MEETING OF MAY 15, 2003 oddholk Tows Clerk Appl. No. 5251 - JOSEPH and THERESE CIAMPA Property Location: 650 Beachwood Lane, Southold; Parcel 1000-70-10-56. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 19,575 sq. ft. parcel has a frontage of 135 feet along the south side of Beachwood Lane, Southold, and a depth of 167.77 feet along the west side line, a depth of 178.80 feet along the east side line, and width of 121.04 feet along the rear property (tie lines at mean high water). The property is improved with an existing split-level dwelling with existing open front porch and rear deck. BASIS OF APPLICATION: Building Department's September 16, 2002 Notice of Disapproval, amended December 11, 2002, citing Sections 100-244, 100-239.4B, and 100-33 in its denial of a building permit for an accessory swimming pool in an area other than the required rear yard and deck construction: (a) at less than 10 feet on a single side yard, (b) with total lot coverage over the code's 20% limitation, and (c) at less than 75 feet to the concrete retaining wall. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on March 20, 2003 and May 1, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct an 18' x 36' accessory in-ground swimming pool and a stone wall surrounding the pool with fence enclosure at 35 feet from the existing concrete retaining all along the edge of wetlands. Also shown on the plan are proposed deck addition and front entry, landward of the established 30 ft. setback from the bulkhead, at its closest point. Together with the pool and the deck additions, and exclusive of the stone terrace surrounding the pool and steps to grade, the overall lot coverage is shown on the site plan (SP-1) revised 5-13-03 will be 21.2%. The westerly side yard setback for the pool with terrace will be 10 feet at its closest point (15 feet to the pool), and the remaining easterly side yard will remain at its established 8.9 feet. Ciampa 70-10-56 at Southold REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the alternate relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Originally, the applicants requested several raised accessory structures (elevated pool with terrace surrounding the pool, deck additions, and stone walks seaward of the existing home). During the hearings, the architect/agent for the applicant was asked to scale back the project from a proposed lot coverage of 22.5% to approximately 21%. By letter dated May 13, 2003, Architect Garrett Strang confirmed that the northeast section of the roofed, open front porch has been deleted in the amount of 152 sq. ft., and the existing open center section of the rear deck will remain open, eliminating 98 sq. ft. The revised plan dated 5-13-03 confirms 21.2% lot coverage. The neighbor on the west side of the pool in the area of the proposed pool is a community beach which would allow emergency access if needed behind the house and new construction. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Applicants have a well-established high-level ranch home built about 1970 which, after the pool is terraced areas are added, would be centered on the property. The property is +-140 ft. deep on the west side (to the concrete retaining wall) and has a substandard size of 19,575 sq. ft. It is not uncommon for lots of this size to require a minor lot coverage variance, and the pool with terrace require an elevation above grade due to the low contours and ground water levels (FEMA). 3. The relief requested is substantial. However due to the existing location of the house and the property size, the applicants request is not unreasonable when using the scaled- down plan for a maximum lot coverage is not unreasonable. 4. The alleged difficulty is self-created, based on the location of the house on a waterfront lot which dictates the location and size of all accessory structures both at the time of construction and in future planning. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and deck additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Ciampa 70-10-56 at Southold RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Horning, and duly carried, to DENY the relief requested for 22% lot coverage, and to GRANT Alternate Relief as shown on the May 13, 2003 revised site plan prepared by Garrett Strang, Architect, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The stone terrace footpath shall be at ground level for the purpose of gaining clear access in any emergency; 2. The side yards shall be open and unobstructed for a minimum width of 10 feet between the westerly property line and the raised terrace/path areas, and a minimum width of 8'9" (existing setback) between the easterly property line and the raised (building) area. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In addition, the proposed construction of an accessory in-ground swimming pool is not permitted pursuant to Article III, Section 100-33,which states; "In the Agricultural-Conservation District and Low-Density Residential R-80, R-120, R-200 and R-400 Districts, accessory buildings and-structures or other accessory uses shall be located in the required rear yard." The proposed accessory in-ground swimming pool is noted as being in the side yard. (SLC Our concerns remain the same as they were when the Ciampa's first applied for several variances. At that time we wrote a letter to the Board of Trustees. The pool request places the pool too close to the community beach and property line. If the application is granted it will set an example for anyone to place a pool on the side yard. The community beach area is open to all residents in Southwood and the pool and fence would be placed entirely too close to the property line. There are several homes within Southwood located on the water that have pools in the rear yard. At the site there are already stakes for the pool and fence. Has this been approved before the hearing? On the blueprint it says a proprosed 2'high stone wall with a 4' high pool enclosure. Does that mean 6' high total???? We also believe that the garage built on the front of the existing garage would place it too close to the road. Both of these requests should be denied not only because of Town Code but also because of the restrictions in the covenants of Southwood. Thank you for your time and consideration. Applicants propose an accessory swimming pool in an area other than the required rear yard, and additions to the existing dwelling: (a) at less than 10 feet on a single side yard, (b) with total lot coverage over the code's 20% limitation, (c) at less than 75 feet to the concrete retaining wall. Location of property: 650 Beachwood Lane, Southold; Parcel 1000-70-10-56. CHAIRWOMAN: Is someone here who would like to speak on behalf of the application? GARRETT STRANG, ARCH: I'd like to just pass up for the record a few pieces of information. One being a copy of a Trustee permit and approval and the other being just an observation that we made with respect to the neighborhood. I photocopied the tax map and what we did is mark where we could see by observation from the street lots where it appeared there may be swimming pools. CHAIRWOMAN: We have a new plan from you correct? MR. STRANG: Yes subsequent to the last meeting as per your request. CHAIRWOMAN: The trustee, there's just 1 copy? MR. STRANG: Just 1 copy yes. CHAIRWOMAN: We now have the house at 15? MR. STRANG: We've pulled the pool itself back as shown on the plan and as discussed at the last hearing. It's now 15' from the property line and the terrace that surrounds the pool is now 10' from the property line. There should have been 7 copies of that I thought, yes. MEMBER GOEHRINGER: Have we determined if the patio is at ground level? MR. STRANG: The existing grade is approximately elevation 6. Femur requires that the construction be elevation 8 so the terrace and the pool is elevated to we're showing 8.25 we could bring it to 8 even but we're factoring a little bit of safety there if will. CHAIRWOMAN: The original plan was 15 on the pool right? MR. STRANG: The original plan was 12 I believe. What we've done is reduced the size of the terrace. STRANG: The reason we hadn't moved the pool is if you look in the cover letter, you'll find the pool as it's shown is and as it exists 7' from the building so we really couldn't shift the pool over so what we did was reduce to pick up the extra space that you wanted between the property line. We reduced the terrace size so we could give the 10'between the property line and the terrace. CHAIRWOMAN: And you didn't think about an indoor pool? MR. STRANG: We could put a roof over it if you like. CHAIRWOMAN: So the difference is not in the location of the pool the difference is in the size of the terrace that surrounds the pool. MR. STRANG: As it is it's really tucked in there pretty tight. We wish we had the ability to place it elsewhere but we don't unfortunately given the nature of the lots it's relatively shallow and the house exists so. MEMBER GOEHRINGER: What does that give us for lot coverage? MR. STRANG: The lot coverage is minimally reduced when you factor in the square footage that we took out I don't even know that I calculated it because it doesn't have that much of an impact so that's what it was. It may go down`to 10's of a foot. CHAIRWOMAN: Did you include that in your packet? Because it is a raised patio. MR. STRANG: According to the BD because it is not "construction" a deck as they said is their definition it is not considered in lot coverage because it's a stone terrace. It's not included in the calculation. MEMBER GOEHRINGER: Even if it is raised? MR. STRANG: I discussed it at length with them and said is it on grade fill or dirt? I said the excavation spoils are going to be placed around the pool compacted and we'll place a stone terrace on grade. MEMBER GOEHRINGER: We'd have to remember that for future situations. CHAIRWOMAN: It doesn't stand with Miriam Road. MR. STRANG: I made it a point to be perfectly clear with them when we filed our BP so the disapproval could be written properly and in fact what was given to them was the lot coverage with and without the terrace. They said the terrace isn't included because it's not is it a deck it's a stone terrace- Page 3 of 37 Page 4 May 1, 2003 Southold Town Board of Appeals Special Meeting Public Hearing CHAIRWOMAN: The reason we are asking is because we had another application about 7 months ago with a raised patio and the BD at that time included it in lot coverage because of the very reason that it was raised. MR. STRANG: I've had experience with the BD that depending on what day of the week it is depends what the determination is. MEMBER GOEHRINGER: Generally you'd want to raise it a little bit I don't mean this one but in general even on flatter property for the sole purpose of the fact that you really don't want standing water on it if it rained and the water didn't diffuse through- MR. STRANG: Well you'd want a little pitch to it. CHAIRWOMAN: They didn't do anything with the steps - that wasn't in the lot coverage? MR. STRANG: No. The only thing that deviates from the site plan that you have and the site plan they have is now we've reduced the terrace. CHAIRWOMAN: Is there anything you can do to this plan to be very blunt to cut down the total lot coverage on this? MR. STRANG: We've looked at this from every which way and we've done certain things for example and I think this is a major mitigating factor in our case if you recall the property the property has an asphalt driveway in a circular configuration as shown here in dotted lines because we are removing it as a hard surface and replacing it with a pervious surface so that the impact environmentally if you will is being lessened I know that doesn't address this board's issues with respect to physical lot coverage from the way you look at it but we are trying to mitigate the lot coverage if you will from other perspectives. MEMBER ORLANDO: Just one comment on the tax map showing identifying the pools. MR. STRANG: What I believe pools from my observations. MEMBER ORLANDO: Of the 12 houses on Beach Lane there are no waterfront- MR. STRANG: I couldn't tell because I couldn't get to the waterfront side although there was a correspondence that this board received that this board there was a copy of correspondence that came to this board that I received from a neighbor that made reference to the fact that there are other pools that exist on the waterside of houses now if that in fact is the case they were obviously put in long before DEC had jurisdiction because they had as we do in this case a bulkhead that takes DEC out of jurisdiction but they still would have had to address either this board or at the least the Trustees to get permits to get a pool. I don't have a boat so I wasn't able to go on the waterside to observe if there were pools obvious on the waterside of other homes. MR. STRANG: So alternate relief for 22.2 as opposed to we can work to that yes. MEMBER GOEHRINGER: As you can see here and I'm not speaking for the chairperson we have a limited board tonight. So I'm not sure if we'll vote tonight but in general you feel it's around 2.2- CHAIRWOMAN: You have 22.4 MR. STRANG: We have 22.4 but that was the original and I did not bother to modify that because the we are talking about 10's of a percent in reduction because we calculate the reduced terrace size but I am comfortable in accepting the 2.2 over not to exceed 2.2% over. GARRETT STRANG, ARCH: To give the board an overview of what we are presenting here and seeking from you is we have an existing single family dwelling. It was built in the mid 70's. It has nonconforming setbacks to the house and the existing deck from the stone wall that presently exists. The setback to the house is 32'. The setback to the deck is 30' from this concrete retaining wall. To the best of my knowledge when the house and the deck and the light were built back in the mid 70's by the previous owner they were all done with the necessary permits and approvals at that time and there is a CO on everything there that exists. The work we are proposing at this time for my client who wishes to make improvements to the house and make it a little bit - add some amenities to the house includes a garage addition and a front entry porch on the north side of the house as shown on the site plan. All these items are shown on the site plan. There is a minimal deck addition with steps to grade proposed on the south side of the house. We would like to increase the roof pitch to improve the appearance of the house. It has a relatively flat hipped styled roof presently and we feel that somewhat out of character with the neighborhood, but somewhat undesirable in appearance in general so we want to increase the roof pitch on the house and lastly we want to have a swimming pool with a stone terrace surrounding it on the west side of the house. CHAIRWOMAN: Is it going to be grade level that where the patio is around the pool? MR. STRANG: The pool and the patio have to be elevated 2' to meet FEMA requirements. The property is in a flood plain. Minimum elevation required by FEMA is 8' and the grade is approximately 6'. We come up with 2' above grade. CHAIRWOMAN: Then the stone terrace around the pool is calculated or is not calculated in lot coverage? MR. STRANG: In my discussions with the Building Department they indicated that inasmuch as it was a stone terrace that would basically be on the fill spoils from the excavation from the pool and not a deck per say. If it were a deck it would be considered lot coverage not being a deck,being a stone surface on dirt if you will it's that they don't deem it to be lot coverage and wrote the disapproval accordingly. Page 22 of 96 Page 23 March 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing CHAIRWOMAN: What is going to contain the elevation? Are you going to raise the grade, how are you going to contain it? MR. STRANG: We are proposing a decorative landscape stone wall around the perimeter of the terrace. Something very attractive. CHAIRWOMAN: As far as the access to the retaining wall is that also elevated or not? MR. STRANG: The access to the terrace area is by a couple of steps which are on the south side of the house again they are shown on the site plan. I can show it to you if it's not clear. There's only one entry point shown on the site plan and that's on the water side if you will. CHAIRWOMAN: The reason the lot coverage went from 27 down to what are we at now? MR. STRANG: I showed it both ways for clarification purposes so the BD as well as this board and without the stone terrace it's at 22.4%. CHAIRWOMAN: It's a lot of building for this size lot even though we are talking about terraces. Yes it's going to be raised. The pool itself in the proposed side yard is actually 15' from the neighbors property line. The terrace with the raised wall looks to be about 2 or 3'. Is that correct? MR. STRANG: Probably closed to 5' we have about 10' from the pool we could probably be a little less than that if we so choose, but I call to the board's attention that the zoning allows it to be as close as 3'to the property line as an accessory structure. CHAIRWOMAN: Zoning requires it to be in the rear yard. MR. STRANG: Which obviously isn't a option for us given the fact that we have to be 75'back from the stone retaining wall. CHAIRWOMAN: But it's within a side yard that the board decides it's not 3' or 5- MR. STRANG: Just in general, the zoning to an accessory structure is 3' off a lot line. Zoning also allows us to put it in the front yard but that's impractical and certainly undesirable. CHAIRWOMAN: As a practical matter that's very close to the neighbor's property line. You've got the terrace whether it's 3' or 5' from the property line- that's not something I personally would look favorably on particularly in view of the fact that it looks like you can move the pool Page 23 of 96 Page 24 March 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing closer to the house. That's just my personal comment. I'd like to hear the other board members comments on that too. MR. STRANG: Could I address this? The neighbor if you will on the pool side of the house is the community beach. It's not a residential piece of property or property that can become a residential. If we look at it realistically, a community beach is more of an encumbrance on my client because of the activity and the like that goes on at the beach than a single family residence pool might be to the community beach property. MEMBER HORNING: I was looking at the terraced area and the significance of the stone area is irrelevant, it's the placement of the pool that's important. And I can see on this lot there's not a whole lot of area to work with so I don't know if they want a pool how they could have one other than a side yard really. I don't have any comment. MEMBER GOEHRINGER: As you know in the past my concerns have always been in closing up of side yards. Although you have raised an interesting point regarding the community beach access. Is there a possibility your client could get a letter from the association requesting that if there need be access to the waterside area to this property they would allow him access to that through the ROW? Because if you look at it, you only have 8.9' on the opposite side and with this rather ambitious plan you're not going to be able to run over anything with a stone with heavy equipment. So the only way you are going to get anything on that side of the house is through that if the board is so inclined to deal with that. If you are not successful in that, we definitely need to move the pool over closer to the house structurally as much as you could. They may have to downsize the pool. They might have to make the pool a lap pool instead of a true swimming pool maximum depth of 6 or 8'. That's my suggestion. MR. STRANG: What would be an acceptable alleyway I'll use as a term for emergency vehicle access between the property line and the terrace? MEMBER GOEHRINGER: It's not really emergency vehicle, it's the ability to get to that waterfront for whatever reason,maintenance, anything at this point. I have to tell you that I would say that 4-6' is definitely an area that you need to that stone wall bearing in mind that there'd be no closing up on the other side and of course bearing in mind also that the association would let you certainly in a fire issue the fire department's going to use the community beach as implied access anyway. MR. STRANG: For the record presently, although it's not physically dimensioned on the drawing, the scaling is accurate. From the property line to the edge of the wall of the terrace is 6'. CHAIRWOMAN: There's a fence there now? Page 24 of 96 Page 25 March 20, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing MR. STRANG: There's a fence on the community beach property line. CHAIRWOMAN: What type? MR. STRANG: Chain link. CHAIRWOMAN: If there's a chain link fence then in order to get access, you'd have to put a gate around it. MR. STRANG: If you were to gain access from the beach side to the rear property of my client, yes there would need to be some sort of a gate. I'm not sure of the ownership of the fence, that's a question that hadn't arisen before so I haven't researched that, I don't know if it's in fact the community fence or my client's fence,but we can certainly check into that. Once again as far as a vehicle getting through 6' would be tough on it unless it was a small vehicle. It's possible we could reduce the terrace if my clients was accepting of that idea I can discuss that with them. Reduce the size of the terrace and/or shift the pool a little bit to give a bit more of an alleyway there. CHAIRWOMAN: If the fence is the property of the community and it is a chain link fence I think there is an issue of concern of access is even greater for fire. I don't see how you could possibly get any fire vehicles to the rear of this property. MR. STRANG: If we were to build out by code an actual physical structure i.e. an addition to the house I guess we'd have to be 15' off the property line since we have the nonconforming on the other side- CHAIRWOMAN: Which is the code's purpose of having the 15'minimum. I share Mr. Goehringer's concerns and I think really it's a very nice designed pool, the kidney shape,but I think you should pull it over to the house to give clearance. MR. STRANG: What would be the minimum clearance this board would look for this access- way? CHAIRWOMAN: 38' to the house. MR. STRANG: Right now it's 30'to the corner of the garage. It's 38' to the corner of the house. MEMBER ORLANDO: I'm going to interject before they close this on me. I drove the neighborhood and I didn't see any pools in the neighborhood. STRANG: There are a few - I think there's a neighbor who sent a letter making reference to the fact that there are other pools on the waterside in the community. They must have pre-dated the 75' setback requirement of this board. MEMBER ORLANDO: I couldn't see anything from the roadside anyway. I personally am not in favor of putting the pool right there. I'm in favor of a 38' sideyard setback myself. MR. STRANG: 38' is far more than what the code requires, a minimum is 15. CHAIRWOMAN: I think he just said he wasn't willing to grant a variance there. MEMBER ORLANDO: This survey is busy. That's my comment. MR. STRANG: That might be because I've tried to certain things to have it read better. I think when you see it in reality it's not going to be as busy as it does when you look at it pictorially in this fashion but I appreciate your concern with respect to that. My client needs to have at least a swimming pool for recreational purposes and use of the house and also address the concerns this board may have. MEMBER OLIVA: I agree also that the pool should be moved closer to the house so you can have access right now. The garage goes under the house? MR. STRANG: That will be abandoned actually. The garage that's under the house is unusable. It's more of a utility area if you will. It doesn't really function. The new garage is forward of the house as shown and at grade level. It's not going to be subterranean. MEMBER OLIVA: That will be at 8? MR. STRANG: The garages don't have to be at 8 because their purpose is housing a vehicle,but it will be a grade that is probably at 6'. I CHAIRWOMAN: Let's see what happens.
