New York 11971, whic.h said corporation is liable to be
assessed for highway taxes in the Town of Southold, hereby
applies to you to lay out certain tewn highways, as described
on a conveyance of said highways a copy of which is attached
hereto and hereby made a part hereof.
The said proposed highways will pass through the
lands of H.J.S. Land and Development Corp. which said
corporation does hereby consent to the laying out of said
described highways and to the development and use of them.

UPON READING AND FILING the application of H.J.S.
Land & Development Corp., a corporation organized under and
existing by virtue of the Business Corporation Law of the
State of New York, having its principal office at Middle Road,
Greenport, New York, by its Vice President, Frank Sturm, dated
and acknowledged August 1st, 1974, and the dedication and release
of H.J.S. Land & Development Corp., by its Vice President,
Frank Sturm, dated and acknowledged August 1st, 1974, dedicat-
ing and releasing lands for proposed town highways as follows:
ALL those certain roads located near Greenport,
Town of Southold, County of Suffolk and State of New York,
known and designated as Inlet Pond Road, Green Hill Lane,
and Homestead Way as shown on Map of Section Five, Eastern
Shores at Greenport, filed in the Office of the Clerk of the
County of Suffolk on December 31, 1968 as Map No. 5234.
RESOLVED that, in accordance with the provisions
of §171 of the Highway Law of the State of New York, consent
be and the same hereby is given that the Town Superintendent
of Highways of the Town of Southold make an order laying
out the aforesaid town highways, the said town highways to
consist of the lands described in the said dedication and
release and to extend as delineated upon the said maps, and
it is further
RESOLVED, that the Town Clerk by and he hereby
is directed to forthwith cause such release to be recorded
in the office of the Clerk of the County of Suffolk and upon
its return, to attach it hereto.

ORDER
Application having been duly made for the laying
out of town highways in the Town of Southold, Suffolk County,
New York described as follows:
ALL those certain roads located near Greenport, Town
of Southold, County of Suffolk and State of New York, known
and designated as Inlet Pond Road, Green Hill Lane, and Home-
stead Way as shown on Map of Section Five, Eastern Shores at
Greenport, filed in the Office of the Clerk of the County of
Suffolk on December 31, 1968 as Map No. 5234.
And a dedication and release from the owner of the lands
through which the highways
been given:
NOW THEREFORE,
are proposed to be opened having
I, the Town Superintendent of
Highways of the Town of Southold, County of Suffolk, New York,
do hereby determine and order that town highways shall be and
the same are hereby laid out in said Town in accordance with
the description set forth on the deed copy conveying said lands
which is attached hereto and hereby made a part hereof.
These described highways are 50 feet in width at
all points and are constructed in compliance with the
regulations of the Town of Southold in such matters.

have revised the proposed dedication papers of H.J.S.
to provide for a continuous loop of road to avoid the
cul de sac difficulty. The deed, release, application
and survey reflect this change.
As suggested, I also enclose a letter signed
by Charles Morgan, Treasurer of H.J.S. Land & Development
Corp mentioning two additional construction jobs now almost
completed which are located on the described roads.
Will you kindly present these papers to the
Board at the coming meeting after your approval thereof.

area as shown on surveys attached hereto which are "MaD of Eastern

Re: Dedication of Moore's Lane North and Portions of Inlet
Pond Road, Westwood Lane and Homestead Way
Dear Sir:
I have examined the documents which you sent me with respect to the dedication
of the above highways and have the following comments to make relative thereto.
(1) The dedication papers propose to dedicate all of the roads shown on the map
of Section III of Eastern Shores. That portion of Inlet Pond Road lying east of the
northerly extension of the easterly line of Moore's Lane North should be excluded
and that portion of Homestea~ Way lying east of the easterly line of Moore's Lane
North should be excluded as both portions of these highways would be dead ends
and sbovld not be Included nnless a 100 foot turn around is provided.
(2) The map shows the sourtherly portions of Westwood Lane and Moore's Lane
and all of Homestead Way as being owned by J. M.S. Land and Development
Corporation. Itowever, the application and dedication and release are only
executed by H. J. S. Land and Development Corporation.
(3) The title report should, I believe, certify title in both corporations and
franchise taxes with respect to both corporations should be removed.
(4) The release of lien of part of mortgaged premises purports to release two
mortgages held by the North Fork Bank and Trust Company. A separate release
i~ required for the release of each mortgage (see Section 321, subdivision 3 Real
Property- Law).
~5) Map of Section II Eastern Shores shows a parcel of land bounded northerly by
Lot 67~ easterly by Westwood Lane, Southerly by Homestead Way and westerly by
land of Speeches which is designated on the map as "Reserved for Dedication to the
Town of Southold'. I am advised by Van Tuyl that this is a swamp area and is to
be used for highway drainage purposes. Accordingly0 this parcel should be conveyed
to the Town for highway drainage purposes.
