicant of these comments so that the deficiencies may be
corrected.
