SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.519-acre parcel has 238.3 ft. frontage along the north side of NYS Route 25 (or Main Road) at East Marion. The property is located in the Limited Business Zone District and improved with a restaurant and small cabin structures, shown on the map prepared by Young & Young, L.S. dated June 19, 2002, revised March 3, 2003. The applicants also have a parking lease with the owner (Village of Greenport) for their restaurant's expanded parking on the adjacent parcel (CTM 1000-35-2-15.1 of .7658 acre). BASIS OF APPLICATION: Building Department's August 14, 2001 Notice of Disapproval, amended March 13, 2003, citing Section 100-244B, in its denial of a building permit to construct hotel units in this Limited Business (LB) Zone District, after removal of the existing cabin structures. The new hotel units are proposed to be located at less than 20 feet on a single side yard, less than 45 feet for both side yards (total), and less than 75 feet in the rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 15, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant is requesting Variances for setbacks of the proposed new buildings, after removal of existing frame buildings and noted on the plan prepared by Young & Young, L.S. revised March 3, 2003. The closest setbacks are shown for Duplex Units 7/8 at 20 feet from the northerly rear lot line; Duplex Units 9/10 at 23.64 feet from the northerly rear lot line; Duplex Units 5/6 at 12 feet from the westerly side lot line; Duplex Units 3/4 at 10.99 feet from the westerly side lot line. • Page 2—June 5, 2003 Appl. No. 5019—Giannaris and others 35-2-14 at East Marion REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the setbacks requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Applicants have applied for replacement of up to 14 buildings with a total of ten (10) new duplex units in a total of five (5) new buildings. The new buildings are being located on site in a circular configuration adjacent to a large parking lot and existing restaurant, located on the east side of the property. Applicants' proposals have been the nature of many agency reviews during the past six years. The reason for this request is for consideration of the setbacks of the proposed five new buildings, based upon the March 3, 2003 revised plan and Building Department's March 13, 2003 amended Notice of Disapproval. At the public hearing no information was furnished to indicate that the requested variances would produce undesirable character changes in the neighborhood or to nearby properties. The property is surrounded on the north and west sides by the Island's End Golf Club properties, and the east by land owned by the Village of Greenport (leased parking lot), and a private access right-of-way and residences. It is the determination of the Board that the grant of the requested setback variances will not in any way alter the character of the neighborhood or district. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Based on the March 3, 2003 revised survey, the duplex units as proposed are positioned on a circular court on the westerly portion of the property. The purpose of this configuration was to maximize the area needed for parking of the restaurant. The relief granted addresses this alternative requested by applicant, based on the amendments and removal of existing nonconforming buildings in nonconforming locations. 3. The relief requested is not substantial. During on-site inspections and knowledge of the history of the property ("Hellenic Cabins"), and the Town's Assessment records, the property has about 14 buildings, many of which are in nonconforming locations and all of which will be removed or demolished, and replaced with five (5) duplex buildings in locations more conforming than the existing setbacks. 4. The request for variances is self-created. All of the construction will be placed in the westerly section of the property. This area is smaller than the area occupied by cabins, and the site plan/survey affords a greater area of open space and areas slated for parking. 5. No evidence has been submitted to suggest that the grant of setback variances for new duplex buildings, after removal of existing nonconforming structures, will have an adverse impact on physical or environmental conditions in the neighborhood. Grant of the requested setback relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new construction in this Limited Business Zone District, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Tortora, and duly carried, to GRANT the Variance as applied for and shown on the plan prepared by Young & Young, L.S. dated June 19, 2002, revised March 3, 2003. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. CC: file, Z.B.A. Reason for Appeal Continued Zoning Board of Appeals re: Hellenic Hotel Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. This property has been used as resort hotel units since prior to zoning, the existing structures were developed in the 1940 ' s within a few feet of the property line . The "neighborhood" consists of a golf course and a parking lot leased from the Suffolk County Water Authority (formerly Village of Greenport Water District) . The proposed placement of the structures provides space between the units and avoids congestion of the units . The setbacks do not allow for good site plan design therefore variances are requested. The site plan was submitted to the Planning Board and the Architectural Review Committee reviewed the plan and agreed with the proposed placement of the units . The units will enhance the character of the area. The required variance for each unit has been identified on the plan, however, in order to give the Planning Board flexibility we would recommend a "not to exceed" setback to the property line . With regard to the pool, the pool has been located on the property as an integrated part of the site plan. The pool in the "back yard" of the hotel units would push the units toward the restaurant and towards the street . The design of the site plan would be compromised. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The units would have to be connected and look too commercial . The separation of the units on the property can only be accomplished by variances from the property line . With regard to the pool, the intent of a resort motel is for privacy and vacation enjoyment . Pushing the pool to the back will require the units to move closer to the road and make the site plan look like a "motor lodge" . This would detract from the rural character of the site plan. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . The existing cottages are nonconforming buildings with conforming uses . Town Code section 100-242 allows the enlargement of a nonconforming building as long as one does not increase the degree of nonconformance . The proposed units reduce the nonconformance to the minimum necessary to provide for a well designed site plan. With regard to the pool, the pool has been integrated into the site plan which is in the rear yard of the restaurant . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . No adverse impact to the district, the cottages will conform to Health Department standards and New York State Fire Prevention and Building Code. The pool is an amenity which will not adversely impact the physical on environmental conditions in the district . 5 . The alleged difficulty was not self-created. The existing cottages are preexisting nonconforming structures, the number of units have been reduced, and a good site plan requires better placement of the units then the code permits . By analogy, the development of the units is similar to the site planning of a condominium development . In a condominium development the setbacks consider site plan elements over the single family setback regulations in the zoning code. Consequently, the Planning Board is given flexibility of design. The pool is consistent with the design elements of the site plan. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The units and pool are placed away from the restaurant and towards the golf course. The golf course provides desirable open space, privacy from the restaurant patrons and aesthetic views . The Planning Board notes that the present application has been downsized from the original proposal, only 10 hotel units are now shown on the plans, and the swimming pool has been eliminated. Most of the other changes reflect Health Department requirements for an upgraded sanitary system for the existing Hellenic restaurant. The Planning Board notes that a new parking area will be created behind the restaurant, and is concerned about the significant grade change between the existing parking lot to the east, and the new parking lot and access to the motel units. We note that several large trees are now located on the intervening slope, and would like to preserve as much of the natural landscaping as possible on the slope. The Planning Board also is concerned that the main restaurant parking lot to the east, currently leased to applicant by the SCWA, should be secured by a very long lease to provide guaranteed parking for the restaurant. We also note that the lot is not well maintained, and improperly drained. The Planning Board has no objection to the pending ZBA application pertaining to the sideyard setbacks. I presented this plan to the building department and they have issued an amended notice of disapproval dated January 22 , 2003 . The project has been revised to 10 one story hotel units, the use of "hotel" is a permitted use in LB zoning. The proposed buildings are shown on the Young & Young "Health Department site plan" with the setbacks of each unit shown. We have previously provided an "existing conditions" survey which shows the setbacks of the existing buildings . In order to place the new buildings in the proposed location setback variances are requested. The variances for setback will enable this project to be developed better and less congested. Compliance with setbacks would force the buildings to be bunched together or attached as one building. The plan has been submitted to the Planning Board, however, a final engineered site plan can not be prepared until the buildings are located on the property (WITH VARIANCES) . The Health Department has reviewed the plan and my client advises me that they have approved the new sanitary system for the existing restaurant and proposed hotel units. My clients are very anxious to remove the old cottages, howver, we are awaiting this variance. This matter is ready for the board' s consideration, we would ask that you place this matter on your calender immediately. The Zoning Board advised me that they would not place it on the calender until the SEQRA was complete, the Planning Board granted a Negative Declaration on July 8, 2002 .
