IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,and these presents to be subscribed by a majority of the said Board as of the day and year first above written. & 4,- TIMIA,11 TERMS AND CONDITIONS The Permittee Joel B Singer,residing at 20575 Soundview Avenue Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said-Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. SINGER 20575 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-4-11 Dear Mrs. Moore: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 15, 2023 regarding the above matter: WHEREAS, Patricia Moore, Esq., on behalf of JOEL B. SINGER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 23, 2023, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 15, 2023, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of JOEL B. Page 2,August 18,2022 #7661,Singer SCTM No. 1000-51-4-11 RELIEF REQUESTED: The applicant requests variances to 1) construct a swimming pool 71 feet from the top of the bluff where code requires a 100 foot minimum bluff setback; 2) Construct a new accessory garage with a side yard setback of 15 feet,9 inches where town code requires a minimum side yard setback of 20 feet,and to permit the construction of a bedroom and full bathroom with shower in the second floor loft of the proposed garage where town code does not permit bedrooms or full bathroom in accessory structures unless the homeowner applies for a special exception to establish a legal accessory apartment that is approved by the Board of Appeals based upon documentation verifying compliance with the code requirements for such use. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on August 11,2022 submitted a plan that is dated January 2021 that shows a proposed VA septic system,pool equipment,pool backwash leaching pool,and adds an outdoor shower to the proposed garage. The revised plan does not bring the plan into more conforming with the code. ADDITIONAL INFORMATION: The applicant has submitted multiple proposals for the scope of work on this project. The Architectural plans by Charles W. Kuehn show the scope of work being to add an accessory garage and in ground swimming pool. During the hearing the applicant stated that the owner is not working on the frame dwelling at this time and is only applying for the proposed work in the accessory garage and in-ground swimming pool at this time. The proposed habitable space in the garage is to be used when the dwelling cannot be occupied during improvements.' The Board members advised the applicant that if the dwelling is demolished, in accordance with Town Law(50%or more of value),that an application to the ZBA would be required if the applicant proposed the reconstruction of the dwelling Iess than the permitted 100 feet from top of bluff. In response,the applicant stated that demolition has not been considered. The applicant has a Coastal Erosion Management Permit from the Southold Town Board Trustees dated March 23, 2021 which allowed the installation of additional 150 ton of 1-to-3-ton rock as armoring at base the base of the eastern section of the bulkhead,among other improvements to the subject property shown on the site plan prepared by Costello Marine Contracting stamped approved on March 18, 2021. The New York State Department of Environmental Conservation (NYSDEC) issued permit #1-4738-01561/00007 dated August 9, 2021. The permit identifies an area of severe erosion and it permits the applicant to reset and install armoring at the base of the eastern section of the bulkhead; reset any existing dispersed rock at the western section of the bulkhead(rock armoring not to exceed 2.5 ton per linear foot), vegetate the top of the bluff and any disturbed areas along bluff face with native plantings; all as depicted on the site plan by Costello Marine Contracting Corp., stamped approved on March 18, 2021. In support of the application,the applicant submitted ZBA Appeal#5427 dated December 4,2003. In this decision, the ZBA granted approval for an as-built deck setback 10 feet from the top of the bank. This decision occurred prior to the hurricane event known as Superstorm Sandy on October 22, 2012, which did substantial damage along Soundview Drive. The Board of Trustees and the NYSDEC now identifies this parcel and neighboring parcels as areas experiencing severe bluff erosion. Accessory uses in accessory structures: Article III. Section 280-13(C) does not Iist bedrooms or full bathrooms as an accessory use which is permitted in accessory structures;nor is a bedroom a customary use in an accessory garage structure. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: i j r . Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of waterfront properties developed with single family homes. Site inspection and Suffolk County GIS ariel photos show that many of the residences in the neighborhood are less than the code conforming 100 feet from the top of the bluff. However, these residences are older residences and the parcels have faced substantial coastal damage from storms over the years. Accessory structures with non-conforming bluff setbacks and non-conforming side yard setbacks are not characteristic of this neighborhood. The proposed garage loft bedroom is not a permitted use in,an accessory structure pursuant to the Southold Town Code. 2. Town Law$267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Architectural drawings show that the applicant has a code conforming building envelope to build an accessory garage and in-ground swimming pool. The applicant could build an accessory garage with a code conforming side yard setback and without a nonconforming habitable use. 3. Town Law §267-b(3)(b)(3). The variances denied herein for the in-ground swimming pool bluff setback is mathematically substantial,representing 29%relief from the code. The variance for the non-conforming accessory garage side yard setback is mathematically substantial representing 21% relief from the code. The variance denial of overturning the notice of disapproval for the non-conforming bedroom in an accessory structure is a request for a use variance and represents a request for 100% relief from the code 4. Town Law&267-b(3)(b)(4). Evidence relating to permits from the New York State Department of Environmental Conservation and Southold Town Board of Trustees files suggest that a variance to construct an accessory structure closer than 100 feet from the top of the bluff in this residential community may have an adverse impact on the physical or environmental conditions in the neighborhood,as well as evidence accumulated by these agencies relating to Superstorm Sandy and other storm occurrences. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law§267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage and swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
