No. 5247 —JOAN LANGEMYR Southold Town Clerk Street and Location: 770 Oak Drive, Cutchogue 1000-104-6-12.1 PROPERTY FACTS/DESCRIPTION: Applicant's property is located on the south side of Oak Drive in Cutchogue. The property contains a total area of 30,649.56 sq. ft., identified on the Suffolk County Tax Maps as 1000-104-6-12.1 13. Existing is a one-story wood frame dwelling 45.7 feet from the front property line facing Oak Drive, as shown on the August 26, 2002 survey prepared by Stanley J. Isaksen, Jr., L.S. BASIS OF APPLICATION: Applicant's August 12, 2002 request for a merger determination, by way of a building permit application to locate a new dwelling, was denied by the Building Department on August 12, 2002, for the reason that CTM Lot 12.1 has,merged with an adjacent lot to the east (1000-104-6-13) pursuant to Section 100-25, and the lots have been held in common ownership during a period of time after July 1, 1983. APPLICANT'S REQUEST: Applicant requests a Waiver of Merger, pursuant to Article II, Section 100-26, to unmerge CTM #13 with 15,131.09 sq. ft. in area and 112.53 ft. in width along Oak Street, from CTM #12.1 with 15,518.47 sq. ft. in area and 125.04 ft. in width. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this matter on April 17, 2003, at which written and oral evidence were presented. Based on all testimony, documentation, personal observations of members of the board, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. The title search prepared by Chicago Title Insurance Company and Alexandra A. Bossung dated October 10, 2002, indicates that CTM #13 was acquired by Joan Langemyr and her husband, Roy Langemyr, from Emile A. Vibert and Marion S. Vibert, by deed dated 6/15/1970 recorded at Liber 7308 page 592. At the hearing it was noted by the applicant's attorney that CTM #12.1 was acquired by Langemyr from Ellis Hyers and Helen K. Hyers by deed dated 6/11/1977, recorded in Liber 8260, page 204 on 6/29/1977. The adjacent land, The Viberts owned CTM #13 since 1961. The Hyers owned CTM #12.1 since 1963. 2. On 1/2/1973 Roy Langemyr died, and as a result, CTM #13, improved with a dwelling, became merged with vacant CTM #12.1. 3. Grant of a waiver of merger will not result in a significant increase in the density of the neighborhood or district containing single-family dwellings. The grant of this waiver will provide for future construction of not more than one dwelling with single-family occupancy. SS)? Grant of a waiver of merger would recognize a lot that is consistent with the size of lots in the neighborhood. The neighborhood and district is well-developed with single-family residences, and consists almost exclusively of older lots that do not conform to the R-40 (40,000) minimum for this zone district. The 15,518.47 sq. ft. size of the vacant lot (CTM 12.1) in question is equal to some, and smaller than others, but it is clearly consistent with the average size of lots in the neighborhood and district. 5. The waiver will avoid an economic hardship for the owner. 6. Waiver of merger will allow for construction of one single-family dwelling on original deeded lot, which will not result in a significant increase in the density of the neighborhood. There will be no need for significant change in its contours or slopes, and no evidence was presented to suggest that the lot would require filling affecting nearby environmental or flood areas, or to suggest that its natural details, character, contours or slope would be significantly altered in any manner. 7. The waiver would recognize the original lot lines as set forth in the 1963, and earlier deeds, for CTM #12.1. BOARD RESOLUTION: NOW, therefore, on motion by Chairwoman Tortora, seconded by Member Goehringer, it was RESOLVED to GRANT the Waiver of Merger, as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. " | � / � S, 0 say?� VO RIDER TO APPLICATION FOR WAIVER UNDER SECTION 100-26 APPLICANT' S REASON: 2O3r Your applicant, purchased Tax Lot 13 (SCTM #1000-104-6-13) on June 15, 1970 along with my husband, Roy Langemyr and we received a deed dated that day which was recorded in the Suffolk County Clerk's Office on December 21, 1972 in Liber 7308 Page 592 (Exhibit 1) . The purpose of the purchase was to build. a retirement home for the both of us . The house was built and a Certificate of Occupancy No. Z4973 was issued on January 12, 1973 (Exhibit 2) . Unfortunately, my husband died on January 21, 1973 so he did not get to enjoy this home (Exhibit 3) . In 1977, your applicant purchased as an investment the adjacent vacant Tax Lot 12 . 1 (SCTM #1000-104-6-12 . 1) to the west of my residence . I received a deed dated June 11, 1977 which was recorded in the Suffolk County Clerk' s Office on June 29, 1977 in Liber 8260 Page 204 (Exhibit 4) . In planning ahead, it was your deponent ' s intention in purchasing this land to hold this parcel as a separate parcel so in the future it could be sold and I would have sufficient monies from the sale to enable me to pay the bills to stay in my residence . Recently, I intended to place Tax Lot 12 . 1 on the real estate market for sale, but I was told by the Building Department this lot cannot be sold as a separate parcel because it has been merged with Tax Lot 13 . For all of the years I have owned these properties I .never was aware the two lots were merged into one as I always received two tax bills (Exhibit 5) . The decision to merge the two lots by the zoning code into one lot is unfair and will result in causing your applicant to have a severe financial hardship as your applicant will not be able to afford to remain in her current residence . The vacant lot currently has a fair market value of approximately $150, 000 . 00 . However, if this lot was merged with your applicant ' s other property, it would only add approximately $50, 000 . 00 to the value of the house parcel resulting in a loss of $100, 000 . 00 (Exhibit 6) . Therefore, your applicant is requesting the Southold Town Zoning Board of Appeals waive this lot merger and recognize the original lot lines that existed before the merger. It is expressly submitted the granting of this waiver of merger by allowing one additional residence will not result in any significant increase in the density of this neighborhood. Further, the granting of the waiver would be in recognition that the two lots each consisting of 15, 000+ square feet are consistent with the general overall lot size of a great many of the lots in this particular neighborhood. The vast majority of the lots is in neighborhood which is known as the "Mason Development" are all undersized by the zoning standards of today. The contours and the slope on this lot will not be changed or altered in any manner as the land is level so there will be no need to provide any fill . Applicant proposes to unmerge the properties, referred to as 900 and 770 Oak Drive, Cutchogue. CHAIRWOMAN: Is someone here who would like to speak on behalf of the application? MR. LARK: Me again. As you know from the application this is a waiver of merger application as time goes on I think we are going to see less and less of these hopefully in the town. I have with me here today the applicant Joan Langemyr and her neighbor Curtis Horton who lives basically right next door to her who's familiar with all of the background of the property in the neighborhood in fact he owned a portion of the property one time himself way back when as you can see from the single and separate search that you have. I'd like to hand up for the record at this time a couple of things that will make some sense as we go on. The first one Mrs. Langemyr I'll give to the clerk got no objections from all of her neighbors with the exception of Mr. Slavin who Mr. Horton refers to later just enter that into the record. So that you have some understanding of this neighborhood I don't think you have it I made a photocopy which was going to be a filed map and then it subsequently did not turn out but it's called the mason development of which this property is part of and I'll put that in as A then there's exhibit B I'll put a current tax map of that basically most of that subdivision and which is south of Bay Ave. and then portions of the map and Nassau Farms on the tax map which is north of Bay Ave. you'll see that so when I'm referring to it and those 2 last exhibits I've highlighted what the applicants property which is the southerly portion and I've highlighted some property in Nassau Farms which is called_the Slinko property and I'm going to be referring to that in fact I'll do it right now so as to avoid any confusion. Thatko property which as the crow flies is about 600'north of the subject property. He bought an appeal on March 6 of 1996 appeal #4363 he gave a waiver of merger to those lots for Shako and under almost a very similar fact pattern that we have in Ms. Langemyr's case. There in the Senko the husband and wife purchased the smaller lot which was 15857 sq. ft. back in the 70's built the house and then subsequently bought a vacant lot which was next door to them which was 20200 sq. ft. and then let it sit in about 1981 when upzoning Os, was going on in the town lot recognition and things started to come in they transferred the property from husband and wife to the husband and it stayed that way until about 1990 (2/1.‘ when the husband got poor legal advice he was sick and elderly he transferred the vacant land to his wife and promptly died 2 weeks later. A couple of years later the estate went to sell the house and was told naturally no CO's so they had to get an updated CO because it was done prior to zoning and the BD told them the lots were merged and the state had a contract to sell the property and the purchaser did not want to buy the vacant lot. The vacant lot had a little bit of a kettlehole in it, the depression in the back and wanted no part of it wouldn't pay any more money. Similarities of the 2 applications are . d, Page 43 of 73 6o Gr -fftm aR. feu)lel ini Page 44 April 17, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing when you look at both of the maps areawise the lots are all by today's standards under the zoning are small and they are very similar to the mason development which is south of Bay Ave. to the Nassau Farms development which is north of Bay Ave. in fact when the Sanko application the lots range from 10720 sq. ft. to 39700 sq. ft. and the vast majority of them are under 20000 sq. ft. so to Joan Langemyr's development the interior lots, the smallest one is 92050 sq. ft. and the average of all the internal lots there are 14900 sq. ft. so it's very close the similarities of the 2 areas Mr. Horton will speak to you in a moment but apparently these properties were about 90% developed all by about 1970-which I did not know and that's one of the reasons all the lots are consistent size and under the 20000 sq. ft. so then in the appeal before you I won't dwell on the application because I think that has all the facts into it, but basically she Mrs. Langemyr purchased her lot with her husband, they built a home and then subsequently he died she bought the adjacent lot for herself right next door and it sat ever since that time. One of the requirements is you know to get a waiver of merger is the economics in the Sanko case the board was confronted with a contract of sale of a small house lot alone of 115K and they had an appraisal on the smaller lot for 63K so the economic hardship if they didn't grant the merger to the Sanko estate was 63K you have before you in your package the appraisal that was done at the time of the application for the vacant lot as it stood of 150K and the improved lot where her house is from 425 to 450 but the interesting thing is the appraisal found that if it was one lot it would only add up to about 50K increase in value to the overall parcel as one so if she doesn't get this thing unmerged she tends to suffer under that appraisal regime about $100K loss so it is significant to her. It's submitted in both cases that all the criteria are met. The Sanko case there was no significant increase in the density there would be possibly one more house in this situation here there would be one more house so that requirement of having the significant and also the land in this case is all basically level if you go see the property it's just basically almost tabletop it's flat whereas in the Seiko piece the vacant lot had a little bit of a kettlehole in the back but there was sufficient room to move the house front on the upper portion to build another house there so the board didn't have any difficulties with it but when you consider all the issues for a waiver of merger this application falls squarely within it. The last ingredient the maps in front of you Ms. Tortora point out that what's being asked for here is no different that everybody else has in the neighborhood. I wanted to buy that property in case I couldn't afford my house that I would build a little swiss chalet on the adjacent piece of property and I scraped to get the money to buy it at that time just being a single person and Mr. Slade approached me and said you have 25' you do not need and said he'd like to buy it and at the time I didn't want to sell it you like to be friends with your neighbors and I said fine. So he purchased the 25' and I had said to him before we'll share the lawyers expenses and he said fine. When that came to be and I told him how much it was he said he never told me that he would do that so I took on the full responsibility of paying the lawyers fees so I never associated with him thereafter and that's probably why he's objecting and I just wanted you to know that. But as far as this I did this a single person for my retirement and then when I was going to build the house I checked all the prices it would cost more to build a little 4 room house than the house I was already in so I said I'll keep this as part of my retirement package and that's what I did now it feels like the town has stolen the property from me and I never received a notice I get 2 bills and Mr. Horton alerted me to it he said I think your property has been merged so I checked it out and the fellow said no it's unmerged. Let me check he came back and said no it is merged. CHAIRWOMAN: It's been 1 lot for 25 years. MS. LANGEMYR: I figured I'd better see a lawyer I spent $3K for new surveys and whatever else because this is really my retirement as a single person. I worked 43 years for Prudential. I live I sold the house to them originally I own the land right next door and in front of it. The reason this piece of land what we call Mason Development was supposed to be subdivided, legally subdivided the plans were files but in the meantime the masons come along and sold all the lots. 'The lots on the water are all 70' lots the lots where Joan and I live and everything else are all 75' lots. Some were bought and put together right in the beginning there's one lot and there's maybe 6 lots that are double lots. The rest are all 75' lots. Hers is 112' 113' and mines 113 because I own 3 lots and I split one. Basically there's it's all in keeping with the neighborhood completely 100% and now as far as Slavin goes I'll tell you a little story he's sorry he's at Southold Town I built his house originally then he got a man in there to put an addition on years later when Howard Terry was a building inspector and he built it a little too close to the road.
