No. 5359`—JOHN and KATHLEEN AHEARN Southold Tows Clerk Property Location: 480 Dawn Drive, Greenport; CTM 35.-5-13 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' property contains 15,662 sq. ft. of land area with 100 feet along Dawn Drive. The property is improved with a one-story, single-family dwelling and swimming pool structure, both located as shown on applicants' April 29, 2002 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: Building Department's April 29, 2003 Notice of Disapproval, citing Sections 100-242A and 100-244, in its denial of a building permit application to construct a porch addition to the dwelling due to insufficient side yard setbacks and lot coverage in excess of the code limitation of 20% of the lot area. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 15, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a porch consisting of a permanent roof over a portion of the proposed deck addition behind the dwelling. The setbacks for the proposed porch area will remain as applied in ZBA Appl. No. 5086 rendered May 16, 2002 at 9'6" on one side and 10 ft. on the opposite (northerly) side, at its closest points, and at a maximum of 23.8% lot coverage. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The granting of these variances will not produce an undesirable change in the character of the neighborhood, or be a detriment to nearby properties, because the applicants seek to construct a covered porch, with an approximately 450 sq. ft. increase in the building foot-print to this single family residence. In a prior application, #5086, this applicant was the granted variances necessary to construct a deck of identical size and placement in Page 2—June 5,2003 Appl. No.5389—J.and K.Ahearn 35.-5-13 at Greenport relation to the existing building. The addition of a roof (and a possible future screen enclosure) to the previously approved construction will not create any detrimental changes to the neighborhood. • 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance, because in the prior application #5086, the applicants requested variances to build a deck, not a porch, without a full understanding of the code definitions between the two structures. The applicants acknowledged, and are requesting relief from the condition contained in the prior approval of the board which stated: "That the deck remain open to the sky." 3. The requested relief is not substantial because the only area affected by the granting of the new variances is the same footprint area granted Appl. No. 5086. Total lot coverage will remain identical to the prior relief approved, which is 23.8%. 4. The proposed variances will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood, or district because of the small scale of such proposal. 5. The difficulty for the applicants is self-created by a previous misunderstanding of Town Code. 6. The relief offered to this applicant is the minimum determined necessary for this applicant to enjoy the benefit of a covered porch, while at the.same time protecting and preserving the character of the neighborhood, as well as the health, safety, and welfare of the surrounding community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to GRANT the Variance as applied for and shown on the plan as highlighted for the porch area, with the only intent of this board to remove and withdraw Condition No. 3, and subject to same Conditions No. 1 and No. 3 rendered in Decision of application #5086, repeated and rewritten as follows: • 1. That the side setbacks shall be no closer than 9'6" on one side and 10 feet on the opposite (northerly) side, at its closest points; and Page 3—June 5,2003 Appl. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. We engaged an architect (Paid $800) in anticipation of building a deck with fixed shade cover/roof. CURRENT DILEMMA: Included in the Variance Approval is a provision that the deck be"open to the sky". This provision has effectively stopped the entire project from proceeding and we are hereby requesting that it be removed as a condition of your resolution. Our plans are, otherwise, in compliance. The reason for the disapproval is that this expansion would bring our lot coverage to 26% and have a single side yard setbacks of 9 feet and total side yard setbacks of 18 feet. The disapproval cites Article XXVI Section 100-244 which states that non-conforming lots under 20,000 square feet in total size,require a single side yard setback of ten(10) feet, a total side yard setback of twenty-five(25)feet and no more than twenty(20) percent lot coverage. It should be noted that our residence is skewed on the property lines so that in measuring total setbacks,the measurement is taken from the front of the house on one side and the back of the house on the other side. If the measurement was taken at either the total front of the house or total rear of the house,the total setback would be greater than twenty-five feet. The single side setback of this expansion would be nine feet--one foot outside the ten foot requirement. The deck expansion would not encroach on our neighbors property on either the right or left of the house. The nearest structure on either of these properties is over one hundred feet away. There is no building at all on the rear property line and the nearest building is over 300 feet away from the rear property line. The reason that we are requesting this expansion is to allow for quicker and safer access to a bathroom in our home for children using our backyard swimming pool. Currently, access is through the middle of the house or through a grass entryway. We would obviously like to improve the bathroom access with this expansion. As to the twenty percent lot coverage requirement,this expansion is primarily in the rear of the house and does not intrude on the sight lines or access of nearby homes or property. The expansion of the deck will be at the same level as the existing deck and will provide needed additional deck space. The reason that we are requesting this expansion is to allow for quicker and safer access to a bathroom in our home for children using our backyard swimming pool. Currently, access is through the middle of the house or through a grass entryway. We would obviously like to improve the bathroom access with this expansion. As to the twenty percent lot coverage requirement,this expansion is primarily in the rear of the house and does not intrude on the sight lines or access of nearby homes or property. No. 5086—JOHN and KATHLEEN AHEARN. Property Location: 480 Dawn Drive, Greenport ; CTM 35.-5-13. BASIS OF APPLICATION: Building Department's January 14, 2002 Notice of Disapproval, under Zoning Code Sections 100-242A and 100-244B, for the reason that applicants' construction of a deck addition at the rear of the house does not meet the side yard minimum of 10 feet on one side and 15 ft. minimum on the other side, and which exceeds the 20% lot coverage code limitation. AREA VARIANCE REQUESTED: Applicants request a Variance for deck additions to the existing dwelling. The original request for 9'6" and 9' sides was reduced by the applicants, and confirmed by written confirmation onrMay 6, 2002 from the applicants, for alternative relief, to 9'6" and 10' minimum side setbacks, and maximum 23.8% lot coverage, instead of 25.4 or 26% lot coverage. There is a 6 +- ft. wide addition shown at the north side of the dwelling, and rear addition at the west side of the dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicants' property contains 15,662 sq. ft. of land area with 100 feet along Dawn Drive. The property is improved with a one-story, single-family dwelling and swimming pool structure, both located as shown on applicants' April 29, 2002 survey prepared by Peconic Surveyors, P.C. ADDITIONAL INFORMATION: The applicants amended their lot coverage request of 23.8% (or 3724 total square feet) of building area. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safetwand welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. No evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of the additions, while preserving and protecting the character ofthe neighborhood and the health, safety, and welfare of the community.
