SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II
category of the State's List of Actions, without an adverse effect on the environment if
the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 9,411 sq. ft. parcel has 99.93 ft.
frontage along the north side of Middle Road in Mattituck and is improved with a
dwelling.
BASIS OF APPLICATION: Building Department's January 23, 2003 Notice of
Disapproval, citing Section 100-244, in its denial of a building permit to construct a new
dwelling at less than 35 feet from the rear lot line and less than 25 feet for both side yard
setbacks.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 15, 2003,
at which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Originally, applicant wished to construct a
new 30' x 65' dwelling, replacing the existing trailer. The setbacks were proposed at 32
feet from the front property line (facing Middle Road or C.R. 48), 10 ft. side yard at the
northeast corner, 14 ft. side yard at the southwest corner, and rear yard at 32 feet, at its
closest points, as shown on the November 9, 1999 survey, revised January 21, 2003,
prepared by Joseph A. Ingegno, L.S. The applicant agreed to modify the plan,
withdrawing the need for relief in the front and side yard setbacks, and moved the
location to conform to the front and side yard code requirements, but increasing the
necessary relief in the rear yard from 32 feet to approximately 29 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Grant of alternative relief will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. During the public hearing, the

applicant was asked (and agreed) to move the new (unordered) modular home to a front
yard conforming setback of 35 feet and rear yard setback of 29 feet. Also, the applicant
was asked to place the home parallel to C.R. 48 thereby having conforming side yard
setbacks of 10 ft. and 15 ft. This removed the nonconformity in the front and side yard
setback location.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The lot is nonconforming is size
and the shape is at an angle facing a major highway (C.R. 48). The depth of the house
at 30 feet is reasonable for a new home.
3. The alternative relief granted is not substantial in that a six ft. reduction in the rear
yard is within keeping to similar established homes in the area, and on similar sized
parcels.
4. The difficulty is self-created in that the applicant purchased the property with a house
trailer and attached garage, but due to severe deterioration and wear of the trailer
structure, the applicant is forced to rebuild.
5. No evidence has been submitted to suggest that the proposed new dwelling will have
an adverse impact on physical or environmental conditions in the neighborhood.
6. Grant of alternative relief is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Member Orlando, and duly carried, to
DENY the relief requested as to the front and side yard setbacks, and to
GRANT Alternative Relief for a rear yard setback at 29 feet.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that may violate the Zoning Code, other than such uses,

setbacks and other features as are expressly addressed in this action.

and Chapter 100 (Zoning), Code of the Town of Southold, the following public
hearing will be held by the SOUTHOLD TOWN BOARD OF APPEALS at the
Town Hall, 53095 Main Road, P.O. Box 1179, Southold, New York 11971-0959,
on Thursday, May 15, 2003, at the time noted below (or as soon thereafter as
possible):

county road went through°

MRS. YOUNG: It was always that angle. By.looking at the map~
you can see were some of the property was taken off. The lots were
I25 ft. in depth, and are 99 fto in depth now.
There was a general discussion about the county takingproperty~
how much property they take~ and what price they pay for it.
Mrs. Young also explained that she had a customer that'would
only buy these lots if it can be used as two lots.

The Board finds after investigation and inspection of this
property~ that the difficulties noted are primarily a result of
the county taking approximately 2~ of the northerly area of lots,

which were legal size prior to the new road constr'Uction~ and agrees
with the reasoning of the applicant.as to'the unusua! and unique
hardshipwhich would be created by requiring this parcel 'to be
considered as one lot. Accordinglyit is our opinion that ~he division
asoutlined in the application is a fair solution and that the effect
will not materially change the character of the neighborhood.
The Board finds that strict application of the Ordinance will
produce practical difficulties or unnecessary hardship; the hardship
created is unique and would not be shared by all properties alike
in the immediate vicinity of this property.a and in the same district;
and the variance does observe the spirit of the Ordinance and will
not change the character of the district.
