THIS INDENTURE, made thisc~daY of December, 1983, by and
between DONALD A. DENIS, 84 Meadow Road, Riverhead, wILLIAM W. ESSEKS,
(no %) Bay Woo~s, Aquebogue, New York, BENNETT STARK, 3 Stark Drive,
Center Moriches, New York, parties of the first part, and the TOWN OF
SOUTBOLD, a municipal corporation of the State of New York, having its
principal office at (no %) Main Road, Town Hall, Southold, New York,
party of the second part=

WHEREAS the parties of the first part are the owners of

Suffolk, State of New York, known as "Map of Inlet View Estates", which
~.said map was prepared by Young & Young, filed in the Suffolk County
Clerk's Office on May 1, 1975, as Map No. 6249~ and
WHEREAS the parties of the first part are desirous of
dedicating, conveying and granting to the party of the second part
certain portions of said map, to wit=
(1) a drainage area with an easement for ingress and
egress and for installation and mainteance of storm sewers as located
south of lot # 10~ and
(2) a certain easement for installation and maintenance
of storm sewer and for natural drainage~
NOW THEREFORE, in consideration of one dollar ($ 1.00) and
other good and valuable consideration paid by the party of the second
part, receipt of which is hereby acknowledged, the parties of the

transfer, and convey to the party of the
Drainage Area with Easement for
Ingress and Egress and for
Installation and Maintenance of
Storm Sewer to this Area, all as

Maintenance of Storm Sewer and
Natural Drainage, all as
further described on Schedule
annexed hereto,
to have and to hold said easement, right and interest with respect to
the premises described in Schedules "A" and "B" unto the party of the
second part, its successors and assigns forever.
The parties of the first part, on behalf of themselves, their
successors and assigns, covenant and agree as follows=
The party of the second part, as Grantee herein, shall have
the right to construct, alter, maintain, remove and replace any and all
drains and other structures and improvements existing upon the premises
described in Schedules A" and "B", together with the free right of
ingress and egress over and across such property, insofar as such right
of ingress and egress is necessary to the proper use of any other right
granted herein, upon the condition that the party of the second part
shall, in the due exercise of the rights created hereby, exercise due
diligence and reasonable care.

WHEREAS, application has been duly made to the Town

of Suffolk, and State of New York, for the laying out of a certain
Town highway to be known as "INLET VIEW EAST", and extending in a

APPLICATION having been duly made for the laying out of
a Town highway in the Town of Southold, Suffolk County, New York,
to be known as "INLET VIEW EAST", and extending in a southerly
direction from the southerly line of Harborview Avenue, and a de-
dication and release from the owners of the lands through which
the highway is sproposed to be opened, having been given;
NOW, THEREFORE, I, the Town Superintendent of Highways
of the Town of Southold, Suffolk County, New York, do hereby de-
termine and order that a Town highway, to be known as "INLET VIEW
EAST" shall be, and the same hereby is laid out, in said Town as
follows:

assessed for highway taxes therein, hereby apply to you to lay out
a highway in said Town to be known as "INLET VIEW EAST", and
extending in a southerly direction from the southerly line of
Harborview Avenue, said proposed highway being described as
follows, to wit:

situate, lying and being in the Town of Southold,
County of Suffolk, and State of New York, known

CONSENT OF
TOWN BOARD
UPON READING AND FILING the application of DONALD A.
DENIS, WILLIAM W. ESSEKS and BENNETT STARK, dated the~{~ day of
March, 1978, and the dedication and release of DONALD A. DENIS,
WILLIAM W. ESSEKS and BENNETT STARK, dated the~day of March,
1978, and duly acknowledged, dedicating and releasing the neces-
sary lands for a proposed highway to be known as "INLET VIEW EAST"
to extend in a southerly direction from the southerly line of
Harborview Avenue through lands of the said DONALD A. DENIS,
WILLIAM W. ESSEKS and BENNETT STARK, said proposed highway being
more fully described in the above mentioned application and dedi-
cation and release.
RESOLVED that in accordance with the provisions of
Section 171 of the Highway Law of the State of New York, consent
be and the same hereby is given that the Town Superintendent of
Highways of the Town of Southold make an Order laying out the
aforesaid Town highway, the said Town highway to consist of the
lands described in the said dedication and release and to extend
as delineated upon the map thereto annexed, and it is further
RESOLVED that the Town Clerk be and he hereby is
directed to forthwith cause such release to be recorded in the
office of the Clerk of the County of Suffolk and, upon its return,
to attach it hereto.

Made an inspection of remaining work on August 6, 1985 as requested
by Mr. J. Hirsh ~ho is doing the work. At that time the remedial
work as recor~mended was underway but not completed. Advised him to
contact the Planning Board vhen the corrective work was finished.
August 13, 1985
Inspection today indicated that the work mentioned in Report No. 441
has been satisfactorily completed.
I recommend that the road system be considered for dedication.

Dear Mrs. Terry:
I have reviewed report no. 441 of Mr. John Davis
and agree with his findings.
Upon completion of the minor corrective work, I

has dragged along pending the resolution of title questions. The title
questions have now been remedied and I am enclosing herewith the
dedication papers consisting of the following:

2. Application to Lay Out Town Highway.
3. Proposed Order to Lay Out Town Highway.
4. Proposed Consent of the Town Board.
5. Letter of April 28, 1982 from the Assessors as to the assessed

Dear Ms. Terry:
Donald Denis, Bennett Stark and I are the owners of the
subdivision known as Inlet East Estates and are now ready to
dedicate the road in said subdivision, known as Inlet View
East, to the Town of Southold.
I enclose herewith the following documemts for that purpose:
1. Dedication and Release
2. Application to lay out town highway
3. Order laying out town highway
4. Consent of Town Board
5. Special search of Equity Abstract for the purpose
of street dedication.
Please review the enclosed documents and advise me whether or
not the Town of Southold needs any additional documents. I
have written to the Town Assessors with regard tothe statement
from that office to the effect that the improvements abutting
the proposed highwa~at least in the amount of $40,000.00 per
mile of highway.
I also enclose herein a copy of part of the subdivision map which
shows the road in question.

Present couditio~ of road ~ drainage re dedication
This road system ¢onslsts of a single road 650 ft. ± in length, 36 ft.
in width with 6" eoncrete curbs and a 100 ft. diameter turnaround
cludad in the length. The road construction is typical Tomm requirement
for pulvermix bas~ with a stone chip surface. There is a drainage ease-
ment south of the turnaround.
The road pavement is in good condition with exception of three potholes
at the entrance and two small pavement breaks in the turnaround.
Curbing on the east side is free from weed growth throughout. Curbing
on the west side and half way around the turnaround has weed growth
and other vegetation for widths of from two to four feet on the pavement.
There are three catch basins, two at the entrance and one at the turn-
around. All catch basins are clean to pipe inverts or lower.
The drainage area (small recharge basin) in the drainage easement is
overgrown with so~e brush and a few small trees. The chain llnk fence
and gate around the recharge basin is intact and in good condition.
The intake pipe under the fence and outfall pipes through the dike that
forms the west side of the R.B. appear to be working.
In my opinion the only corrective work necessary at this time to ~ake
the road acceptable for dedication would be to fill the few potholes
with asphalt mix and clear the pavement at curbs on the west side and
at the turnaround. I do not think the present growth in the recharge
basin is detrimantal.

were acquired by the Town.
Our search reflects the 1985/86 taxes are unpaid on both
parcels. In checking with the Real Property Agency, I find that
the deeds were recorded on October 2, 1985, therefore, after the
June 1st taxable status date for the 1985/86 taxes. Even though
the deeds were issued before, I was informed that I must go by
the recording date. ~
Since the properties did not transfer to the Town until
after the taxable status date, the Town would be responsible for
the taxes.
